B. POWER OVER PERFORMANCE EVALUATION.

Agency performance evaluation system.

C. POWER TO PROMOTE PERSONNEL. Merit promotion plans. system of ranking position. Evaluating candidates for promotion. Integrity factor. Appointing power has discretion to

select men of integrity.

D. POWER TO ASSIGN AND TRANSFER PERSONNEL

Discretionary power to assign and reassign personnel.

Power to reassign and transfer should be excused with caution.

E. POWER TO INSTITUTE ADMINISTRATIVE DISCIPLINARY ACTION AND IMPOSE PENALTIES

PROCEDURE IN CONDUCTING ADMINISTRATIVE CASES AGAINST NON- PRESIDENTIAL APPOINTEES.

a. Administrative proceeding maybe commenced against a subordinate by the head of agency, or upon sworn written complaint by any other person.

b. If the complaint is filed by any other persons the complainant shall submit sworn statements of his testimony and those of his witnesses together with his documentary evidence.

c. If the head of agency finds a primafacie case he shall notify in writing the respondent, attaching copies of the complaint, the sworn statements and other submitted documents

d. The respondents shall be allowed not less than 72 hours after receipt of the complaint to answer the charges in writing under oath together with his supporting sworn statements and documents, where he may indicate whether or not he elects a formal investigation.

e. If the respondents answer is found satisfactory the agency head shall dismiss the case.

f. If a formal investigation shall be conducted it shall be held not earlier than 5 days nor later than 10 days from receipt of respondent’s answer by the disciplinary authority and shall be finished written a 3 days from filing of the charges, unless the period is extended by the civil service commission.
