THE NANDI COUNTY FINANCE BILL, 2018

A BILL of the County Assembly of Nandi to amend the law relating to various taxes and duties; and for matters incidental thereto.

ENACTED by the County Assembly of Nandi, as follows—PART I — PRELIMINARY

Short title and commencement.

1. This Bill may be cited as the Nandi County Finance (Amendment) Bill, 2018 and shall come into operation upon publication.

Interpretation. 2. In this Bill, unless the context otherwise;“Authorized channel” means the manner in which a person may

effect payment to the County, including but not limited to a person designated by the Executive Committee Member pursuant to Section 157 of the Public Finance Management Act, 2012, to collect or receive revenue or any other mode of payment as may be prescribed from time to time;

“betting premises” means premises to which the public has or may have access and which are kept or used (whether on one occasion or more than one) for the purpose of—

(a) bets being made therein between persons resorting to thepremises and the owner, occupier or keeper thereof, or anyperson using the premises, or any person procured or employedby or acting for or on behalf of the owner, occupier, keeper orperson using the premises, or of any person having the care ormanagement or in any manner conducting the business thereof; or(b) any money or valuable thing being received by or on behalfof the owner, occupier, keeper or person aforesaid as or for

the consideration for any assurance, undertaking, promise oragreement, express or implied, to pay or give, or for securing thepaying or giving by some other person of, any money or valuablething on any horse race, or other race, fight, game, sport, lotteryor exercise, or any other event or contingency;“betting transaction” includes the collection or payment of winnings

on a bet and any transaction in which one or more of the parties is acting as a bookmaker;

“Business” means trade, commerce or manufacture, profession, vocation or occupation, or any other activity in the nature of trade, commerce or manufacture, profession, vocation or occupation, or any activity carried on by a person continuously or regularly, whether or not for gain or profit and which involves, in part or in whole, the supply of goods or services for consideration;

“County” means the County Government of Nandi; “County Public Officer” means a county public officer within the

meaning of Section 2 of the County Governments Act, 2012; “County Receiver of Revenue” means the person appointed

pursuant to the Nandi County Revenue Administration Act, 2016;“Executive Committee Member” means the executive committee

member for the time being responsible for matters relating to finance and economic planning in the County;

“lottery” includes a sweepstake, a raffle and any scheme or device for the sale, gift, disposal or distribution of any property depending upon or to be determined by lot or chance, whether by the throwing or casting of dice, or by the withdrawing of tickets, cards, lots, numbers or figures, or by means of a wheel, or otherwise howsoever;

“totalizator” means the instrument, machine or contrivance commonly known as a totalizator, or any other instrument, machine or contrivance of a similar nature, or a scheme for enabling any number of persons to make bets on any event or contingency whatsoever with one another or principles of a similar nature;

“Person” means a natural or juristic person; “pool betting” means the making of bets (other than bets made by

means of totalizator), whether the bets are made on the system known as a fixed odds betting or otherwise, by a number of persons on terms that the winnings of such of those persons as are winners shall be, or be a share of, or be determined by reference to, the stake money paid or agreed to be paid by those persons;

“pool betting scheme” means a scheme involving the receiving ornegotiating of bets made by way of pool betting;“totalizator” means the instrument, machine or contrivance

commonly known as a totalizator, or any other instrument, machine or

contrivance of a similar nature, or a scheme for enabling any number of persons to make bets on any event or contingency whatsoever with one another or principles of a similar nature;

“Zone A” means the urban areas comprising of Kapsabet Municipality;

“Zone B” means the area comprising of Nandi Hills Town and its Environs; and

“Zone C” means the areas not captured under Zones A and B above.

PART II— CHARGES, TRADE LICENSE FEES, RENT, INFRASTRUCTURE MAINTENANCE FEES

General Fees or charges.

3. (1) A person who wishes to carry out the activities specified in the Schedules shall pay the fees specified in the last column of the relevant Part of that Schedule.(2) A person who wishes to carry out any of the activities listed under Schedule shall apply for a permit to the County. (3) The County shall grant the relevant permit(s) to the applicant(s) upon payment of fees prescribed in the relevant Part of that Schedule.(4) A person who contravenes any of the provisions of this section commits an offence.

