BLUE SUN GROUP Warranty Terms 2013

Limited Warranty for Photovoltaic Solar Modules The “Limited Product Warranty” and a “Limited Peak Power Warranty” described below

apply to this BLUE SUN GROUP Photovoltaic Solar Modules. This Warranty is valid for

Photovoltaic Solar Module dispatched between 1st January 2013 and 31st December 2013

1. Limited Product Warranty – Twelve Years Repair, Replacement or Refund Remedy

BLUE SUN GROUP warrants its Photovoltaic Solar Module to be free from defect in

materials and workmanship under normal application, installation, use and service conditions.

If the Photovoltaic Solar Module fail to conform to this warranty, during the period ending one

hundred and forty-four (144) months from the date of sale as shown in the invoice to the

original consumer purchaser of the BLUE SUN GROUP product, BLUE SUN GROUP will, at

its option, either repair or replace the product, or refund the purchase price as paid by the

original consumer purchaser. The repair or replacement or refund remedy shall be the sole

and exclusive remedy provided under the “Limited Product Warranty” and shall not extend

beyond the one hundred and forty-four (144) months period warranty period. This “Limited

Product Warranty” does not warrant a specific power output, which shall be exclusively

covered by the “Limited Peak Power Warranty”.

2. Limited Peak Power Warranty - Limited Remedy BLUE SUN GROUP warrants the Peak Power of the Photovoltaic Solar Module provided

that such loss in power is determined by BLUE SUN GROUP, at its sole and absolute

discretion. Peak Power is measured under Standard Test Conditions (STC). STC is where

the light spectrum of AM 1.5, an irradiation of 1000 W per and a cell temperature of 25 degree

centigrade at right angle irradiation.

If, within a period of ten (10) years from the date shown in the invoice to the original

consumer purchaser, the Photovoltaic Solar Module exhibits a peak power output less

than 90% of the minimum Peak Power measured at STC, then BLUE SUN GROUP will

replace such loss in power by either providing additional Photovoltaic Solar Modules to

make up for such loss in power, or by replacement of the defective Photovoltaic Solar

Module.

If, within a period of twenty five (25) years from the date shown in the invoice to the

original consumer purchaser, the Photovoltaic Solar Module exhibits a peak power output

less than 80% of the minimum Peak Power measured at STC, then BLUE SUN GROUP

will replace such loss in power by either providing additional Photovoltaic Solar Modules

to make up for such loss in power, or by replacing the defective Photovoltaic Solar

Module.

The remedies set forth in this clause shall be the sole and exclusive remedies provided

under this Limited Peak Power Warranty. Where several remedies are suggested, the

provided remedy will be solely determined by BLUE SUN GROUP.

All warranty claims must be filed within the applicable warranty period for consideration to be

a valid claim. This warranty is transferable to another owner when the product remains

installed in its original location at the warranty registration.

3. Warranty Exclusions and Limitations The Limited Product Warranties and the Limited Peak Power Warranties do not apply to

any Photovoltaic Solar Modules which have been subjected to:

• Server lightning, flood, hail, fire, storm, natural disaster, or acts of God;

• War, riots, strikes, warlike conditions, plague or other epidemics, or any other similar

cause;

• Alteration, improper installation, repair or modifications by someone other than an

approved service technician nominated by BLUE SUN GROUP;

• abuse, neglect, accident accidental breakage, or malicious damage;

• non-observance of BLUE SUN GROUP’s installation and maintenance instructions; or

• any other event outside BLUE SUN GROUP’s control.

The Warranties as set forth herein are expressly in lieu of and exclude all other express or

implied warranties, including but not limited to warranties of merchantability and of fitness for

particular purpose, use, or application, and all other obligations or liabilities on the part of

BLUE SUN GROUP, unless such other obligations or liabilities are expressly agreed to in

writing signed and approved by BLUE SUN GROUP.

BLUE SUN GROUP shall have no responsibility or liability whatsoever for damage or injury

to persons or property, or for other loss or injury resulting from any cause whatsoever arising

out of or related to the Photovoltaic Solar Modules, including, without limitation, any defects

in the Photovoltaic Solar Modules, or from use or installation.

Under no circumstances shall BLUE SUN GROUP be liable for incidental, consequential or

special damages, howsoever caused. Loss of use, loss of profits, loss of production, and loss

of revenues are specifically and without limitation excluded.

BLUE SUN GROUP 's aggregate liability, if any, in damages or otherwise, shall not exceed

the invoice value as paid by the CUSTOMER, for the single unit of Photovoltaic Solar

Module.

If a part, provision or clause of this Warranty, or the application thereof to any person or

circumstance, is held invalid, void or unenforceable, such holding shall not affect and shall

leave all other parts, provisions, clauses or applications of this Warranty and to this end such

other parts, provisions, clauses or applications of this Warranty shall be treated as severable.

The repair or replacement of the Photovoltaic Solar Module or the supply of additional

Photovoltaic Solar Modules does not cause the beginning of new warranty terms, nor shall

the original terms of this Warranty be extended. BLUE SUN GROUP has the right to deliver

another type (different in size, color, shape and/or power) in case BLUE SUN GROUP has

discontinued producing the replaced MODULES at the time of the claim. Any replaced

Photovoltaic Solar Module shall become the property of BLUE SUN GROUP.

The Limited Product Warranty and Limited Peak Power Warranty do not cover any

transportation charge, customs clearance or any other costs for return of the Photovoltaic

Solar Module, or for reshipment of any repaired or replaced Photovoltaic Solar Module, or

costs associated with installation, removal or reinstallation of the Photovoltaic Solar Module.

Warranty claims will not be honored if the type or serial number of the Photovoltaic Solar

Module have been altered, removed or made illegible.

4. Warranty Claims If the consumer feels that they have a justified claim covered by this Warranty, an immediate

notification directly to BLUE SUN GROUP shall be filed by registered or certified mail letter in

writing to the address of BLUE SUN GROUP listed below, or, sending an email letter to the

email account of BLUE SUN GROUP listed below. The return of any PV-modules will not be

accepted unless prior written authorization has been given by BLUE SUN GROUP.

Together with the notification, the customer should enclose the evidence of the claim with the

corresponding serial number of the Photovoltaic Solar Module and the invoice on which the

Photovoltaic Solar Module have been purchased.
