NCSBN CASE MEASUREMENTPILOT PROGRAM
The Ohio Board of Nursing is participating in the National
Council of State Boards of Nursing (NCSBN) two-year Case
Measurement Pilot Program. The project is testing a high-level
performance measurement system designed to provide objective data
related to the efficiency (operations) and effectiveness (public
protection) of the discipline process.
Efficiency of operations and effectiveness in protecting the public are
key performance measures for boards of nursing. Differences in board
size, operations, terminology and other variables make it difficult to
develop performance measures. This project takes these variables into
account and proposes a high-level performance measurement system
that will provide objective data. This pilot will test the feasibility of the
methodology and NCSBN will determine whether the study should be
extended to include all BONs following analysis of the data.
Cases related to substance use, errors, unprofessional conduct or
other violations of the state nurse practice act will be included in the
project. Goals are: examine the steps involved in discipline cases to
identify the most efficient and effective models for managing discipline
cases; provide performance measurement data for individual state boards
of nursing; establish aggregate data that can be used to provide
comparisons across groups such as umbrella versus independent boards,
similar size boards, etc.; develop evidenced-based uniform processes for
managing discipline cases and a common nomenclature.
The following are some of the performance measurement outcomes
that a board of nursing may obtain as a result from the study:
• Average number of days it takes to resolve the cases from start to
completion
• Economic efficiency
• Length of time to enter data into Nursys/NPDB
• Length of time to take nurses out of practice, if deemed necessary
Further outcomes of the study may include: examination of which
discipline models are the most cost efficient and effective, in terms of
public protection and recommendations based on these models;
individual board tools that are useful in the discipline process; and a
common nomenclature and discipline model that offers a standardized
process that is efficient and protects the public. •

after September 16, 2018 will pay an additional
$50.00. The total fee is $118.50, if you renew on or

MEDICAL MARIJUANA AND THE ROLE OF THE APRN, RN, AND LPN
Effective September 8, 2016, House Bill 523 (131st General Assembly) legalized marijuana use for people with qualifying medical conditions under certain circumstances. Among other provisions, the law permits a patient, on the recommendation of a physician, to use medical marijuana to treat a qualifying medical condition.
The legislation established a Medical Marijuana Control Program that is to be operational in September 2018. The Ohio Department of Commerce oversees the licensure of medical marijuana cultivators, processors and testing laboratories; the Pharmacy Board oversees licensure of retail dispensaries and the registration of patients and their caregivers; and the Medical Board issues certificates to qualified physicians in order to recommend medical marijuana. Section 3796.02, Ohio Revised Code (ORC).

Certified Physicians May “Recommend” the Use of Medical Marijuana Under Ohio Law
The Medical Board must certify physicians as a “certified
recommending physician” in order for physicians to be authorized to “recommend” the use of medical marijuana. The law authorizes physicians to “recommend” the use of medical marijuana under certain circumstances, rather than “prescribe” marijuana. Physicians are required to report the recommendation for medical marijuana treatment in the OARRS database. Section 4731.30, ORC, and Rule 4731-32-02, Ohio Administrative Code (OAC).
The Pharmacy Board Must Register Patients and Caregivers for Them to Possess and/or Administer Medical Marijuana
Each registered caregiver must be registered to a specific registered patient. A registered caregiver may be a caregiver for up to two patients, except in certain situations. Each registered patient may have no more than two caregivers. Rule 3796:7-2-02, OAC.
Registered Patients, Registered Caregivers, and the Nurse’s RoleUnless the nurse is a registered caregiver for a registered
patient, APRNs, RNs and LPNs are not authorized to possess or administer medical marijuana. APRNs, RNs, and LPNs may only possess or administer medical marijuana if they are registered with the Pharmacy Board as a registered caregiver for a specific registered patient. The Board recently received questions regarding a nurse’s use of
various types of ultrasound technology or devices during the course of their
nursing practice. For example, can a RN use ultrasound technology to guide
insertion of a peripherally inserted central catheter, or can a nurse use an
ultrasound device to assess a patient’s urinary bladder volume? Also, may a
RN perform limited obstetrical ultrasounds for purposes of providing
nursing care? To answer these types of practice questions, nurses can use
the Board Decision-Making Model found on the Board website at www.
nursing.ohio.gov under the “Practice RN and LPN” link.
The Decision-Making Model is a process to determine whether a
specific nursing procedure, task or activity is (a) consistent with their
scope of practice, including standards of practice; (b) prohibited by other
laws or rules; (c) appropriate to perform based on the nurse’s knowledge
and skills; and (d) appropriate based on the clinical situation or
procedure. The following outlines the process in relation to the use of
ultrasound technology/devices.
• Scope and standards of practice: Scope of practice is set forth in
Section 4723.01(B), Ohio Revised Code (ORC), for RN practice,
and in Section 4723.01(F), ORC, for LPN practice. In addition,
RNs and LPNs are responsible for following the administrative
rules, “Standards of Practice for RNs and LPNs” in Chapter
4723-4 of the Ohio Administrative Code (OAC). The Nurse
Practice Act (Chapter 4723., ORC) and Administrative Rules
(Chapter 4723, OAC) are available for review in their entirety on
the Board website under the “Law and Rules” link.
• Other law or rules that apply to prohibit the activity or task:
Consider if the operator of an ultrasound device needs a license
or are there any regulations about the use of the device? It does
not appear that there are any other federal or state laws that
would apply so a nurse may use an ultrasound device for the
purpose for which it was designed and manufactured as long as
the nurse is educated and competent in its correct use.

