Trademark registration is the
ONLY way that you can legally own
the exclusive rights to a brand,
company or product name, logo
or slogan.
2
Even if you register a company name at Companies
House and register your domain name (URL), this DOES
NOT give you exclusive ownership of the name. It will
not stop others using your name, even for the same type
of goods and services.
If you do not register a trademark
you may be guilty of trademark
infringement may be sued by the legal
owner of the name.
3
Without checking whether a name is
already protected by a registered
trademark you don’t know if it is free
for use and you may be asked to cease
using it and to rebrand your business.

4
If you do not register a trademark you will lose
your brand if someone else applies to register it
before you do.
You can lose years of reputation and
good will if someone else protects
your name by trademark registration
prior to you.
5
If faced with a rebrand alongside the
financial implications, you will lose
use of your name which has gained
exposure and reputation over
many years.

6
If you decide to fight against an existing
trademark, the burden of proof falls on YOU to
provide evidence that you are the rightful owner
to that name. This can result in thousands of
pounds of legal fees with no guarantee of success.
Often, infringement
cases are initiated
by someone you
already know.
ex-employees,
business partners
and ex-business
partners are the
usually the main
offenders.

If you register a trademark, your brand and business
become more valuable. If you decide to sell your
business or have the option to invite new investors
in, the buyer will want to be satisfied that your
intellectual property rights are secure.
8
If you don’t register your trademark, the valuation
of your brand and business may be far lower than
you expect due to the lack of protection in place.
If you do not trademark names
and brands you will not
confidently be able to extend
your business by allowing
affiliates, licensees, franchisees,
agents and distributors to use
such names and brands.
9?
The process of acquiring trademark registration,
whilst sometimes slow and bureaucratic is not
expensive when you consider it will give you a
10 year exclusive right of use of the name in your
chosen goods and services.
10YEARS
You will have the option to renew this mark
indefinitely in ten year cycles. You can also then
extend your protection by acquiring European or
International registration.
