What is Confidentiality? Confidentiality means that we

promise to keep all client information secret, unless we are given permission to disclose (give out) that information to others or receive information from others.

We cannot even acknowledge to others outside the agency that someone is a client, unless we have permission to do so!

Client information can be shared between two agency programs on a “need to know” basis. This would occur if a client is participating in two separate programs within the agency.

Confidentiality is a protection for all clients. We are showing RESPECT to our clients by following Confidentiality rules.

Consent for Release of Information: In order to disclose or

obtain client information, we must receive or complete a Consent for Release of Information.

The release must be filled out completely.

The release must be signed by the parent/guardian.

The release must also be signed by the child if she/he is 12 years old or older.

We cannot give or receive information unless we have permission to do so!

Exceptions to Confidentiality: There are certain times in which

we can disclose confidential information without parent and child permission. Some of these times include……

Exceptions to Confidentiality Cont. Mandated Reporting: We are all mandated reporters.

If we suspect abuse and/or neglect of a child, we must report the abuse/neglect to proper authorities.

Suicidal/Homicidal Threats: If a client threatens to hurt themselves or others, we must report that, as it is a safety issue.

Medical Emergencies: If a client is having a medical emergency, we must assist the client in receiving proper medical attention.

There are other exceptions to Confidentiality that can be found in the Employee Handbook, Section 8.10

Confidentiality and Protected Health Information (PHI):There are numerous acts and entities in which

we are required to follow regarding client Protected Health Information. These entities ensure privacy and security of client confidential information. They include:

Health Insurance Portability and Accountability Act (HIPAA)

Mental Health and Developmental Disability Act

Council on Accreditation Department of Children and Family Services

Please refer to the Employee Handbook to Section 8.10 for a more detailed description of required confidentiality compliance at the agency.