• Appropriate to perform the activity or task based on the nurse’s
knowledge and skills: Rule 4723-4-03(D), OAC, states that a RN
may provide nursing care that is beyond basic nursing preparation
if the RN obtains education from a recognized body of knowledge
relative to the nursing care to be provided; the nurse demonstrates
the knowledge and skills necessary to provide the care; the nurse
maintains documentation of meeting the requirements to perform
the care; and, when the nurse is providing care pursuant to
4723.01(B)(5), has a specific, current order from an authorized
provider. In addition, the nursing care cannot involve a function
or procedure that is prohibited by any other law or rule. Similarly,
Rule 4723-4-04(D), OAC, states that a LPN may provide nursing
care that is beyond basic preparation for a LPN if the LPN obtains
education that emanates from a recognized body of knowledge
relative to the nursing care to be provided; demonstrates
knowledge, skills, and abilities necessary to perform the nursing
care; maintains documentation of meeting the requirements to
provide the care; has a specific, current valid order from an
authorized provider or direction from a RN; and the nursing care
does not involve a function or procedure that is prohibited by any
other law or rule.
• RN clinical situation or procedure: A clinical situation for the RN
use of ultrasound technology devices could be frequent assessment
of urinary bladder volume. If RNs have been educated and are
competent in the use of ultrasonography bladder scanners, they
may use the device within their practice. This also applies to a RN
who performs limited obstetrical ultrasound in the course of
executing a nursing regimen. Similarly, if the RN has an order to
insert a peripherally inserted central catheter, the RN may use an
ultrasound device to assist with imaging blood vessels during the
insertion. If the use of the ultrasound device is for purposes of the
RN’s nursing regimen, an authorized provider order is not required,
although nursing employers may require an order based on the
employer’s policies. Also, if a RN’s patient is under the care of, for
example, a physician urologist, and the urologist authorizes a
specific urological care regimen that includes bladder scanning,
the RN would be practicing in accordance with Section 4723.01(B)
(5), ORC, and need an order to document the regimen the RN is to
implement for the physician.
• LPN clinical situation or procedure: Consistent with the LPN
scope of practice the authority of a LPN to use an ultrasound
device is dependent on the direction the LPN receives from the
RN or physician. For example, a clinical situation for the LPN use
of ultrasound technology devices to assist with peripheral IV
insertion would be dependent on the RN or other directing health
care provider’s consideration of the patient condition, skill of the
LPN, and other factors. Similarly, a qualified LPN, under the
direction of a RN or an authorized provider, is not prohibited from
collecting and documenting specific data through the
performance of limited obstetrical ultrasounds that will be used
by a RN for purposes of nursing care or an authorized provider to
determine a medical diagnosis or a medical treatment. In either
case, when the LPN is implementing an order or direction, the
LPN must implement the order or direction consistent with Rule
4723-4-04, OAC. When a RN is directing the LPN’s practice, the
RN is required to first assess the condition of the patient who
needs nursing care, the type of nursing care the patient requires,
the complexity and frequency of the nursing care needed, the
training, skill and ability of the LPN who will be performing the
specific function or procedures to do so, and the availability and
accessibility of resources necessary to safely perform the function
or procedure. Rule 4723-4-03(K), OAC.
In summary, a RN or LPN who completed education on the use of
specific ultrasound devices and has documented their knowledge,
skills and abilities in the use of the ultrasound device may use it, if its
use is consistent with the RN and/or LPN scope of practice, the device
is not being used in a manner or for a purpose that is otherwise
prohibited by any other state or federal law, and if this activity or task
is safe and appropriate to perform with the patient.
In addition, nurses need to be aware that they must demonstrate
competence and accountability in all areas of practice including
consistent performance of all aspects of nursing care; and recognition,
referral or consultation, and intervention when a complication arises.

