via neighborscolumbiaedu In todayrsquos decision in Kaur v NewYork State Urban DevelopmentCorpgt The New York Court ofAppeals (the statersquos highest court) hasupheld the condemnation of propertyin the Manhattanville area of NewYork City for transfer to ColumbiaUniversity This outcome is notsurprising In fact I predicted it backin December In the recent AtlanticYards case the Court of Appeals hadalready held that state and localofficials could declare virtually anyarea ldquoblightedrdquo and thereby make itel igible for condemnation andtransfer to favored private interestgroups Nonetheless there are severalextremely troubling aspects of thiscase As in Atlantic Yards The courtupheld an extremely dubious ldquoblightrdquocondemnation by applying a ruleholding that any area could be

declared blighted so long as it mightbe ldquounderdevelopedrdquo Indeed eventhe presence of ldquounderdevelopmentrdquo(a phenomenon that occurs in almostevery neighborhood at one time oranother) need not actually be provenInstead the government need onlyshow that there is ldquoroom forreasonable difference of opinion as towhether an area is blightedrdquo As thelower court opinion in Kaur pointedout this kind of lax standard wouldallow the city to declare ldquo[v]irtuallyevery neighborhood in the fiveboroughsrdquo blighted And as Ipointed out in this post the courtrsquosposition makes a mockery of theNew York state constitution whichallows blight condemnations only inldquoldquosubstandard and insanitary areasrdquo Even worse the Court of Appeals inKaur brushed aside or completelyignored extensive evidence showingthat the blight study justifying thecondemnations had been rigged inColumbiarsquos favor and that Columbiaitself was likely responsible for mostof the ldquoblightedrdquo conditions The keyldquoblightrdquo study was conducted by

AKRF a consulting firm hired byColumbia As the lower courtdecision pointed out It is critical to recognize that [thes ta t e Economic Deve lopmentCorporationrsquos] 2002 West HarlemMaster Plan which was created priort o t h e s c h e m e t o b a l k a n i z eManhattanville for Columbiarsquosbenefit found no blight nor did itdescribe any blighted condition orarea in Manhattanville Insteadhellip thePlan noted that West Harlem hadgreat potential for development thatcould be jump-started with rezoningIt was only after the Plan waspublished in August 2002 that therezoning of the ldquouplandrdquo area wasessent ia l ly g iven over to theunbridled discretion of Columbia Inl i t t l e more than a year f rompublication of the Plan EDC joinedwith Columbia in proposing the useof eminent domain to allow Columbiato develop Manhattanvil le forColumbiarsquos sole benefi t This ultimately became the definingmoment for the end game of blightHaving committed to allow Columbia

to annex Manhattanville the EDCand [Empire State DevelopmentCorporation] were compelled toengineer a public purpose for aquintessentially private developmenteradication of blight From this point forward Columbiaproceeded to acquire by lease orpurchase a vast amount of property inManhattanville It is apparent fromthe record that ESDC had noi n t e n t i o n o f d e t e r m i n i n g i fManhattanville was blighted prior toor apart from Columbiarsquos control ofthe areahellip Throughout this timeColumbia not only purchased orgained control over most of theproperties in the area but it alsoforced out tenant bus inesses ultimately vacating in 17 buildings50 or more of the tenants Thepetitioners clearly demonstrate thatColumbia also let water infiltrationconditions in property it acquired gounaddressed even when minor andeconomically rational repairs couldarrest deterioration Columbia left

Zvi commented on my last Amnestypost and elaborated on it Amnestyhas created i ts own contorteddefinition of the term ldquooccupationrdquowhich it applies exclusively to IsraelWhere Israel is concerned Amnestyabandons the definition of occupationas defined under international law ndashwhich it applies to every othercountry and conflict ndash and uses itsown contorted definition instead Amnesty does not apply thiscontorted definition to any othercountry or conflict anywhere in theworldFor example Amnesty doesnot apply the same definition toAzerbaijan despite the fact thatAzerbaijan completely surrounds theenclave of Nagorno-KarabakhAmnesty does not c la im tha tAzerbaijan is ldquooccupyingrdquo Nagorno-Karabakh Amnesty did not and doesnot apply this definition in theBalkans or in Yemen (where theSaudis are blockading part of thecountry and cutting off land bordersas well) or in Iraq Most importantly Amnesty hasnever applied this definition toIsraelrsquos Arab neighbors in 1967 theArab powers (Egypt Jordan SyriaLebanon) cut off Israelrsquos access to theRed Sea in a deliberate attempt tochoke Israel to death At this time

nearly the entire Israeli border wascontrolled and absolutely closed byArab armies Nobody has ever beeninsane enough to claim that at thispoint Israel was ldquooccupiedrdquo by theArabs In addition the definition is bizarrelyillogical As long as a power does notclose all of a regionrsquos borders it hasno control over what comes in orgoes out It might as well have nocontrol over any border whatsoever Israel cannot control Gazarsquos borderwith Egypt at all as is clearlydemonstrated by the profusion ofweapons-smuggling tunnels that runacross this border and the occasionaldemolition of the Egyptian borderfence In other words the closure ofGaza relies in equal parts on Israeliand Egyptian actions Amnestyrsquosdefinition must therefore be appliedequally to Israel and Egypt sincethere can be no closure of a territorywithout a complete encirclementThus either Amnesty must layresponsibility for Gaza at the feet ofan international anti-Hamas coalitionconsisting of two equal partners ndashIsrael and Egypt ndash or Amnestyrsquosbizarre definition of ldquooccupationrdquo issimply another example of arroganthypocrisy Elder you are absolutely right Israelcannot fulfill the responsibilities of anldquooccupying powerrdquo because Israelcannot control anything that happensin Gaza Gaza i s con t ro l l edexclusively and entirely by the
