Janice recently returned from a Special Counsel position with the Senate Judiciary Committee, where she was asked to testify and then return to staff to support the national, border and identity security aspects of the now Senate-passed immigration reform legislation. Ms. Kephart is an internationally recognized border and ID security expert, who served as counsel to the 9/11 Commission and was a key author of the Staff Monograph, 9/11 and Terrorist Travel as well as the immigration and identity security-related facts and recommendations in the 9/11 Commission Report. Much will depend on education and acceptance by both the public and private sectors

• Why are biometrics so important right now?

• Because most of our trusted transactions are no longer face-to-face

• Thus, the most traditional form of biometric, our brains using facial recognition to authenticate identity, has been lost

In the United States, while governments internationally implement biometrics throughout

functions• Commerce Department’s NTIA seeks to create an “enforceable code of conduct” based on misunderstanding of biometrics• Commerce Department’s NIST E-Authentication for cyber access remains dormant since standards published in 2007• DHS remains at standstill, losing its cutting-edge • DOD is bogged down in red tape• Intelligence community is quietly integrating biometrics into the entire watchlist process, realizing that name based systems are wholly inadequate• Congress seeks repeal of key 9/11 Commission biometric recommendations (immigration reform)• Congress with few exceptions is generally uneducated and uninterested• Florida seeks to ban biometrics in schools
