This subject builds up managerial skills to be applied to individual problematic cases related to properties, boundaries, assessment, development and financing of projects. Knowledge is obtained on the organizational functions and strategies as well as the role of the real estate in reaching the goals of an organisation. An approach towards the return on investment is developed as well as to the operative performance in the process of betterment and reconstruction of real estates.

Анотация

Дисциплината развива управленски умения по отношение прилагането им към отделни проблемни ситуации, свързани с имоти, граници, оценяване, разработване и финансиране на проекти. Придобиват се познания за организационните функции и стратегии и ролята на недвижимия имот в постигането на целите и задачите на организацията. Създава се отношение към финансовата възвръщаемост и оперативната производителност в процеса на подобрение и реконструкция на недвижимите имоти.

Annotation

This subject builds up managerial skills to be applied to individual problematic cases related to properties, boundaries, assessment, development and financing of projects. Knowledge is obtained on the organizational functions and strategies as well as the role of the real estate in reaching the goals of an organisation. ЗА

ДАНИЕ

Към Вас се е обърнал собственик, който е придобил съществена собственост в карето зад Съдебната палата. Кварталът опира на улиците "Алабин", "Позитано", "Княз Борис 1" и "Лавеле" .

Собственикът притежава в момента около 1/2 от имотите (земя и сгради) и се опитва да закупи и останалите имоти. Той не е сигурен какво ще прави, когато придобие всичките имоти от този квартал. Стремежът му е да спечели колкото е възможно повече в дългосрочен план.

Не Ви е даден списък на собствениците и наемателите, но е допустимо, след като направите оглед на имотите да правите разумни допускания по отношение на тях, както и за плащаните наеми и срокове на договорите за наем.

Собственикът се интересува как ще управлявате недвижимите имоти през следващите десет години.

1. Описанието на недвижимите имоти в портфейла. В момента портфейлът включва сградата в строеж в УПИ V и трите сгради, които са паметници на културата в УПИ II. Районът е развиващ се, а местоположението му, непосредствено зад Съдебната палата, предполага изграждане на офис площи. Препоръчвам незабавно да се започнат процедури по възстановяване на строителни книжа за първият имот. Сградите във втория са в лошо физическо състояние. На партерните етажи в тях сега се помещават магазини и заведение, а на второ ниво – адвокатски кантори. 2. Стратегията за портфейла от недвижими имоти. Предлагам развитие на портфейла от имоти – закупуване на УПИ III и УПИ IV и създаване на обща концепция „Групов паметник на културата”, който да обедини сградите в УПИ II и Музеят на Министерството на Вътрешните Работи, чиято сграда също е паметник на културата. Собственикът не може да придобие музея, но по този начин може да запази средата му от бъдещи негативни намеси и така макар и да не притежава всички имоти в квартала, на практика той ще може да изгради обща среда. Концепцията включва реконструкция на сградата в строеж и добавяне на нови „стъклени” обеми, които да не подтискат, а напротив – да подчертаят паметниците в комплекса. Това ще намали и дължимият наем сгради (който в България се заплаща от наемодателя, а не от наемателя). На всеки един етап проектът трябва да бъде съгласуван с Института за Паметниците на Културата, но аз препоръчвам да бъде разработван в тясно сътрудничество с държавните експерти и да не се разчита на процедурите на мълчаливо съгласие. За да се осигури по-голям обем в РЗП (позволен от Общия Устройствен План), може да се предложи партерното ниво да бъде открито публично пространство с голяма светла височина, осигуряващо и добър визуален контакт със сградите паметници. Да се избере такова решение, че да е възможно поетапно изграждане като по този начин може наемателите на площите от УПИ II да се изместят в новата сграда в УПИ V. Промените в Закона за Устройство на Територията от 2007 год. дават възможност за изграждане на публични обекти върху имоти частна собственост и обратно (във връзка с изграждането на метро, подлези и т.н.). Те позволяват да се усвои земята под бъдещата трамвайна спирка (в северната част на имота) и изгради подземен паркинг като може той да има и рампа там.

Във връзка с поетапното изграждане е възможно отначало достъпът до паркоместата в ниво сутерен да се осигури чрез товарен асансьор, а в последствие да се организира обща система за паркиране – вход от асансьор, като

автомобилът се насочва със светлинна сигнализация към местото, което трябва да заеме и изход от рампа, като системата ще следи потоците вход и изход да не се засекат. Препоръчвам още от инвестиционните проектни проучвания да бъде придобита собственост върху УПИ III и УПИ IV, като в никакъв случай да не се продават площи преди рекламата на комплекса и оценка на реалната стойност. З. Политиката при използване на недвижимите имоти. Препоръчвам собственикът да запази офис площите а да продаде административните площи, магазините и заведенията в партерно ниво. Също така последното ниво да бъде заето от апартаменти тип „Пентхаус”, от чиято продажба инвеститорът ще спечели в пъти повече от колкото от наем. 4. Рутинни въпроси. Предлагам собственикът да се специализира в отдаване на офис площи за адвокатски кантори, като осигури комплексно обслужване, включително малка правна библиотека или да покани една от фирмите поддържащи правна информационна система. За целта да се създаде компания, която да управлява комплекса. Заедно с това тя може да организира културни събития, изложби, коктейли и празници, да създаде каталог на наемателите, списание и т.н. Да се рекламират културните събития, а не комплекса. 5. Проучвания и анализи. А. Пазарно проучване на нивата на наемите и продажбите за различните типове и видове имоти за района (в приложение): Извършеното проучване показва, че най-голяма доходност ще донесе продажба на административни площи, магазини и заведения в партерно ниво, както и на апартаменти в последно ниво (високи цени при продажба и ниски наемни), но запазване и отдаване под наем на офис площи в другите нива.