License Permit. 4. (1) A person shall not carry out, within the County, any business or service specified in the Schedule without a license issued by the relevant County Department. (2) A person intending to carry out any of the businesses specified in the Schedule shall apply for a license from the relevant County Department. (3) A person applying for license under subsection (2) shall be issued with a license on the payment of a fee, depending on the location and size of the business, as is specified in the relevant provision of the law. (4) A person who contravenes a provision of this section commits an offence. (5) In the event of a business having total outstanding licenses at the turn of the calendar year, the amount of license computed shall be increased by a penalty calculated at three (3) percent cumulative per month and thirty (30) percent above the normal rate. (6) However, marginal relief shall be allowed in cases where the amount is cleared by the turn of the year to ensure that annual amount of single business permit payable does not accrue penalties

until after 31st of March in each calendar year.

Fees. 5. (1) A person carrying on any activity specified in the Act shall pay to the relevant office a fee at the rate set out in the relevant Part. (2)A person who carries on an activity listed in the Schedule and fails to pay the fee referred to under subsection (1) commits an offence.

Plot or house. 6. (1) A person occupying any plot, stall or house leased or rented out by the County shall pay the annual rent, at the rate specified in the Schedule. (2) The rent referred to under subsection (1) shall be due in case of—

(a) a plot, on the 1st day of January of each year; and(b) a house or stall on the 30th day of each month.

(3) A person who contravenes the provisions of subsection (1) or (2) may be procedurally evicted from the premises and shall be evicted if the person fails to pay the rent for three (3) consecutive months. (4) A penalty of two percent cumulative per month shall be charged for any outstanding amount of rent for a plot that remains unpaid after the 31st day of March of every year. (5) Further, in the case of a property with a registered title deed or lease certificate the total property tax under this section (herein referred to as property tax) and where such properties having been registered for more than seven years preceding the year of notification, marginal relief shall be provided to exclude any charges beyond seven years. (6) The provisions of this section shall take effect from 1st January, 2017.

Cess or Market Fees. 7. (1) A cess or market fee shall be charged on the goods specified in the relevant Part of the Schedule at the rate specified.(2) A person who fails to pay the cess or market fee set under subsection (1) commits an offence.

Amendments to the schedules.

8. (1) The Executive Committee Member responsible for finance may forward to the County Assembly a legislative proposal entailing amendments of the schedules for consideration. (2) Any proposed legislation made under subsection (1) shall be laid before the County Assembly without unreasonable delay, and unless a resolution approving the proposed legislation is passed by the County Assembly within twenty one (21) days when the Assembly next sits after the proposed legislation is so laid, the proposed legislation shall lapse.

PART III — PAYMENT

Payments to the County.

9. (1) Any payment to the County shall be made through authorized means.(2) An officer appointed by the County to collect revenue shall have an identification card issued by the County which shall be pinned or tagged where it can be easily identified by any person. (3) A County official receipt shall be issued for all payments made to the County. (4) A person shall not receive or collect any money on behalf of the County unless he or she has been appointed in writing as per the Nandi County Revenue Administration Act, 2016, or has authority as the receiver and collector of the County revenue. (5) A person who contravenes the provisions of this section commits an offence.

Appointment and duties of an agent.

10. (1) The Executive Committee Member may by written notice addressed to any person appoint the person to be the agent of the County for the purposes of collection or recovery of charges, licenses, fees, rent or Cess, as may be necessary for carrying out the purposes of this Act. (2) An agent appointed under this section shall enforce and ensure due compliance with the provisions of this Act and shall remit all revenue collected to the county as per the appointment notice. (3) Where an agent claims to be, or to have become, unable to comply with subsection (2), he shall, within seven working days, notify the Executive Committee Member in writing setting out fully, the reasons for his inability to comply, and the Executive Committee Member shall accept the notification and cancel or amend the Appointment notice accordingly.(4) Unless and until a notification is given by an agent under subsection (3), sufficient moneys for the payment of charges, licenses, fees, rent or Cess specified in his appointment notice shall be presumed to be held by him and this money shall be due to the County.(5) For the purposes of this section, the Executive Committee Member may, by notice in writing, at any time require any person to furnish him within a reasonable time, not being less than seven (7) days from the date of service of the notice, with information showing any moneys which may be held by the

agent for, or due by him to the County. (6) Where an agent fails to pay an amount of money collected under this section within the time specified in the notice, the agent shall be deemed to have committed an offence.(7) An agent who has made a payment to the County under this section shall for all purposes be deemed to have acted therein with the authority of the County and shall be indemnified in respect of that payment against all proceedings, civil or criminal, and all process, judicial or extrajudicial, notwithstanding any provisions to the contrary in any written law, contract or agreement.(8) Any person who willfully makes any false or misleading statement, or willfully conceals any material fact shall be guilty of an offence.

