Q. For three years I’ve had a tenantin a two bedroom house on my prop-erty, a single man, who makes period-ic trips to the Mainland. He’s oftengone for as long as a week but has anemployee who stops by to keep an eyeon things and checks in with me...ifrent is due while he’s away, theemployee drops it off. Last week, heleft without notice due to a familyemergency. He didn’t contact medirectly, but sent his brother to seeme, a young man who recently movedhere and was in between rentals. Hehas a job and has supplied me withsocial security number and bankinformation. He said his brother, thetenant, would probably be away foran indefinite period of time and want-ed me to turn the house over to himfor the interim. The young man hadactually already moved in because hisbrother left him the key. I pointed outthat there was documentationinvolved, so even though I allowedhim to stay we still needed to makeeverything official. To complicatematters, he wants a friend to stay inthe second bedroom to help him meetthe rent obligation. So I have severalquestions...can a tenant with a stan-dard lease in force simply designateanother individual to take over therental while he’s away...if I’m OK withthe designated individual, what kindof documentation does he need tocomplete...then, if he has a friend alsostaying in the rental to help defraycost, does the friend share responsi-bility for payment of the rent? I havetold the tenant’s brother that he isresponsible for making the monthlypayment and personally delivering itto me...I don’t want to deal with theother individual to collect rent but isit OK to include her on whatever doc-umentation you recommend so I atleast have a record of who is stayingin the house.
A. This appears to be a somewhatcomplicated question, but my answer israther simple. My answer also assumesyou are using the Hawaii Association ofRealtors Standard lease and my refer-ences to the lease reflect its terms and
conditions.You have a lease in place with the
current tenant and under the lease(whether it is fixed or month to month)he is not allowed to sublet (allow some-one else to take over) without yourprior permission, so he is in breach ofhis lease. I suggest you require that thenew occupants complete an applicationand go through the standard applica-tion process that you require of everytenant even though it is after the fact. Iwould then suggest that you requirethat the lease be re-written and have allparties over 18 years of age on thelease so that each of the 3 partiesinvolved is 100% responsible for therent and any damages. If there are mul-tiple adults on a lease, each is responsi-ble for 100% of the rent (not 1/3 each)and 100% of damages regardless whocaused them. In other words, if one ten-ant does not pay his share, you can goafter the remaining tenants for the bal-ance of the rent. If the friend is not onthe lease as a tenant, he/she is not sub-ject to the requirements of the lease, sowould not be responsible to you forany rent or damages.
If you allow the brother’s friend tomove in but do not want him/her as astated tenant on the lease for some rea-son, I would suggest that under specialterms you indicate that they areallowed to occupy the premises, other-wise they will be in breach of Section 4of the lease stating that no guest shallstay more than 14 days.
All of this being said, nothing is moreimportant than confirming with yourcurrent tenant that he has given hisbrother and friend permission to bethere. At that time you can discuss theterms you will require of him to bringhim into compliance with his lease,including rewriting the lease to add theadditional individuals.
