Purpose • Establish harmonised conditions for access and sharing INSPIRE spatial data and services

– From Memeber states MS to Community institutions and bodies– Within the MS

„Searching the ballance“ Restrictions should not be seen as all or nothing

– Although restrictions can be neccessary, INSPIRE aims to improve sharing– MS or involved stakeholders should quote under which conditions is possible to grant access to restricted data and services (e.g. removal of sensitive information, generalisation, etc)– Possible restriction exemptions (forest fire near a military base)– Support for wide access to data & services to stimulate added value generation potential

• Requirements for licences:– Any arrangements concerning access to spatial data sets and services shall be fully compatible with the requirements of the Regulation– Definitions laid down in Article 3 of Directive 2007/2/EC shall be used in any arrangements concerning access to spatial data sets and services

Implementation scenarios• Aim: Fullfillment of requirements on data sharing:

– Licensing framework (Legal and technical (suportive) dossier); – Processes allowing access, sharing and use

• Possible scenarios:– Individual decentralised agreements (Close to current status): Low level of harmonisation – Centralised licensing framework (Full centralised control of INSPIRE data and services sharing): Difficulties to implement because of heterogenity of environment– Combined scenario (Allowing flexibility, whilst ensuring minimal level of harmonisation):

• Licensing framework – (step wise implementation):• Definition of NSDI license policy

– Methodological/strategic document sumarising conditions of licensing framework for SK NSDI, experience identified in the process of implementation and providing recomendations for further development in area of legislation (harmonisation with relevant initiatives eGov, Emergency activities) as well as in the area of practical implementation (eg. Machine readable licenses).

• Preparing SK localisation of INSPIRE license templates:– Benefits: Partial level of licenses structure harmonisation, fast implementation – Limitations: Relatively still high level of admin burden, still relatively time consuming mainly from the coordination point of view.

• Framework agreement preparation – delineating generic harmonised framework for data and services provision for EU as well as national level:

– Benefits: High level of harmonisation of licence structure and overal coordination, increased speed in processing of data and services access requests, clear rules and processes– Limitation: Higher time needed in order to achieve the consensus on national level (heterogenic spectrum of requirements and expectations)

Processes allowing access, sharing and use

• Possible scenarios to deploy relevant processes:

– Centralised• Central national licensing coordination (Ministry of Environment, MSCP, Coordination Group ?) • Agreement achieved with all involved stakeholders in order to ensure consistent communication and sharing of digital spatial content on national level• Following that central coordination authority will initiate agreement/s with relevant EU authority(ies).

– Distributed• Each stakeholder will sign agreement individually on national and international level, following agreed rules for harmonised data sharing.

– Combined•Combination of above scenrios