PART IV —CESS

Amendment of Section 2 of No. 2 of 2017.

11. Section 2 of the Nandi County Cess Act, 2017, is amended—(a) in the definition of “Essential products” by deleting the words

“means products declared as such under Section 5” and replacing them with the words “means products that are vital to the imposition of Cess levy and are declared as such by the Executive Committee Member under Section 5”;

(b) by deleting the whole definition of “Local Agricultural Producer” and substituting therefor the following new definition—

“Smallholder producer” means a person who owns a small acreage of land within the County and utilizes it for purposes of production of the scheduled products;

(c) by deleting the whole definition of “Multinational Agricultural Producer” and substituting therefor the following new definition—

“Large scale producer” means a person who owns a large acreage of land, or land exceeding a hundred acres within the County and utilizes it for purposes of production of the scheduled products; and

(d) in the definition of “Special products” by deleting the words “means products declared as such under Section 5 of this Act” and replacing them with the words “means products that are declared by the Executive Committee Member as exceptional and pertinent to the imposition of Cess levy”.

Amendment of Section 6 of No. 2 of 2017.

12. Section 6 of the Nandi County Cess Act, 2017, is amended by—

(a) deleting subsection (2) and introducing the following new

subsection—“Notwithstanding the provisions of subsection (1), eighty per centum of the Cess revenue collected under section 4 of this Act shall be used in maintaining roads and other connected services, related to the sectors in respect of which such monies are levied, and the remaining twenty per centum shall be retained by the County Government.”

(b) inserting the following new subsections immediately after subsection (3)—(3A) Cess revenue collected under Section 4 of this Act shall be credited to the County Revenue Fund.

(3B) Administrative costs and other related expenses of the Committee shall be chargeable from the twenty per centum of the Cess revenue referred to in subsection (2).

Amendment of Section 11 of No. 2 of 2017.

13. Section 11 of the Nandi County Cess Act, 2017, is amended—(a) in subsection (1) by deleting the word "receiver of revenue"

appearing immediately before the words "shall prepare" and substituting it with the words "Executive Committee Member";

(b) by deleting subsection (3) and substituting it with the words “Reports prepared under this part shall be copied to the Committee.”;

(c) in subsection (4) by deleting the word "Receiver of Revenue" appearing immediately before the words "shall submit" and substituting it with the words "Executive Committee Member"; and

(d) in subsection (5) by deleting the word "Receiver" appearing immediately before the words "shall include" and substituting it with the word "Executive Committee Member".

Amendment of Section 13 of No. 2 of 2017.

14. The Nandi County Cess Act, 2017, is amended by deleting Section 13 and substituting it with the following section—

Establishment and composition of the Cess Committee.

13. (1) There is established a Nandi County Cess Committee.

(2) The Cess Committee shall be composed of—

(a) the chief officer responsible for finance.

(b) the chief officer responsible for economic planning;

(c) the chief officer responsible for roads and infrastructure;

(d) the chief officer responsible for

agriculture;(e) the chief officer responsible for

Cooperative Development;(f) the Receiver of Revenue who shall

act as the Secretary of the Committee;

(g) four (4) representatives of the tea farmers;

(h) a representative of the coffee farmers;

(i) a representative of sugarcane farmers; and

(j) a representative of dairy farmers and;

(k) a representative of maize farmers.(3) Representatives of the tea farmers

shall emanate from the following industry stakeholders

(a)Kenya Tea Growers Association;(b) Kenya Tea Development Agency;(c) Eastern Produce of Kenya; and (d) Siret Outgrowers Empowerment

Producer Company Limited.(4) The Committee shall elect a

chairperson from among its members under subsection (2) (g) to (k).

(5) The Committee shall elect a vice–chairperson from among its members under subsection (2) (a) to (f).

Amendment of Section 20 of No. 2 of 2017.

15. The Nandi County Cess Act, 2017, is amended by deleting section 20 and substituting it with the following section—

Power to make regulations.

20. (1) The Executive Committee Member may make regulations for the better carrying out of the purposes and provisions of this Act, or for prescribing anything which is required to be prescribed under this Act.

(2) Notwithstanding the provisions of subsection (1), the Executive Committee Member may make regulations relating to—

(a) inclusion of the Committee members under section 13 (2) (g) to (k) in the development of road infrastructure

to be maintained within areas in which Cessable products are ordinarily transported;

(b) management of County Cess collection barriers;

(c) mode of operation of agents appointed under Section 7 of the Act;

(d) conduct of public officers and Cess collection officers under the Act; and

(e) any other matter the Executive Committee Member may deem necessary for the proper carrying out of this Act.

