• Official figures indicate that there are over 12 million child workers in India, but many NGOs reckon the real figure is up to 60 million. The number of girls involved is not much lower than the boys.•1 in every 11 child is working in India• As per CRY and Census data Child labor has been decreasing at an abysmal rate of 2.2% from 2001-2011• More than half of working children in India are concentrated in 5 states: Bihar, Uttar Pradesh, Rajasthan, Madhya Pradesh and Maharashtra.• 500,000 children are forced into this trade every year.• By a law introduced in 2006, no child under 14 should work. But like many laws in India, the problem is enforcement. 2 years after the ban, the Labor Ministry had carried out 12,000 operations but only made 211 prosecutions.

• 19% of children employed work as domestic help.• 90% working children are in rural India.• 85% of working children are in the unorganized sectors.• About 80% of child labor is engaged in agricultural work.• There are approximately 2 million child commercial sex workers between the age of 5 and 15 years and about 3.3 million between 15 and 18 years.• Bihar, UP, Rajasthan, MP and Maharashtra: these states account for more than 5.5 million of child workers.

Who is doing what?Child Labor law India :• Children who are engaged in labor work for economic

gains, harmful works or hazardous works below the age of 14 years.

• There is no penalty provision for parents for the first offence, the employer would be liable for punishment even for the first violation.

• In case of parents, the repeat offenders may be penalized with a monetary fine up to Rs 10,000.

• In case of first offence, the penalty for employers has been increased up to two and half times from the existing up to Rs 20 thousand to up to Rs 50,000 now.

• The age of prohibition of employment has been linked to age under Right of Children to Free and Compulsory Education Act, 2009.
