• According to the Decision E1 of the AC, Romanian institutions continue to issue E 301, E 302 forms

• Insurance periods or periods treated as such and specified in the European forms issued by other MS are taken into account unconditionally by Romanian competent institutions

• Intense activity in relation with Italy and Spain, mostly in one way direction: Romanian insurance periods certified in view of establishing entitlement to unemployment benefits in one of the above-mentioned states

• Less significant exchange of information and forms in relation to other member states

• Reference period of 1 year (1st October 2010 – 31 October 2011):

• 4766/E301, out of which: - 2164 issued for Spain

- 1992 issued for Italy• 6333/E 302, out of which 6320 issued for Spain

• The number of E 301 claimed by Romania from other MS over the same period is significantly lower: 64

• Lack of required documents when a Romanian E 301/E 302 is claimed by other MS, which finally leads to subsequent Romanian delays in issuing requested forms

• Long waiting time until requested forms are delivered by other MS

• Reluctance of certain institutions to use e-mail communication when further exchange of information is needed, which extends the waiting time

• Improperly filled in forms (undated, unsigned, not stamped)

II. II. Export of unemployment benefitsExport of unemployment benefits

Common procedures applied by Romanian institutions:-Export period initially authorized for 3 months-Period extended up to 6 months upon the request of the unemployed, transmitted before the end of the initial 3-month period/ no criteria-Payment of the Romanian unemployment benefits only upon receiving U009 confirming registration as jobseeker and U013 (monthly monitoring)-U013 can be replaced by the own behalf statement of the unemployed, transmitted before the end of each export month

which, 9 for Spain, 5 for Hungary,)• Exported MS unemployment benefits: 126, out of which:

Implementing problemsImplementing problems

• Failure to deliver or delayed delivery by other MS of U009, which could stop or delay payment of Romanian unemployment benefits

• Sometimes, neither U013, nor the own behalf statement of the unemployed is received, meaning no payment is made

• Late payment of unemployment benefits by other MS, in which case the unemployed asked for assistance from Romanian liaison body

• Just a few entitlements were established under art. 65 of BR: - 1 frontier worker (employment state Hungary)

- 3 mariners (employment state Italy, Germany, Luxemburg)- 1 seasonal worker (Germany)

• No Romanian claims for reimbursement were sent up to the current date because:

- either the payable period of 3/5 months did not elapse, or:

- payment of unemployment benefits is currently suspended because of short-time employment

• Romania received several reimbursement claims from other MS:- 3 from Hungary- 2 from Germany- 1 from Bulgaria- 1 from Sweden

• The reimbursement claims were examined, but no payments will be made before AC Decision U4 is adopted, especially that Romanian delegation sent proposed amendment of section <determination of refundable period> of the draft Decision U4

• Less intense exchange of information and forms compared to Spain and Italy

• Whenever needed, efficient and prompt communication at liaison bodies level

• Shared standpoint in relation to the draft Decision U4 regarding reimbursement of unemployment benefits
