AN EARNEST REQUEST TO THOSE IN POWER

This slide show is not meant to address the personal problem of communal suppression/landgrabbing/ violation of fundamental rights because it is futile to demand justice through such presentations. It is to create an awareness that such things do exist in the current society and these are known to many of us and only few have skill, time and dareness to express them and these need to be solved on national issue through general consensus and through deeper understanding of the subject because this communal suppression could be done by any community whosoever is in power in a particular legislative constituency

About the complainant

The author belongs to Punjabi Community and that too of parents who were refugees who had to surrender everything of their belongings in now called Pakistan during the independence partition. This Kotla Mubarak pur Village is an urbanized village and is dominantly inhabited by Gurjar Community and basically except in few pockets of Kotla Mubarak pur , every other community is a Minority community by default

PROVISIONS BY STATE TO ADDRESS THE PROBLEM

India is a truly democratic republic and Indian constitution has been framed to let the democracy operate with no discrimination of minority by the majority.

The key feature of Indian constitution is seculiarism, a part of which states that apart from religious domination between different religious groups, there should be no domination by one community over the other within the same religion.

Every effort has been made to prevent the dominion of majority over the minority by bifurcating the state powers into legislative and executive with a check by judiciary in case of dispute

FAILURE OF FOOL PROOF SYSTEM• But as per current circumstances prevailing in our country,

the menace of caste and creed has penetrated into this foolproof system provided by the constitution of India.

• In this case, one finds that Gurjar community persons who are in majority are well connected and they have persons belonging to their caste in all the three tiers of state power, i.e. they have representation as legislature which is by default a Gurjar belonging to any party coming in power, they have their caste persons employed in Corporation bodies as well as police and judiciary at local level. Therefore the three tiers of administration i.e. legislative, administrative and judiciary fail to deliver justice due to pressure from their own groups…this is one are that needs to be addressed in our constitution

FAILURE OF FOOL PROOF SYSTEM (cont.)

• Therefore it is fruitless if a person from minority even dares to complain to the local police or the corporation body or to the judiciary at SDM level. The complaints are bound to be either not attended at all or the action get delayed by months and years and the complainant is further exposed to the tyranny of the majority wherein he suffers from losses as well as torture which assume different forms and shapes which can hardly be accounted to and in such a way that no evidence is ever left by the majority which acts in a mob like fashion wherein it is always difficult to predict and pinpoint against a particular person.

FAILURE OF FOOL PROOF SYSTEM (cont.)

This failure of the three tiers of governance is visible one enters the kotla mubarak pur and one can see it in different forms….even the instructions of highest courts are openely disobeyed……

Illegal constructions, unauthorised buildings, land grabbing, enroachment on roads/streets,

cows and buffalo keepings in public passage, open hukka smoking in public places Putting of cow dung in public passage

storing cow dung cakes in public passagePutting charpais in open street and thereby blocking the passage

Page 8: A case study violation fund right

The torture of communalism at personal level…..this is the public passage which is

the only right of way to my own house….see how it is being blocked by

majority community

Page 9: A case study violation fund right

The torture continues…see how the group hukka smoking is in progess and that too in public passage…the pathetic part is that sometimes police persons or even the ex. MLA or Councillor are seen smoking in such groups

Hindu Communalism/religious intolerance during partition

The tolerance between different communities within the Hindu Religion is much worse than amongst persons of different religions.

As a Hindu before partition and living in now so called Pakistan was much better than living as a Hindu in Hindustan

Our family was saved in pakistan during partition violence only because of Muslims brotherhood with our family

Whereas the life has become hell by living in Hindustan due to Intra-religion communalism

A practical experience

• If you are interested in learning what is communalism…what is gurjarism…what is communal pressure…what is suppression…..

• Just pay a visit to my house at address quoted in first slide then you would know in which country you are living…what is the current level of development in terms of tolerance amongst different groups

• How law is totally ineffective

Page 12: A case study violation fund right

Why should I complain and put my life in danger

• You just come to my house and you will not be allowed to park your vehicle in front of my house….

• You just see violation of law…smoking in public place with no action by Police…the station is just few meters away

• Ideally no one can sit in group of four or five in public passage..but it is there

Page 13: A case study violation fund right

Why should I be the complainer

• In india…everything is fine as long as there are no complains

• But being a complnaint is to risk your life.• Therefore I am not complaining,… I am inviting

everybody to have a taste of communalism and that too without any charges

• Just give a free ride to my house and enjoy it
