Electrical Energy Suppliers

• A licensee or supply authority who

supplies electrical energy to any

installation

• Regulation 5 : Obligation to submit

Electrical Energy Consumers & Generators

• Any installation which receives electrical energy from a licensee or supply authority with a total electrical energy consumption equal to or exceeding 3,000,000 kWh as measured at one metering point or more over any period not exceeding six consecutive months

• Any installation which is used, worked or operated by a private installation licensee with a total net electrical energy generation equal to or exceeding 3,000,000 kWh over any period not exceeding six consecutive months(Generating electrical energy for own consumption only)

Regulation 5 : Obligation To Submit

Information To The Commission

• Electrical energy supplier/generator To submit to the Commission information or documents

regarding the names and particulars of consumers/generators whose total electrical energy consumption/generation over any period not exceeding six consecutive months equals to or exceeds 3,000,000 kWh, not later than one month after the expiry of the period of six consecutive months from the effective date

shall ensure that the information or documents provided are true, accurate and complete and shall provide a representation to that effect, including a representation that he or it is not aware of any other information which would make the information provided untrue or misleading

Regulation 16:

Notification By The Commission

• Upon received the notification by the Commission

• By hand/registered post addressed according to information received from energy suppliers and affected private licensees.

Policy

• The statement of policy for efficient electrical energy management of the installation

• The specific policy statement on efficient management of electrical energy or apart of other policies that has been developed and introduced for implementation at the installation.

• To be included in the policy statement:

– The commitment in efficient management of electrical energy to improve energy efficiency usage continually.

– The commitment to address and act towards processes and activities that will give impact on the performance of electrical energy usage at the installation; and/or

– The commitment to ensure compliance towards the Act and regulations on efficient management of electrical energy.

Objectives

• The objectives of efficient electrical energy management

• The target or objective of energy savings from the implementation of efficient energy management policy introduced by the owner of installation

– achievable electrical energy saving target for the

installation for short, medium and long terms.

– the methodology to measure electrical energy saving target based on performance indicator established by the owner of the installation.

B. Comprehensive energy audit report or apart of the report

– availability of efficient management of electrical energy practices at the installation.

– electrical energy supplied to the installation

– electrical energy consumption:-

• Daily/weekly/monthly load profile in kW

• Load distribution of electrical energy consumption according to equipment in energy unit(kWh) and percentage(%) of each load.

• operating hours of the installation and major electrical energy using equipment.

Accounts And Documents

B. Comprehensive energy audit report or apart of the report

– energy saving measures and estimated energy saving value in energy unit (kWh) for each measure:

• description of each saving measure and how to implement

• estimated energy saving value for each saving measure according to:-

– no or low cost required to be implemented; and/or

– high cost required to be implemented.

• method of measurement/calculation to determine and verify the energy saving achieved

• estimated return of investment/financial analysis used by the owner of the installation for economic evaluation

• implementation plan and estimated time required to implement

Regulation 9 :Review

• The Commission may, at any time after receiving the information and report under regulation 6, review the obligations of the private installation licensee or consumer by considering –

(a) that the total net electrical energy generation or total electrical energy consumption for the reported period in

Form A of the Second Schedule is below 3,000,000 kWh;

(b) that the installation has fully complied with the requirements

of these Regulations; and

(c) any other reason which the Commission deems fit to show efficient management of electrical energy at the installation

• The Commission shall, after reviewing the obligations of the installation by written notice notify the installation that he or it is no longer required to further submit the information and report as specified in regulation 6

Regulation 10 :Withdrawal

• The Commission may, at any time after the issuance of the written notice under subregulation 9(2) to any installation, withdraw that notice if –

(a) the total electrical energy consumption or total net electrical energy generation at the installation over any period of six consecutive months after the date of issue of the notice equals to or exceeds 3,000,000 kWh; or

(b) for any other reason as the Commission deems fit, it is satisfied that the installation has not practised efficient management of electrical energy at the installation after the date of issue of the notice.

• Any private installation licensee or consumer to whom the written

notice issued is withdrawn shall become subject to these Regulations with effect from the date of withdrawal of the notice

• Any withdrawal of the written notice issued by the Commission

shall be in writing and served upon the installation

• No person shall engage in, be employed or hold

himself out as a registered electrical energy

manager for the purposes of these Regulations

unless the person has been registered by the

Commission

Regulation 16 :Functions And Duties Of

Electrical Energy Manager

• To audit and analyse the total electrical energy consumption or generation

• To advise in developing and implementing measures to ensure efficient management of electrical energy at the installation

• To monitor effective implementation of the measures

• To supervise the keeping of records on efficient management of electrical energy at the installation and verify its accuracy; and

• To ensure the timely submission of information and reports under the regulations.

Regulation 12:

Qualification Requirements

A Malaysian citizen aged 23 years and above who –

(i) holds a certificate of registration as a Professional Engineer under the Registration of Engineers Act 1967 [Act 138] and possesses at least six months working experience in the efficient management of electrical energy at an installation; or

(ii) holds a degree in Science, Engineering, Architecture or its equivalent and possesses at least one year working experience in the efficient management of electrical energy at an installation; or

(iii) holds a Certificate of Competency issued by the Commission as an Electrical Services Engineer or a Competent Electrical Engineer and possesses at least nine months working experience in the efficient management of electrical energy at an installation; and

Regulation 12:

Qualification Requirements

• Demonstrates knowledge of the requirements of the Act and these Regulations that satisfies the Commission

• The Commission may require any person to attend an interview to ascertain his qualifications

Involvement in energy efficiency projects covering technical and management

Operation of electrical system/equipment at installation

Energy Efficiency Project Report

At least one project report on energy efficiency must be attached with the application to become an electrical energy manager

Only electrical energy related project ( thermal energy related project can be submitted as additional)

conceptual ideas, implementation and to reporting on savings achieved

Energy audit/feasibility study any installation –

although findings partly implemented or not implemented

General Provisions

• The Commission to maintain a register of registered electrical energy managers

• Extension of time – the person affected may request for an extension of time in writing and the Commission may grant such extension of time as it deems fit.

• Penalty- Any person who commits an offence under the Regulations shall, on conviction, be liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding one year or both

Notes

• Electrical energy manager is not required to employed permanently

• A registered electrical energy manager can be appointed at more than one installation

• No mandatory requirement to attend any training or course to apply to become a registered electrical energy manager.

Continuous Development Program (CDP)

For Registered Electrical Energy Manager

• One of the requirements for the renewal of registration as a REEM

• REEMs are required to participate or involve for at least eight (8) hours in programmes related to efficient management of energy endorsed by Energy Commission
