You will note in the enclosed aemorandum, which ... prepared by SA Kennedy, that United States Attorney LaCour lnl tiallJ iDstructed 8.l Kennedy, after he wu aubpoenaed, 'to invoke the privilese on all queationa put to him and to only answer aa to hia name, the fact that he la an &Kent, and that be is assigned to the •ew Orleans Office of the Federal Bureau of Investigation. You will also note that after the hearing on the aorning of May 17, 1967, when the Government'• aotion to quash the aubpoena of SA Kennedy was dented and prior to SA Kennedy's appearance before the Orleans Parish Grand Jury, Assistant United States Attorneys Ciolino and Vetera tempered llr. LaCour's instructions to the extent that it would be aeceasary for SA Kennedy to justify invoking the privilege aa it would be aubject to judicial review. Assistant United Statea .Attorney• Ciolino and Vetera told SA Kennedy to use ·hia cnm judpent in invoking the privilege and that he ahould answer questions of his own personal knowledge, and that lf he was in doubt on any «~Uetstion, be could come out of the Orand Jury room and aak them about it.

Wiliiam Wayne Dalzell was active in anti-castro Cuban activities New Orleans area in the early 1960's. We have previou~ly received report that Garrison desired to question Dalzell as to his knmrledge of possible anti-castro Cubans being involved in the assassin'ation. We received no information during our ipvestigation of the assassination that Dalzell was ever acquainted with Lee Harvey Oswald or involved in any manner in the assassination of President Kennedy.

Inasmuch as data in the attached teletype appeared in news media, no dissemination will be made of it.

William Dalzell who, 1n 1963, was a patient in a aental hospital in Louisi was connected with Jack s. Martin ot New Orleans. Martin, a private investi­gator, is one of the ~n who furnished information to Garrison Which started Garrison's investigation. Information concerning Dalzell was furnished to the Attorney General in Karch, 1967. It is not known why Dalzell is appearing before the grand Jury in connection with Garrison's case.

A source, who has provided reliable information in the past, advised that the Orleans Parish Di~ Attorney's Office is looking for ~~lliam . Wa~alzell, formerly of New Orleans and previously connected with the Cuban movement in New Orleans. This source advised that the District Attorney's Office suspects that Dalzell is providing information for the defense of Clay Shaw and the District Attorney's Office, according to this source, is very much concerned about the information that Dalzell may be able to supply to the defense.

is continuing to apply pressure to various individuals in the Ne~~ Orleans French Quarter in an effort to force them to testify 1n connection with the District Attorney's probe into the

I assassination of President Kennedy. The pressure according to this source is primarily threats to expose past criminal records

- of· various individuals.

• We have previously received informati n that William Wayne Dalzell is a friend of Clay Shaw, and that New Orleans District Attorney Garrison suspects that Dalzell is providing information to Shaw's attorney to assist in the defense of Shaw.

Our files disclose in 1961 Dalzell was involved with individuals in New Orleans in anti-Castro activities. Our files also contain information that Dalzell was hospitalized in a Louisiana State mental hospital in 1963, reportedly being discharged from such hospital on March 20, 1963.

l In connection with the two questions listed above, our file

contain no information indicating Ferrie was a communist. He was ver active in anti-Castro activities in New Orleans. Regarding question number two, Novel did contact our New Orleans Office on February 20, and volunteered information to Special Agents J. Peter Chase and

I Max M. J.iarr. The data volunteered by Novel concerned his participa ti 1

with Ferrie, Sergio Smith and others in robbing an ammunition bunker at Houma, Louisiana.

OBSERVATIONS:

Novel's reliability is highly questionable. He has frequently made charges which have been found to have no basis in faci He reportedly claimed ties with CIA which CIA denied. It seems incredible that if Novel saw Garrison leave Ferrie's apartment at 5:30 a.m. on the day Ferrie was found dead that he would not have com( forward with this information up till now. He has contacted our FBI Offices several times since February 22, 1967, and did . ~ot volunteer such data.

ACTION:

The data furnished by Novel will be summarized in a letterhead memorandum and disseminated to the Department, Secret Service and CIA. v

The Central Intelligence Agency's record review process for this request, listed as F82-0240 (Count 5) under CA82-l603 (prior to consolidation (CA82-l667), has been completed. One Agency-originated ~ e ~ d during the search of

r. Charles E. Moyer, the Information Review Officer Directorate of Administration, has determined on review document (F82-0240/l) that it may be released in part

to your clients. The portions deleted are being withheld to protect information properly falling within the scope of exemption (b) (3) of the FOIA.

