UST Facility Inspections:Operator and Manager

Responsibilities

Provide specifications for your UST components, including UST site vicinity map

Provide records, receipts, testing results, and system manuals for operation and maintenance of your UST system

Upon reasonable notice an authorized representative of the state may enter the premises of the site subject to regulations

The inspector is there to review records and observe operation of equipment. The inspector will not operate equipment or open containment covers for you. You must be able to open covers or entry points, and demonstrate ability to operate all components.

Access will be required into all UST system hatch covers, manways, sump covers, under dispensers, and fill ports

NONC (Notice of NON COMPLIANCE)

When an Ecology inspector observes significant violations of the UST regulations they may issue a Notice of Non-Compliance (NONC) to the UST owner/operator

The NONC will identify the specific violations as well as their remedies and a compliance schedule to resolve them

In addition the inspector may also issue a Notification of Delivery Prohibition at the time of inspection or by mail

Notification of Delivery Prohibition begins a 30 day period in which the owner may file an appeal

If the notice is not appealed or upheld by the Pollution Control Hearings Board, Ecology will attach a RED TAG to the tank (s) identified on the Notification of Delivery Prohibition

Delivery Prohibition Cont Delivery Prohibition is also known as “RED TAGGING” Delivery Prohibition makes it illegal to deliver, deposit or

accept petroleum or hazardous substances to regulated UST systems OR withdraw waste oil from a waste oil tank

Ecology will use a red-colored tag to identify each tank that is prohibited from receiving regulated product or waste oil removed

The RED TAG will be placed on the fill pipe easily visible to anyone delivering product or withdrawing waste oil

Delivery Prohibition cont *Ecology will “RED TAG” any UST system that does not have

required spill prevention, overfill prevention, leak detection, or corrosion protection equipment

Ecology may also “REG TAG” other non-compliant UST systems (See ECY Publication Number 12-09-059) for others

Ecology will consider site-specific circumstances when deciding whether to “RED TAG” such systems

An owner or operators are subject to a civil penalty as well as any persons delivering product or removing waste oil from a RED TAGGED tank.

Owner/ operator should complete the actions listed on the NONC as quickly as possible

Ecology will review evidence and documents that violations have been resolved, as required

An Ecology UST inspector may visit the site again before reclassifying the ineligible tank(s) eligible and removing the RED TAG

Penalties

Take inspections seriously!

Inspectors can issue citations up to $5,000 per tank, per day for violating UST regulations.

Penalties for some serious violations or repeat violations may go as high as $5,000 per tank, per day of violation.
