TOSA CASE: COULD PERHAPS BE VIEWED AS UNFRIENDLY ACT BY THE ORDINARY PEOPLE OF INDIA, BANGLADESH AND PHILIPPINES – FAILURE OF PANAMA TO FILE BEFORE ITLOS IN ORDINARY JURISDICTION, URGENT PROCEEDINGS 1. The M.T. Tosa incident has given a bad name to seafaring industry; an already  tough profession has been criminalised by coastguard, pirates and shore based prosecutors who have scant regard for Law of Sea. For a detailed background note on the M.T. Tosa kindly see;http://www.slideshare.net/manioberoi/compulsory-jurisdiction-at-itlos  2. Taiwan is a province of Peoples Republic of China. This position is made explicit in UN General Assembly Resolution 2758 (XXVI) of 25 October 1971 which recognizes Peoples Republic of China as the only legitimate representative of the people of China including its province of Taiwan. In all three Joint US-China communiqués to date, the US acknowledged the Chinese position that Taiwan is part of China. Panama and Peoples Republic of China have both committed to uphold the Charter of the United Nations and both nations are bound by the Law of Treaties, 1969, to honour their obligations under UNCLOS 1982 in spite of the fact that Panama does not maintain any diplomatic relations with the Peoples Republic of China.  3. Article 2 of the Anti-Secession Law, promulgated by Peoples Republic of China on 14 March 2005,  provides that, "There is only one China in the world. Both the mainland and Taiwan belong to one China. China's sovereignty and territorial integrity brook no division. Safeguarding China's sovereignty and territorial integrity is the common obligation of all Chinese people, the Taiwan compatriots included."  4. Article 3 provides that "Solving the Taiwan question and achieving national reunification is China's internal affair, which subjects to no interference by any outside forces."

 5. Article 5 provides that "... Taiwan may practice systems different from those on the mainland and enjoy a high degree of autonomy."  6. Article 6 provides that "The state protects the rights and interests of the Taiwan compatriots in accordance with law." 7. Article 7 states "The state stands for the achievement of peaceful reunification through consultations and negotiations on an equal footing between the two sides of the Taiwan Straits." and also provides for "Taiwan region's room of international operation that is compatible with its status;" 8. Article 9 makes provision to "protect the lives, property and other legitimate rights and interests of Taiwan civilians and foreign nationals in Taiwan," under certain circumstances. 9. Peoples Republic of China would protect its "Taiwan compatriots" from any action for alleged violations of international law by its "Taiwan compatriots" in view of Article 2, "Safeguarding China's sovereignty and territorial integrity is the common obligation of all Chinese people, the Taiwan compatriots included." and Article 3, "Solving the Taiwan question ..... is China's internal affair, which subjects to no interference by any outside forces."  10. Peoples Republic of China has not provided for obligations of its Taiwan province while providing it with privileges and rights under the Anti-Secession Law, 2005. Therefore, it would appear that Anti-Secession Law, 2005, while giving some rights of "equal footing" in negotiations for re-unification and some room for "international operation" and "autonomy" precludes all or any action in international tribunals for an alleged violation of obligations of "Taiwan compatriots" (Taiwan being a province of Peoples Republic of China) under international law, against any such act of any "Taiwan compatriots" other than through and with the concurrence of the Peoples Republic of China.  11. Panama and the Peoples Republic of China are bound by the Law of Treaties, 1969 to honour their obligations under UNCLOS 1982 in respect of any alleged prima facie violation of UNCLOS 1982, in particular, Article 301 thereof, threat to use force inconsistent with the principles of  international law embodied in the Charter of the United Nations, particularly Article 2 thereof, and Articles 87 to 97 of UNCLOS 1982, freedom of navigation of the high seas of a Panama Flag vessel, by "Taiwan compatriots" of the Taiwan province of the Peoples Republic of China. 12. The only option, therefore, before Panama in order to honour its obligations under UNCLOS 1982, is to file for ordinary jurisdiction of ITLOS under urgent proceedings with the counter party as Peoples Republic of China of which Taiwan is a province, as regards the provisional measures under article 290, paragraph 5, of the Convention, and the prompt release of vessels and crews under article 292 of the Convention, no matter that it does not maintain diplomatic relations with the Peoples Republic of China. 13. In case Panama does not honour its obligations as above, it would be liable to be viewed as an unfriendly act by the ordinary people of India, Bangladesh and Philippines, some of whose seafarer nationals were practically abducted from the high seas, detained in the province of Taiwan without due process and even held in solitary confinement for upto 3 months without any legitimate investigation, without due process in the eyes of international law obtaining on the high seas, and without any trial.

Tosa kindly see;http://www.slideshare.net/manioberoi/compulsory-jurisdiction-at-itlos In the exclusive economic zone, the coastal State has sovereign rights for the purpose of exploring and exploiting, conserving and managing the natural resources, whether living or non-living, of the waters superjacent to the sea-bed and of the sea-bed and its subsoil, and with regard to other activities for the economic  exploitation and exploration of the zone, such as the production of  energy from the water, currents and winds.

In the exclusive economic zone, the coastal State has jurisdiction with regard to artificial islands, installations and  structures, marine scientific research and the protection and preservation of the marine environment.

Articles 55 to 85 of UNCLOS 1982 are the basis of State Parties legislations on Laws on the Exclusive Economic Zone and the Continental Shelf.

Article 111, Paragraph 2 of UNCLOS 1982 provides that "The right of hot pursuit shall apply mutatis mutandis to violations  in the exclusive economic zone or on the continental shelf, including  safety zones around continental shelf installations, of the laws and  regulations of the coastal State applicable in accordance with this  Convention to the exclusive economic zone or the continental shelf,  including such safety zones."

On 17 April 2009 the M.T. Tosa was admittedly not engaged in exploiting any living or non-living natural resources (including fishing), production of energy from water, currents and winds, construction of artificial islands or marine scientific research. Out of the full list of items falling within the coastal state's sovereign rights and jurisdiction under Articles 55 to Articles 85 of UNCLOS 1982, that leaves only "protection and preservation of the marine environment."

Law on the Exclusive Economic Zone and the Continental Shelf of the Republic of China 1998, Article 16 provides "Where the authorities of national defense, police, customs or other authorized agencies of the Republic of China consider that a person or an object, which is in its exclusive economic zone or on its continental shelf, is engaged in any activity violating laws and regulations of the Republic of China, such authorities may engage in hot pursuit, boarding, and inspection. When necessary, the aforementioned authorities may expel or arrest the suspected person, or detain the vessels, aircraft, equipment, or other articles belonging to the suspected person, and institute legal proceedings."

Page 7 of INDICTMENT ISSUED BY HUALIEN DISTRICT PROSECUTORS OFFICE OF TAIWAN (File No.: 2009-chen-tzu-ti-1873) has a statement "to detain TOSA pursuant to Article 16 of the Law on the Exclusive Economic Zone and the Continental Shelf of the Republic of China.."

This opens one route to establish the prima facie compulsory jurisdiction of ITLOS under urgent proceedings: the provisional measures under article 290, paragraph 5, of the Convention; and the prompt release of vessels and crews under article 292 of the Convention considering that the President of the International Tribunal for the Law of the Sea clarified at Page 13 of The Gilberto Amado Memorial Lecture held during the 61st Session of the International Law Commission at Geneva, on 15 July 2009, "It is to be emphasised that the prompt release procedure is a special one that, when based on compulsory jurisdiction, may only be instituted before the Tribunal in cases, as stated before, of detention of vessels and crew for alleged violation of fisheries legislation of the detaining State and for marine pollution or environmental damage. The prompt release procedure cannot be used in cases of detention or arrest of vessels and crew for other reasons."
