Export and Import Control Act 1950….

PREFACE

Import and export means respectively to bringing into and taking out of Bangladesh by sea, land or air.

There are several provisions relating to import and export in Bangladesh .These provisions are enforced to prohibit, restrict, execute or otherwise control import and export……………

AUTHORIZED PERSON TO CONTROL THE ACT

According to section 2(a),Chief controller, a collector of customs is appointed by the government under the custom act 1969.controller appointed by the government to perform the duties of controlling import and export.

POWER TO PROHIBIT OR RESTRICT According to section 3(1), the government may

, by order published in the official gazette , prohibit, restrict or otherwise control import and export of goods of any specified description.

By section 3(2), no goods of the specified description shall be imported and exported except in accordance with the conditions of a license to be issued by the chief controller or any other authorized officer on behalf of Government.

 PROHIBITION TO SELL OR PURCHASE IMPORT LICENSE

According to section 4(a), no person shall sell, purchase or otherwise deal in any import license other than an import license issued under the export bonus scheme that means scheme introduced by government.

PROHIBITION REGARDING SALE AND TRANSFER OF GOODS BY INDUSTRIAL CONSUMERS

According to 4(b),Except with the previous permission in writing of the controller or any other authorized officer , no person who is in his capacity as industrial consumer , without any license ,shall sell, purchase or transfer such goods which is allowed by the act 1950……

AMENDMENT

An Act to continue for a limited period powers to prohibit control imports and exports. (As amended up to the 26th May, 1962)

After independence of BD this act was amended in 1975.

The following Acts of House of the Nation received the assent of the president on the 3rd December,1997.

PENALTY

According to section (5), If any person contravenes any provision of this act

or any order made on this rule , he/she will be punished with imprisonment for a term which may extends to one year, or with fine, or with both. No court shall take cognizance of any offence punishable under this section except some cases.
