arrested and he was convicted in 1966 Phoenix Arizona
3. WHAT HAPPENED? Ernesto Miranda was charged with raping a 15
year old girl, kidnapping, and robbery. Police forgot to read
Miranda his rights before he arrested him. He then confessed and
his confession was taken to trial but could not be used because it
was considered unconstitutional. The trial had to be thrown out. He
was then retried.
4. WHY IS IT IMPORTANT? Criminals have to be read their rights
because if not they are being denied their liberties granted by the
constitution. Many people of the supreme court feel that without
the law, people would be allowed to go free when it comes to
technicalities with in the court room.

York, he was not read rights but he sold drugs to an undercover cop
and was arrested and the evidence was taken by his rights were
read. Dickerson vs. United States, He confessed to being a driver

confession under the 5th and 6th amendment can not be dismissed
unless they have been read their rights and then have decided to