As you know, exemption (b) (3) of the FOIA encompasses matters which are specifically exempt from disclosure by statute. The relevant statutes are section 6 of the central Intelligence Agency Act of l949, as amended, 50 U.S.C. §403g, which exempts from the disclosure requirement information pertaining to the organization, functions, names, official titles, salaries or numbers of personnel employed by the Agency, and subsection l02 (d) (3) of the National Security Act of l947, as amended, 50 U.S.C. §403 (d) (3), which makes the Director of Central Intelligence responsible for protecting intelligence sources and methods from unauthorized disclosure.

William Wayne DALZELL described as a petroleum advisor to the Ethiopian Government was an -incorporator of an anti-Castro organi­zation in New Orleans early in 1961, known as the Friends of Democratic Cuba. (See Sergio Arcacha SMITH) Joining him as incorporators were Guy BANISTER, Grady C. DURBAN and William KLEIN. DALZELL -was subpoenaed for questioning by GARRISON on 30 June 1967 but the subpoena was dropped when DALZELL agreed to talk to GARRISON voluntarily~ DALZELL 1-1as subpoenaed again in September 1967. DALZELL told the FBI that be had three contacts with the New Orleans DCS office in 1960 and 1961 but OS indices search was negative.

couldn't remember the office, but he felt that it was above

the offices of the FBI an~ he did give this Mr. K certain

information that he obtained.

He said that he left New Orleans sometime in '62 or

'63 before the as s assination. He also states that the re

offices - office that was the center of this activity. ·

He knew Arcacha Smith as his office was over the

Mr. Dalzell atated that he speaks! our or five languages but has been getting out of practice by not using most of them. He is fluent in Spanish and 1n addition to the languages he ~peak eeveral dialects of Aramaic and Swahili.

He asked :it the Select Committee had a white male inve~tigator by the name of Singletown or SingletOn. This man had · been in the Pair A Dice Bar aaldng quastions about his connections with the Cuban• anci Radio Free Cuba. H• is described as approx. 45-50 yrs. old well dressed and bas a northern· acd•nt. Mr. Dalzell waa advised that this Committee ddd not have anyone that fit that description.

Cn December 9, 1977 investigators Bob Buras and L. J. Delsa met with V.illiam 11 Billy Littlehorse" Dalzell at the Pair A:· Dice Bar located at 241 -Decatur St. in Nel>r Orleans, La. }.ir. Dalzell is a part time bar­tender at this bar. Jack s. :Hartin introduced the investigators to Hr. Dalzell.

Nr. Dalzell did not have a lot of time to talk with the investigators but consented to a short conversation. He was waiting on word from a large oil corr.pany that had a well blowing wild in the Gulf of Hexico. He was pro­posing to dive in about eighty feet of l>Jater and attach a cap t hat he had invented some time ago and has patented. (Later convesation 11\ith him re­vealed that the comapny had to refuse because the insurance companies would not or could not cover the venture). He agreed to speak further ~dth the investigators at a later date. ·

~.Lr. Dalzell stated that he had worked with the Central Intelligence Angency. in the early fifties in Arlington, Va. He was attending Georgetown Univer­sity at the same time and between the two jobs he over~orked himself and quit school and the Agency. He stated that he would help in any way pos­sible because he is still loyal to the Agency and the United States. ~fuile working for the C.I.A. he was in the Arabic Section mostly dealing with ~odes and radio transmissions. He was a crl~tologist with a top secret clearance. After leaving the Agency he knocked around in South America and the Far East. Just when he seemed to be getting set up as an advisor and in good standing with Emperor Haile .Salasie of Ethiopia the Garrison probe began and everyone dropped him like a hot potatoe. He's ~een down and out since that time~ but still hopes to do something with his weel head attachment that will prevent blow outs.

He knew Jack S. Martin before the 1961 Bay of Pigs Invasion and he volunteere1 to help the Anti Castro Cubans in New Orleans. He worked for Arcacah -Srnith and set up the medical supply units that would help in the invasi one He only worked with the Americans that wanted to join. He would get an applicatiob f r om them and send them first to a New Orleans Blood Bank to donate a pint of blood and then some of them he would put up in the Balter Building located at 403 St. Charles. Col£ Bluford Balter donated office space for the men,

\as many as sixty at a time were bunked in like soldiers. They had a mess hall there and they f'ed the men. The men did not get any trainirlg and no guns were allowed on the premises. Most of the men got tired of doir.g nothing anci left quickly, others stayed awhile. If any \>lent to Cuba Dal2ell claims hP. doesn't know a~out them. He was not paid by Arc~cha Smtih and was only ~sed to get blood and medical supplies. He feels that Arcacha Smith ~as looking more for money than anything else. He seemed surprised that Arcacha :~ith might be back in ¥~ami because of the a~ger towards him by some Cubans. r. Dalze~l was going to jump into the Escamprey ~ountains and radio signals ut before the invasion but felt that this might not be a good idea. He is

no\'1 certain that iwould not have been a good idea. Dalzell stated that he did not know Ferrie personally but that Ferrie did make t\oiO drops of medical supplies in Cuba. Both drops reportedly landed in Castro's hands. Both Dalzell and }~rtin expressed the idea that the anti Castro Cubaas were · suspicious of the Americans and things like this drop only served to con­firm there suspicions that all was not well. The Cubans seemed to think that tings went better when only Cubans were involved.