(2) Устройственото и функционалното предназначение, ограниченията при застрояването, правилата и нормативите за устройство и застрояване на видовете територии, устройствени зони и самостоятелни терени по ал. 1 са посочени в приложението.

Раздел III

Устройство и застрояване на централната градска част Чл. 9. (1) В градския район се обособява централна градска част на гр.

София, която включва следните групи устройствени зони и самостоятелни терени:

1. група централни устройствени зони (Ц): а) устройствена зона на новия делови център (Ц-1); б) устройствена зона на стария софийски център (Ц-2); в) устройствена зона със смесено застрояване (Ц-3); 2. група смесени многофункционални устройствени зони (Смф): а) смесена многофункционална устройствена зона с високи параметри на

застрояване (Смф1); б) смесена многофункционална устройствена зона (Сиф2); 3. група устройствени зони за обществено обслужване (О); 4. група жилищни устройствени зони (Ж); 5. група устройствени зони за озеленяване (3); 6. група устройствени зони за спорт и атракции (Са); 7. устройствени зони и терени за защита на културно-историческото

наследство; 8. самостоятелни терени за специфични нужди (Т).

(2) Устройственото и функционалното предназначение, ограниченията при застрояването, правилата и нормативите за устройство и застрояване на видовете територии, устройствени зони и самостоятелни терени по ал. 1 са посочени в приложението.

(3) Застрояването в устройствената зона на новия делови център не се ограничава във височина, етажност, интензивност и плътност. Параметрите на застрояване за отделните квартали се определят по реда на чл. 21.

(4) Застрояването в устройствената зона на стария софийски център се извършва и в съответствие с изискванията на Закона за паметниците на културата и музеите за устройствена защита на културно-историческото наследство.

(5) Ново строителство, пристрояване и надстрояване на съществуващи сгради в централната градска част се разрешава въз основа на влязъл в сила работен устройствен план при спазване изискванията на раздел VI.

Специфичен режим за ГГЦ с многофункционално предназначение - за общественообслужващи дейности, обитаване и други допълващи функции. Не се допускат обекти за дейности с вредни отделяния и влияния. Задължително се изпълняват всички изисквания за изграждане на средата, с оглед ползването й от инвалиди. Във всеки УПИ мин. 10% от РЗП на приземно и/или първо подземно ниво да бъдат оформени като публични пространства. При прилагане на максимално допустимите стойности за плътност на застрояване част от озеленяването се реализира върху застройката - хоризонтално и вертикално; Мин. 25% от озеленената площ е с високи дървесни насаждения

§1. За териториите, с проблеми от екологичен, геоложки, социално-етносен и инфраструктурен характер към подробните устройствени планове задължително да се изготвят специфични правила и нормативи, които се изработват и одобряват

18 заедно с ПУП. Върху чертежите в М 1:10 000 и М 1:25 000 тези територии са отбелязани със звездичка, поставена след буквения индекс на съответната устройствена зона. §2. Териториите за далекоперспективно развитие се маркират с буква “д” след буквения индекс на устройствената зона, с райе в съответния за зоната цвят. Тяхното усвояване по новото предназначение се предвижда да започне след 2020г. §3. Сградите с обществено предназначение в строителните граници на град София, попадащи в комплексните градски центрове от първо до трето ниво нямат ограничения по отношение на височината, но при спазване на изискуемите отстояния от жилищни сгради, детски и болнични заведения и училища. В тези случаи виза за инвестиционно проектиране се издава въз основа на работен устройствен план, одобрен от СОС. §4. За всички видове устройствени зони, без да се нарушават допустимите за съответната зона параметри Кинт и % на озелененост, отклонения до 5% от максимално допустимата плътност на застрояване се допуска по изключение с разрешение на Общинския експертен съвет за устройство на територията. §5. За функции, определени в ОУП като стратегически за развитието на града и региона и от национално значение, се допуска промяна на предназначението на земеделски и горски земи, попадащи в “зона без право на застрояване” след взето решение от СОС и съгласуване от МРРБ за всеки конкретен случай. Горните функции са представени в списъчен вид към обяснителните текстове. §6. В смесените устройствени зони хигиенно-защитните зони, установени с подзаконовата нормативна уредба на ЗЗ, се изискват до регулационната граница на жилищните УПИ; §7. Рампите за влизане в подземните обекти се считат за елемент на подземното застрояване в цялата си дължина . §8. Допълнителните режими поставят допълнителни изисквания и ограничения към основното функционално и устройствено предназначение на територията. §9..Размерът на частта от минимално определения процент за озеленяване в устройствените зони, която следва да бъде с висока дървесна растителност се определя по проекцията на короните на дървета на 20 годишна възраст, съобразно вида им, посочен в дендрологичния проект.

Песимистичен вариант: 20% наети площи (наетите сега) При подобно стечение на обстоятелствата препоръчвам обединяване на последните две нива в апартаменти и продажбата им. Реалистичен вариант: 60% наети площи Проектът е реализуем с десетгодишна кредитна линия. Оптимистичен вариант: 100% наети площи При този вариант стратегията може да се изпълни без кредит (при поетапно изграждане), като не препоръчвам запазване на апартаментите в последно ниво – те са с много високи продажни и много ниски наемни цени, трудно се намират и наематели. По-добре да бъде развит съседен квартал по подобен начин. Основните преимущества на концепцията са:
