The Council of MortgageLenders (CML) points to con-fusion surrounding the defi-nition of first-time buyers.
It says that many first-timebuyers are in reality return-ing buyers who have rentedfor a period. But according tothe HMRC’s strict definition offirst-time buyers this group isunlikely to benefit from thislatest stamp duty concession.
The CML points out that theHMRC guidance says the firsttime buyer must not “havepreviously acquired a majorinterest in ...residential prop-erty....anywhere in the world".
The CML says this may bedifficult to verify and insteadcalls on the chancellor to cre-ate a far simpler concessionof exempting all propertiesworth less than £250,000from stamp duty.
The body estimates thataround 136,000 first timebuyers may still be exemptfrom stamp duty. However,the figure would have beenmore than double this if theconcession were available toall buyers including thosewho are selling a property.
The government is plan-ning to pay for this stampduty holiday for first-timebuyers by increasing stampduty tax from 4% to 5% onproperties worth more than£1m from next year.
CML director generalMichael Coogan said: "TheBudget offers a modest po-tential boost to the housing
and mortgage market interms of reducing transactioncosts for first-time buyers,and potentially improving ef-ficiencies for lenders.
“But as always the devil is
in the detail, and the detail isconfused. The stamp dutyconcession in particular lookslike a tax loophole waiting tohappen.”
Others are less critical ofthe stamp duty announce-ment. Paul Smith, chief exec-utive of estate agency chainSpicerhaart said: “First-timebuyers are the lifeblood of theindustry and the wider econ-omy. The new stamp dutythreshold is set to strengthenthe UK property market moreso than any other (recent)government initiative.
“This new measure is of na-tional significance as it willsubstantially increase thenumber of first-time buyerscoming into the propertymarket, giving the rest of themarket a much needed boostand mitigate any negative ef-fects that the recent rise instamp duty has had after thecessation of the stamp dutyholiday.”
He added that the changesto stamp duty would be “par-ticularly helpful to those try-ing to get on the ladder inLondon and the south east ofEngland where propertyprices are significantlyhigher.”

UK house prices are set to re-main virtually flat for the en-tirety of 2010, one expert hassuggested.
Howard Archer, chief UK andEuropean economist for IHSGlobal Insight, explains new"muted" data from the BritishBankers' Association (BBA) hasreinforced suspicions that houseprices will not rise for the rest ofthe year.
According to the BBA, the aver-age house price in February was£140,800 - one per cent morethan in January. Similarly, just 122more mortgages were approvedthan in the previous month.