~~. Dalzell was vague when asked about his whereabouts durin~ the Bay of Figs Invasion, and he wasn't pressed about that date or November 1963. He has a lot of information about the times that we will talk about further before pressing him on subjects that he seems reluctant on at the present.

Hr. Dalzell went to school with and knows well ~~. Nick Popich. l{r. Fopich is presently in barge companies and oil companies and according to Dalzell is worth a few million dollars. ¥~. Popich owned land across the Lake (Fonchatrain) from New Orleans. l.fr. Popich knows the Harcello family well and unconfirmed reports from some sources state that this land mgiht have been used to train Cubans. On one occassion William Dalzell drove Sergio Arcacah Smith to the Slidell area to a training camp. Dalzell stated "that he did not get out of the car but waited while Arcacha Smith went to take care of Business. ~~. Dalzell stated that he doesn't know if he could find the land again. This area was and still is sparcely populated and it is hard to rereember a remote area. Jlccording to Mr. Dalzell }fr. Popich l'.o.s a owner of large gambling operations in Cuba before Castro. Jo~. Popich is anti Castro because of this. l·x. Popich owned a large track of land across the lake.

}~. Fopich owned the Seven Crown Ranch in Lacombe, La. (Slidell area) and sold the land to :Hr. Salvador 11 Sammy" 1-Iarcello. This is the same Sammy ~~rcello that is identified in meetings where Thomas Beckham stated that the assassination of President Kennedy was discussed.

Investigation was conducted by the Federal Bureau of Investigation (FBI) in late 1963 and early 196L} concerning lf7illiarn Hayne Dalzell for possible violations of the Inter­state Transportation of Stolen Property, Fraud by 'Hire and Nail Fraud Statutes.

During 1959, Dalzell had established a firm named ' 'Delman Ass0ciates 11 for the alleged purpose of facilitating purchase of speculative 0~1 rights to certain offshore lands along the coast of Yemen and to collect royalities on the oil dra~m from these lands in event they 1vere subsequent l y developed by a major oil company. Dalzell had influenced Miss Cecilia N. Hlebanj a, Hashington, D. C., to invest ap­proximately .) 2,000 on alleged oil specula tions in Yemen and she received no return or verification that money had been properly invested. Some of the money had been sent to Dalzell by intersta te wire based on his claims sent by United States Nai l and interstate \vire of contracts 1.vith United States Oil Companies and influence at the Yemen Embassy, Hashington, .J.C . Dal zell a lso alleged during November, 1963, by interstate lvire and United States Hail, that he 1-vas negotiating similar deal in Eth1opia and attempted to obtain $1500 f rom Hiss Hlebanj a f or alleged transportation to Ethiopia to promote deal.

Dalzell contacted Richfield Oil Company, Tide1.vater Oil Company, Dixilyn Drilling Company, Yemen Legation, Hashington, D. C., and Ethiopian Ninistry of Finance in pro­motion of his efforts to secure concessions for deve lopment of 0il under offshore lands, but no binding agreements w·ere secured by him.

On July 7, 1964, the facts developed in the investigation were discussed with an Assistant United States Attorney, Washington, D. C., by a Special Agent of the FBI. The I>Ssistant United States Attorney de­clined prosecution of HilHam liayne Dalzell for the following reasons: The matter was primarily civil in character as evidenced by the fact that Dalzell had made promotional efforts with respect to the various persons and companies he is alleged to have contacted . There Jras no evidence that money expended by Dalzell >ras used for any purpose other th·an in connection wi th these promotional efforts. .\ f raudulently prepared document on 1 e t ter head of the P6pich Marina Construction, Incor porated, caused no loss to Hiss IUebanja and since Dalzell a cted alone in perpetr a t ion of the fraud, no conspiracy violation existed . No clear cut violations of Title 18 , United States Code , Section, 1343 (Fr aud by Wire) nor Section 134-1 (Mail Fraud) existed in the case . In addition, the time Lapse between the actual monetary losses and the report of loss to Federal .~thorities f~ther limited the chances of crimina l pr osecu­tion.
