FROM THE EXECUTIVE DIRECTOR
Does our state’s legislature represent the will and pri-orities of Arizona’s citizens? Theoretically, yes. Practically, as our students would say, “not so much.”
When we vote, we, the people, invest our trust, expectations and greatest hopes in individuals who we believe will best articulate our views at the Capitol in the form of new laws and allocation of state resources. Arizona’s education leaders – school board members, administrators, teachers, and myriad business, community and parent advocates – often make the best interest of schools and students the deciding factor when selecting a candidate.
Are those of us who count education as Arizona’s top priority having our expectations met by our elected representatives? Each year, the Arizona School Boards Association tracks and publishes the voting records of our state legislators on key bills impacting education in Arizona. I’ll let you decide whether or not your expectations are being met after perusing the voting records in this special issue – those for your district and for legislators statewide.
Whether your answer is “yes” or “no,” one thing is certain. These votes are a snapshot of votes that were made years ago – the last time we had a general election. These votes represent those who voted in the primary and general election of 2010. The results shown in these voting records are also a snapshot of those who didn’t vote. Expectations and great hopes are hollow without action. Voting matters – both in the general and the primary election! (In fact, in most districts, general election outcomes are essentially decided in the primary election; if you neglect to vote in the primary and vote only in the general election, you’ve exercised only half your right to vote – and, as history has proven again and again, it may be the least important half.)
As individuals, we must engage in this most important of civic duties. And as leaders – especially elected leaders – we must find ways to encourage others to exercise their right and responsibility to vote. As you do so, feel free to share the voting records in this issue to help those in your circle of inf luence understand what it truly means to support education in Arizona. And what it looks like when our elected leaders don’t.

It’s a Fact:Independents Can Vote in the PrimaryAnd they should! Independent voters account for one-third of the state’s electorate. Independent voters who go to the polls will be asked to choose a ballot – Republican or Democratic. Those registered Independent may also request an early ballot – again, either Republican or Democratic – and vote by mail; simply contact your county elections office for details. This early ballot choice doesn’t lock Independents it to receiving a certain party ballot in future elections; the choice can be made each cycle.

Accountability Is A Two-Way StreetFind Out How Your Legislators Voted on Key K-12 Issues in the 2012 Session
The 2012 Legislative Session adjourned sine die on Thursday, May 3, at 8:25 p.m. after a 116-day session. The General Effective date for chaptered
bills will be Aug. 2, 2012. The exception is bills passed with an emergency clause, which took effect immediately, or those passed with a retroactivity clause.
The expansion of private school tax credits and vouchers made this an extremely disappointing year for Arizona K-12 education. Even so, it’s important to note the small victories. There were no additional budget cuts, and a small increase in K-3 reading resources was provided. In addition, ASBA effectively and successfully worked with legislators to amend bills that would have either been problematic or harmful to schools.
ASBA is committed to ensuring our members’ voices will continue to be heard at the Capitol and within the regulatory arena. School board members are either helped or hindered by legislative action as they work to ensure our students have a quality education. That is why being aware of the legislative voting records shown on the following
pages is so critical. Our goal is for school boards to be able to make the best choices for student academic success, rather than having to make choices with an eye towards what will be least harmful. We must honor those who help us toward this goal and hold those accountable that do not.
It is particularly important to note that the voting records contained in this issue of the ASBA Journal are organized by the districts that existed during the last general election. In 2012, legislative races will be based on newly formed districts with new boundaries and new district numbers. (Every decade, every state including Arizona goes through a redistricting process based on updated census counts. Thus, legislative district numbers and geographic boundaries for elections beginning with those in 2012 have changed significantly.)
Many of the same legislators that currently hold office will be up for election but in one of the newly formed and numbered districts. It is imperative that you are aware of your new legislative district and currently serving legislators who may be running for a seat there (see Spring ASBA Journal article). The voting records on the following pages provide an excellent starting point for conversation with these individuals, and will enable school board members and other public education leaders to hold legislators accountable for the positive and negative votes cast on K-12 education legislation.

