Personal devices can be owned by the business and used by its employees

Personal devices can be owned by the employee and used by that employee in the employer’s business

Intention is usually to make working easier, for the employees to be more available and able to provide a better service with fewer delays

Some problems

PINs and passwords are not always used by employees and, when they are, they are rarely changed

encryption and software to protect devices can reduce their speed and capacity

open access WIFI in coffee shops, hotels and other places can leave devices open to hacking

the devices can be used for a mixture of home and office use

the device can be lost

what happens if the employee leaves or dies – will the employer have the PIN or password it needs, will it even have physical or electronic access to the device?

if the employer’s data or other data is on a device or can be downloaded to a device and the data is supposed to be protected by the Data Protection Act how will the employer demonstrate its compliance with the DPA?

information about or belonging to the employer’s business is put in a personal folder

information relevant to the employer’s business is not downloaded to the employer’s system

Some employment policy solutions

allow the employer to monitor e-mail and other traffic

allow the employer to use passwords or PINs selected by the employer or notified to the employer

employees to change those PINs and passwords when required and to deliver up the device when requested

allow the employer to track the device and directly or remotely to download information from the device

Other solutions make clear the reasons for what may appear to be

significant restrictions on the employees and the sanctions which may flow from a breach of policy

train the employees so they understand how the business may be damaged if the information is lost or gets into the wrong hands

involve your IT people so they can help with risk assessment and solutions

review policies, procedures and technical developments regularly
