The employment rate of people

with disabilities

In Romania, the employment rate of people with disabilities remains one of the lowest in Europe (in 2010 - 12,26%).

Psychological factors and stereotypes that deter employers to hire people with disabilities:

1. Persons with disabilities achieve their tasks at a lower level than other employees.

2. We have no post suitable for a disabled person

3. We are afraid to hire disabled people for safety reasons.

4. Fear of not being able to give out a disabled person if employers are not satisfied, because the legislative framework.

5. Administrative overloading is too high.

6. The legal situation is not transparent.

7. Employees with disabilities will have problems / disputes with colleagues or their direct bosses.

8. People with disabilities are not sufficiently qualified.

Authorities in the field of professional integration in Romania National Agency for Employment is a public institution under the Labor Ministry offers, free of charge, to all persons seeking employment services:- information,- counseling and guidance,- training,- mediation,- advice and assistance to start a new business.

Priorities of the Social Security PolicyAccording to the law 448/ 2006, every employer :

• has to offer jobs in a quantum of 4 % if he has over 50 employers or

• has to pay for every unemployed person with disabilities 50% of the minimum salary or

• has to buy monthly products and services from a shelterd units.

Also, a person with disabilities has a posibility to establish his own shelterd unit, having multiple benefits ( for example lower taxes).

Some NGO give the posibility to acces jobs by helping them with courses and offering support in the procces of social and professional integration.

The law supports special schools in establish shelterd workshop.

Quota system in Romania If the initial penalties were paid by

employers into a special fund used to finance various assistance programs for people with disabilities, at present they are transferred to the general budget.

Quota system in Romania has a poor implementation.

As remittances fall in the general budget is not clear to what extent this money back to people with disabilities as labor market integration services.

Sheltered unitsRomanian legal framework allowing

founding of private bodies to provide employment for people with disabilities.

The duty of the entrepreneur who lead such structures called sheltered units is to provide that unit by employment status based on employment contract at least 30% disabled employees in total.

(Government Decision no. 268/2007 on rules for the application of Law no. 448/2006).

units with legal personality, whatever form of organization and ownership, that have at least 30% of the total number of employees assigned to the disabled individual employment contract;

sections, workshops or other structures without legal personality of the economic or non-governmental organizations, which have their own accounts and at least 30% of the total number of employees assigned to the disabled individual employment contract;

family associations, non-profit associations or foundations, consisting of at least one person with disabilities;

the disabled person authorized by law to conduct independent economic activities.

According to data provided by the General Authority for People with Disabilities, on the 14th of September 2011, 498 protected units were registered in Romaniaand were working 1389 people with disabilities.

Therefore 50% of people with disabilities who are employed are working in the protected units in the country.

Counseling and vocational orientation in schools

In schools there are school counselors who offer counseling and vocational guidance. They belong to the county centers of assistance and educational resources.

In special education organization chart does not provide a specific job for school counseling and vocational guidance.

The curriculum (both in general and special schools) includes subject area guidance and counseling.

Is an association of school centers for inclusive education “ ALEXANDRU ROŞCA” LUGOJ;

Established in January 2016;Mission: defend the rights and interests of

persons with disabilities, increase their quality of life and promote their full inclusion and participation in community life they belong, favoring their socio-professional integration;

The association relies on the support of teachers C.S.E.I. ,, AL. ROŞCA '', volunteers and donors.

The main goal of the association improve the lives of children and

youth with disabilities, providing material and moral

support their families, promoting social integration and

awareness raising about them.

In conclusion:Of all the options in the market in the last

years in Romania, most likely as a disabled person to find a job is in the public sector;

The number of private sector employment of persons with disabilities is very small;

Differences between legislation concerning employment of persons with disabilities and the reality of the labor market;

The employer option to choose of payment of a sum instead of hiring people with disabilities reduces the chance of the person with disability to get a job.
