Alternative Dispute Resolution

Kelliher & Associates provide a full range of Alternative Dispute Resolution Services across the full spectrum of the commercial and construction industries. ARBITRATION

Keith Kelliher is a fellow of the Chartered Institute of Arbitrators and has completed the Diploma in Arbitration in University College Dublin. Keith is also a committee member of the Irish Branch of the Chartered Institute of Arbitrators which is the worldwide body for Arbitration. Keith has acted as an Arbitrator in various commercial, property and construction disputes ranging from low thousand values to over €2 million. The practice provides advice for parties in Arbitration, the process which is governed by the Arbitration Act 2010.

MEDIATION

Keith Kelliher is a certifi ed member of the Mediation Institute of Ireland and has completed an accredited commercial mediation training course. Keith is also a committee member of the Irish Branch of the Chartered Institute of Arbitrators where he has assisted with training of mediators by the institute. Keith has acted as a Mediator and co-Mediator in various commercial, property and construction disputes ranging in values up to over €25 million.

ADJUDICATION

Adjudication for payment disputes in Construction projects was introduced into Ireland under cover of the Construction Contracts Act 2013. Keith has completed a diploma in adjudication in University College Dublin and has provided a substantial amount of advice for parties in construction payment disputes including sub-contractor and main contractor disputes and builder and private individual disputes.

Quantity Surveying

Kelliher & Associates provide a full range of quantity surveying services to all sectors of the general construction and property industries. Since 1998, Keith Kelliher has been providing quantity surveying services to main contractors, sub-contractors, private clients, fi nancial institutions, corporate bodies, state bodies and commercial entities. The types of projects that the practice has been involved in include everything from small domestic extensions to large infrastructural projects. The practice has also expertise on projects in conservation and working on listed and protected properties.

The range of services offered by the practice includes:

ESTIMATING AND TENDERING

Kelliher & Associates can assist with the preparation and submission of tender documents, pre-qualifi cation submissions and associated documents for Contractors, Sub-Contractors, private individuals and corporations in order to facilitate contract commencement.

VALUATIONS AND CONTRACT ADMINISTRATION

Services include site valuation of works completed, identifi cation of variations and pricing of variations, submission of interim and fi nal valuations and project reviews including contractual entitlements and requirements. The practice also provides assistance with the production and agreement of contracts and associated obligations.

COST ADVICE, COST PLANNING AND COST REPORTING

Services include advice on costs for new or prospective projects. Assisting with the creation of cost control and reporting systems, purchasing systems and ordering systems in order to control outgoings in construction operations. Services also include the production of cost plans for securing project fi nance.

FINANCIAL APPRAISALS AND FEASIBILITY STUDIES

The practice provide services including the provision of detailed fi nancial reporting for fi nancial institutions on project fi nancing, progress reports on projects and development appraisals and feasibility reporting both for clients and fi nancial institutions.

PROCUREMENT

The practice provides a full range of procurement services including preparation of tender documents, bills of quantities, schedule of rates, review of tender drawings and specifi cations, advice on procurement methods, advice on material selections, cost planning proposals, and subcontract and material procurement systems.

INSURANCE CLAIMS

Keith Kelliher is a member of the Insurance Institute of Ireland and has completed a certifi ed diploma in Loss Adjusting. Keith has completed over 1500 insurance claim settlements as a loss adjuster for Insurance Companies in property and construction related claims. Keith has also completed an extensive number of construction and planning bond type claims. In addition Keith has achieved the settlement of a substantial number of claims for policy holders as a loss assessor appointed by the policy holder to act on their behalf. The practice utilises their extensive construction costs experience to assist its clients in insurance claim disputes and settlements.

CONSERVATION

The practice has extensive experience in working on conservation, listed and protected structures and demise. The practice has worked on projects like Carriglass Manor and estate in Longford, Drimmnagh Castle, as-well as numerous protected domestic properties on the Clontarf Road and Sandymount areas of Dublin. The practice is fully experienced in projects involving the use of traditional materials and methods in the repair and reconstruction of specialist fi nishes.

PROJECT MANAGEMENT

Kelliher & Associates provide project management services for house refurbishments, offi ce fi t outs, and general commercial projects. The service provides the full quantity surveying aspects in addition to site administration and management to completion of the required works. Keith is a highly experienced and motivated quantity surveyor and dispute resolver who specialises in the construction and general commercial arenas. Since 1998, Keith has been providing quantity surveying expertise to a broad range of clients including main contractors, sub-contractors, developers, individuals, corporate and public entities. Keith’s expertise has involved projects including the M50 and M1 motorway projects, the Luas extension projects, residential and commercial property developments, commercial fi t out projects (including offi ces, public houses and restaurants), private domestic projects and conservation projects, including works to the Carriglass estate in Longford and various protected and listed properties in Dublin. Keith is also an experienced dispute resolver and has provided general dispute resolution services to various clients including advocacy and appointments to act as an Arbitrator, Conciliator and Mediator.
