2015, within three months itself, looks very promising for the property market and investments. We can see signs of recovery when compared to last year, especially with a few positive developments that have recently materialized. For the industry, REITs (Real Estate Investment Trust) is expected to become a reality making funding of real estate projects transparent. And to the advantage of people who wish to own their dream homes, RBI cut the interest rates on home loans. A lot of people will now be eligible for loans and easy investments. The biggest development has been the efforts towards implementing ‘Akrama-Sakrama’ scheme in the state of Karnataka, this year. Overall, this initiative should channelize the growth of Bangalore and other cities in the right direction. And since so many interesting developments have happened lately, this scheme has made its way to our cover story under ‘Realty Reality’ this month.

Golden Gate, in spite of fluctuating national markets and swivelling global scenarios, never lost its vision towards quality homes. The Presidential Tower, in this case, stands as the ‘tallest’ paradigm of our commitment towards excellence. Bangalore has seen a haphazard growth in several pockets with no rules and regulations. This is mainly due to the rampant growth of the IT destinations with no statutory body regulations in place. This leads to “deviations” which means constructing something that does not adhere to what was sanctioned. Regularizing these deviations becomes the need of the hour to benefit the projects that have been sold earlier with irregularities. Nearly nine years after it was piloted, the State government has finally decided to implement the ‘Akrama-Sakrama’ scheme for regularization of unauthorized construction in all urban areas, including Bengaluru, from March 23rd, 2015. Though the State government had issued the final notification under the Karnataka Town and Country Planning Act in June last year, it was kept pending due to a stay order by the Karnataka High Court. The court recently gave the green signal to implement the scheme. Lakhs of owners of houses and commercial buildings now have a ‘one-time opportunity’ to regularize illegal constructions if it has not been challenged in the court again. The scheme will be in force till March 22, 2016. Under the scheme, violations pertaining to setback, floor area ratio (FAR), non-conversion of agricultural land and formation of unauthorized layouts in all 213 urban local bodies will be regularized. Owners of buildings can submit applications to the urban local body by paying prescribed penalty. Violations up to 50 per cent and 25 per cent would be regularized in case of residential and commercial properties, respectively.

All illegal buildings and layouts developed before October 19, 2013, are eligible for regularization. The non-compliance factor could become especially true with layouts and apartments or individual houses where there hasn’t been a BDA/BBMP sanction, with Occupation Certificate not issued. Although the local board panchayats have issued khatas and approved plans for construction, the construction has to be regularized by the present local body. The rates, once regularized, would be corrected to gain a marketable title and a better value to property. Paying a fee (Sakrama) for the violations (Akrama) would certainly be a 30-40% correction depending on the location. As the BBMP will go to polls in May this year, implementing the scheme, particularly in Bengaluru, will earn good revenue to them and the government. The BBMP alone is expected to mobilize Rs. 6,000 crore. A separate fund would be set up in each ULB to park the funds received. As far as the latest developments go, the government has decided to amend the Karnataka Apartment Ownership Act, 1972 and Karnataka Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1972. Both the Acts will be merged into one to impose fine and punishment of imprisonment of officials and builders involved in illegal construction of buildings and layouts.