Amendment of the First Schedule of No. 2 of 2017.

16. The Nandi County Cess Act, 2017, is amended by deleting the First Schedule and substituting it with the following schedule—

17. The Nandi County Cess Act, 2017, is amended by deleting the Second Schedule and substituting it with the following schedule—

Amendment of the Third Schedule of No. 2 of 2017.

18. The Third Schedule of the Nandi County Cess Act, 2017, is amended by—

(a) deleting the section 1 and substituting it with the following section “The Chairperson shall hold office for a period of three (3) years.”;

(b) inserting the following new subsections immediately after subsection (2)—(2A) A member under Section 13 (2) (g) to (k) shall cease to be a member of the Committee upon termination of their membership to their respective industry stakeholders’ institutions.(2B) Vacancy which occurs as per subsection (2A) shall be filled by persons from the representative industry stakeholders’ institutions in which the vacancy occurred.

(c) deleting the section 3 and substituting it with the following section “The Committee shall meet twice in every financial year.”; and

(d) by deleting the words “Ward Education Fund Committee” immediately before the words “business of the” and replacing them with the words “Nandi County Cess Committee”.

Insertion of the Fourth Schedule.

19. The Nandi County Cess Act, 2017, is amended by inserting the following new schedule immediately after the Third Schedule—

Licensing of betting, lotteries and gaming premises.

20. (1) An application for the issue or renewal of a licence or permit licensing business premises for the purposes betting, lotteries and gaming shall be conducted pursuant to the Nandi County Single Business License Act, 2017.(2) An application for the issue or renewal of a licence or permit licensing business premises for totalisators and amusement machines shall be conducted pursuant to the Nandi County Single Business License Act, 2017.

Authorisation and licensing of pool tables.

21. The County may authorize a pool table business and shall issue a pool table permit for the said purposes.

Complaints. 22. A person aggrieved by the action of a licensee or a permit holder under this Part may make a complaint in that respect to the Chief Officer responsible for matters relating to Trade and Industrial Development.

PART VI— OFFENCES AND PENALTIES

General penalty. 23. (1) Any person who commits an offence under this Act for which no penalty is provided shall be liable, on conviction, to a fine not exceeding two hundred thousand shillings or to imprisonment for a term not exceeding one year or both. (2) To maximize revenue collection, use of other arms of the National Government shall be applied during enforcement and penalties shall be effected at the expiry of the tenth day of every month for all the monthly payments. (3) Animal(s) impounded pursuant to the provisions of this Act and other related Acts of the County Assembly of Nandi and not claimed within seven days shall be auctioned.(4) Any other impounded items pursuant to the provisions of this Act and other related Acts of the County Assembly of Nandi and not claimed shall be auctioned after three (3) months from the date of impoundment unless otherwise specified.

Offences by staff of the County.

24. (1) A member of staff of the County or any other person having duty to perform under this Act who— i makes, in any record, or document required to be kept or

made by that person, an entry which he or she knows or has reasonable cause to believe not to be true or to be false;

ii willfully refuses to do anything which he or she knows or has reasonable cause to know is required to be done;

iii interferes with any other person or process under this Act, so as to defeat the provisions or requirements of this Act; or

iv where required under this Act to do anything to give effect to the provisions of this Act, fails to do that thing;

v without reasonable cause omits to do something in breach of his or her duty under this Act;

vi willfully contravenes the provision of this Act to give undue advantage or favor to another person;

vii fails to prevent or report to the County or any other relevant authority, the commission of an offence committed under this Act;

Commits an offence and is liable on conviction, to a fine not exceeding two hundred thousand shillings or to imprisonment for a term not exceeding one year, or both.(2) Notwithstanding the provisions of this section, offences committed by authorized officers whose penalty has not been specifically set by this Act, shall be punishable, on conviction as envisioned under Part VII of the Public Finance Management Act, 2012 of the Laws of Kenya.

