Jan Lokpal Referendum Questionnaire1. Every government department should have a Citizen’s Charter, which

should state which officer will do which work in how much time.(a) Anna: If Citizen’s Charter is violated, i.e. if the citizen’s work is not done in stipulated time, then penalty should be impose d on guilty officer, which should be paid to citizen as compensation. It should also be deem e d to be a case of corruption against guilty officers.(b) Govt: Citizen’s Charters are fine but penalties should not be there.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue

2. Lokpal should have jurisdiction upto which level of officials?(a) Govt: Lokpal should have jurisdiction only on Group A officers of the Central govt because it would be impossible for Lokpal to check corruption of entire 40 Lakh employees of Central.(b) Anna: Corruption is rampant throughout from top to bottom. In fact common people have to deal mostly with lower bureaucracy. Therefore all officials should be brought within the jurisdiction of Lokpal and adequate systems should be set within Lokpal to deal with it.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue

same Bill.(a) Anna: Common people have to deal mostly with state government depts, like ration, pensions, roads, electricity etc. Therefore, through the same Bill, Lokpal should be set up for central government departments and Lokayukta should be set up in each state.(b) Govt: The state govts should take their own measures to tackle corruption in sate depts; it is theirresponsibility.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue.

4. There have been several allegations of bribery against our MPs to cast vote or ask questions in Parliament. Who should investigate such cases?(a) Govt: A Committee of MPs themselves should investigate such cases. Lokpal cannot investigate such matter as it would violate our Constitution.b) Anna: It is not possible for MPs to investigate against their own colleagues. This system has not worked. Despite strong evidences ,no MP has ever been jailed on these charges in last 62 years. An independent Lokpal would do a fair investigation. If Constitution need to be amended ,we should do it.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue

5. Who should give permission to register an FIR against a corrupt judge?(a) Govt: This matter should be addressed through judicial Accountability Bill, which says that a committee of same high court should give permission to register FIR against their corrupt colleague judge. of 3 judges(b) Anna: Judge will never give permission against their own colleague Therefore an independent 7 member bench of Lokpal should grant the permission.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue

6. Who should investigate charges of corruption against the Prime Minister?(a) Govt: CBI should investigate corruption charges against PM. Lokpal shouldn’t be allowed to investigate it. PM won’t be able to function if flood of frivolous complaint are received against him.(b) Anna: CBI is directly under the control of PM. How can it investigate against its own boss? Lokpal is independant. Let Lokpal investigate corruption charges against PM. Adequate safeguards have been provided in Jan Lokpal Bill against frivolous complaints.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue

(a) Govt: The minister of that dept should order dismissal of corrupt officer. If Lokpal will have these powers, then officers will not obey their superiors.(b) Anna: The ministers & bureaucrats are in collusion with each other in corruption. Often the ministers, instead of punishing the corrupt ,reward them with plum postings. Therefore dismissal of corrupt officer should be ordered by independent Lokpal rather than the Minister. Even then, the authority for decidingpromotions ,transfer etc. would continue to remain with minister ,so it is wrong to say that officers will not obey their seniors.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue

8. On Lokpal Bill, how should your MP vote in Parliament?(a) He should vote according to his Party High Command’s orders(b) He should vote according to the wishes of the people, that emerge out of this referendum.(c) I don’t agree to both proposals.(d) I don’t have an opinion on this issue.
