The claimant must send the copy of the mechanics lien affidavit by certified mail to the owner, and general contractor (if applicable) at their last known business or the residence address not later than the 5th day after the date of the lien affidavit is filed with the county clerk.

How can you file mechanics lien in Texas?

The “accrual” date varies depending on whether the claimant is an original contractor or a subcontractor. The debt to an original contractor accrues on the last day of the month in which the contract was terminated, completed, finally settled, or abandoned. Indebtedness to a subcontractor accrues on the last day of the month in which the labor was performed or the material furnished.

Before filing a lien affidavit, subcontractors must send notice of the unpaid claim to the owner and the original contractor no later than the 15th day of the third month after the work was performed. Sub-subcontractors need to send a timely notice to both the original contractor and the property owner or reputed owner not later than the 15th day of the second month after the work was performed. These notices must be sent by certified mail to their last known business or residential address.

When a lien has been successfully filed by the claimant, the lien will be valid for 2 years on commercial projects and one year for residential, if payment is not submitted in that time lawsuit to foreclose the lien is the step to follow.