PART VII— MISCELLANEOUS

Savings. 25. (1) Any fee, charge, license, rent or Cess payable to the County at the commencement of this Act which is not included in any part of the Schedule to this Act, shall continue to be chargeable and payable to the County unless specifically stopped by law or until a County law relating to that fee, charge, license, rent or Cess is enacted. (2) All directions, resolutions, orders and authorizations on, or relating to financial management, including the collection and administration of fees and charges given or issued by the previous Municipal Councils, County Councils and Town Councils before the commencement of this Act shall be deemed to have been given, issued or made by or under the authority of the County Assembly of Nandi until the expiry or repeal of those directions, resolutions, orders and authorizations, and shall continue, with the necessary modifications, to apply, be paid and administered under this Act: Provided that this sub-section shall also apply to such fees and charges levied by various ministries and departments of the National Government in respect of functions devolved to the County under Part 2 of the Fourth Schedule of the Constitution which fees and charges shall be levied by the County on performance of the devolved functions.

(3) All references shall include Local Authorities as were defined under the now repealed Local Government Act, Cap 265 of the Laws of Kenya.

Cessation. 26. Any contrary figures in relation to fees, charges, licenses, Cess or rent, applicable before the commencement of this Act, for businesses, activities, goods or services specified in the schedules, shall cease to apply at the commencement of this Act.

Regulations 27. (1) The Executive Committee Member may make regulations for the better carrying out of the purposes and provisions of this Act.(2) Subject to consistency of the revenue raising measures with the national legislations in force and approval by the County Assembly of Nandi, the relevant County Executive Committee shall:

(a) implement measures aimed at maximization of all revenue sources by tapping on untapped revenue sources including;

(i) water bottling;(ii) recreational activities;(iii) eco-tourism; and(iv) other potential sources as the County Executive

Committee may deem necessary;(b) review the valuation roll to optimize on rates and rents through increased property value;(c) develop prescribed forms to be utilized in the application under of various taxable or service regimes;(d) adhere to best practices and standards in revenue collection in levying fees, rates and duties by using standard forms; and(e) Implement means and ways to empower the agricultural sector to increase incomes of the citizens and county agricultural investments in order to harness the revenue potential of the County Government.

(3) Subject to compliance with the provisions of Nandi County Revenue Administration Act, the County Executive Member responsible for finance shall:

(a) grant waiver of penalties on or reduce the chargeable fees, land rates and rents of increasing revenue being collected by the County Government;(b) improve service delivery in order to make it more efficient and effective;(c) undertake measures aimed at reducing the cost of administration on revenue raising measures; and(d) enforce measures including regular departmental meetings on revenue collection performance aiming at monitoring and

evaluating revenue collection performance through the accounting officers.

MEMORANDUM OF REASONS

With the coming into Government of a new County Executive dispensation, a lot of changes relating to the taxing and/or fee charging regime principles were put in place to review the figures and taxing policies. This has led to the amendment of the Finance Act, 2017. 

The purpose of the Bill is to amend the laws relating to various taxes and duties; and for matters incidental thereto. Part I of the Bill makes provision for preliminary matters involving the short title, commencement clause and the interpretation clause.

Part II of the Bill recounts matters relating to the charges, trade license fees, rent and infrastructure maintenance fees. Under that part, provisions relating to the general procedure on application for licences and/or permits, fees payable relating to the applications of licences and/or permits, plot or house rent, Cess and market fees and the power of the Executive Committee Member responsible for finance to effect changes in the Schedules to the Bill vide regulations.

Part III of the Bill makes provisions relating to payment made to the County. It sets out the power of the Executive Committee Member responsible for finance to appoint agents to assist in the collection of revenue. It further sets out the duties and responsibilities of the agents so appointed.

Part IV of the Bill provides for amendments effected on the Nandi County Cess Act, 2017, (No. 2 of 2017). The said Part features amendments on Sections 2, 6, 11, 13 and 20 of the said Act. It further consists amendments made on the First, Second and Third Schedules of the Act. It finally introduces a new Schedule dubbed the Fourth Schedule which introduces a Conflict of Interest Declaration and Action Form.

Part V of the Bill makes provision for offences and penalties. The said part sets out a section for the general penalty for offences under the Bill whose penalty is not specifically spelt out. It further sets out offences by County Staff in the carrying out of their duties as collections agents, etc.

Part VI of the Bill makes provision for miscellaneous matters such as savings on laws, orders and by-laws of defunct authorities relating to taxes or fees chargeable by the County and gives them legitimacy as if they were enacted under the said Bill. The Bill further provides that any contradictory figures in relation to fees, charges, licenses, Cess or rent, applicable before the commencement of the Bill, for businesses, activities, goods or services specified in the schedules, shall cease to apply at the commencement of the Bill. Finally, the part makes provision for regulations to be made by the Executive Committee Member for the better carrying out of the purposes and provisions of the Bill.