Key K-12 Legislation for 2012 The legislative voting records on the following pages graphically depict how Arizona state legislators voted on the bills summarized below. For a detailed summary of K-12 education bills, please consult the Legislative Wrap-Up Brief.
HB 2075 (schools; consolidation; unification – Fillmore) This bill would have required county school superintendents to commence school district unification and consolidation feasibility studies and appropriated funds for these studies. ASBA opposed; Failed the Senate Appropriations Committee.
HB 2622 (school rankings; display; time period – Lesko) This bill expands eligibility for the Arizona Empowerment Scholarship Accounts program and prohibits a school from displaying a classification or ranking that is no longer current unless the date the classification or ranking was received is prominently shown. ASBA opposed; Chapter 360; 2012 Laws.
HB 2760 (publicity pamphlets; bond elections – Olson) This bill requires the district governing board to declare a ballot argument deadline (that has been set by the county school superintendent) at the same public meeting that the override election is called and must immediately post the deadline in a prominent location on the district’s website. In addition, the bill requires a governing board to set a deadline to submit arguments for bonds at a public meeting and publish the deadline in a newspaper of general circulation... ASBA opposed; Chapter 129; 2012 Laws.
HB 2823 (schools; teachers; principals; evaluation systems – Goodale) This bill makes various changes to principal and teacher evaluations, including teacher and principal incentive and consequence policies and an alternative timeline for those districts not ready for the 2012-13 school year. ASBA supported; Chapter 259; 2012 Laws.
HCR 2037 (budget stabilization fund; expenditures – Olson) This bill would have put on the November 2012 ballot a state General Fund revenue limitation and outlines guidelines for the growth and reductions in revenues (i.e. TABOR). ASBA opposed; Failed Senate Third Read.
SB 1047 (school tuition organizations; credits; administration – Murphy) This bill creates an additional tax credit for private schools ($500/single; $1000/joint), at an estimated cost of $4 million annually, not including the requirement that an annual inflationary increase be had, except that they cannot be adjusted downward. In addition, it removes the requirement that a school annually administers and make available to the public aggregate test scores of its students on a nationally norm-referenced test, preferably AIMS. ASBA opposed; Chapter 4; 2012 Laws.
SB 1059 (school property; community use; liability – Crandall) This bill provides immunity from liability to schools if they choose to open their school grounds for use during non-instructional hours. ASBA supported; Chapter 14; 2012 Laws.
SB 1060 (school districts; procurement practices – Crandall) This bill allows maximum dollar amount of a single job order for job-order-contracting construction services to be $1 million or a higher or lower amount prescribed by a governing board policy and is limited to no more than 5 years unless the governing board determines in writing that a longer contract is beneficial. ASBA supported; Chapter 279; 2012 Laws.
SB 1258 (third-grade promotions; requirements; exceptions – Crandall) This bill removes the majority of the current good cause exemptions, except ELL, to retaining a third-grade student whose reading score falls far below the third-grade level and allows the promotion of a student with a disability under certain conditions. ASBA was neutral; Chapter 150; 2012 Laws.
SB 1259 (digital learning; course choice – Crandall) This bill would, beginning July 1, 2013, allow students in grades 7-12 to enroll in at least two online courses per year, requires ADE or an organization selected by ADE maintain a master list of online courses approved by the SBE, and sets up course funding percentages and fees. Arizona Online Instruction (AOI) providers and other online instruction providers are grandfathered until school year 2019-20 when they will have to submit an application for approval. ASBA supported; vetoed.
SB 1275 (state budget; appropriation limitation; hearing – Smith) This bill establishes Truth in Spending estimates, requires a joint legislative hearing if the Legislature proposes appropriations that exceed those estimates and outlines public notice requirements. ASBA opposed; vetoed.
SB 1529 (K-12 education; budget reconciliation; 2012-2013 – Shooter) This bill is the K-12 education budget bill for Fiscal Year 2013. ASBA opposed; Chapter 300; 2012 Laws.