When were you appointed as a Board member?
I was appointed to the Board of Nursing by
Governor Kasich on March 6, 2018.
Why did you want to become a Board member?
I have always had an interest in/passion for
the three cornerstones of nursing–practice,
education, and regulation. Throughout my
career, I have had working experience in
practice and academics and wanted the
opportunity to be a Board member to learn
more about and participate in the regulatory
side of nursing. I also wanted to continue to
contribute to the nursing profession in a
different way.
What is your nursing background?
My clinical background is Perioperative
Nursing. For over 35 years I have held nursing
management and executive positions in
community hospitals as well as tertiary care
facilities. I also have been an adjunct faculty
member at several colleges of nursing.
What do you believe you can bring to the
Board of Nursing?
My diverse working background helps me to
bring an objective assessment of the issues –
whether they are rule review/revision/
development or determining disciplinary
actions. I have a keen eye for details, which is
necessary during the review of the extensive
Board materials.
What is one of the greatest challenges of
being a Board member?
One of the greatest challenges is structuring
time to prepare for the Board meetings.
There is a massive amount of materials to
read and review.
How would you describe your experience as a
Board member?
It has been very rewarding to get to know and
work with new colleagues. Board staff and
Board members are very earnest and diligent
in executing their roles. Everyone has been
so professional and helpful in mentoring new
members. I am enjoying learning this aspect
of the nursing profession.
What would you say to someone who is
considering becoming a Board member?
If you have the interest in and time to
devote to the work, please submit your
application! It is truly an honor to serve in
this capacity. •

Daniel P. Lehmann, LPN
When were you appointed as a Board
member?
I was appointed to the Board by Governor
Kasich on March 27, 2018.
Why did you want to become a Board member?
I am currently working to complete my RN
degree and became interested in becoming a
Board member while taking a professional
nursing course at Sinclair College in Dayton.
My instructor encouraged all of us to become
members of a professional nursing
organization at some point in our careers. Her
encouragement prompted me to investigate
becoming a Board member and I applied. My
intent in becoming a Board member is to
make a positive impact on public safety in
Ohio with my thoughtful ideas, discussion,
and votes during Board meetings.
What is your nursing background?
I have been fully employed in nursing jobs
ever since completing high school-to this
day. My career began in Dayton in 2000 as a
full time STNA working in a skilled nursing
facility. I provided care to Alzheimer’s
patients and provided basic personal care
like bathing, dressing, and feeding. Those
one-on-one patient care experiences are
what fueled my initial passion for nursing. I
completed my LPN in July 2001 and worked
at the same nursing home for a year as LPN.
I then moved to Long-Term Acute Care
hospital work for several years where I was
blessed to gain a wide variety of clinical
experiences such as complex wound care,
and trach care. I then went back to work at a
skilled nursing facility for years providing
skilled care, long term care, and Alzheimer’s
nursing care, gaining charge nurse
experience care at that point. Currently I
work a full-time transitions case
management job where I help to ensure
quality patient outcomes.
What do you believe you can bring to the
Board of Nursing?
As the only male nurse on the Board, I bring
diversity. I am also an independent thinker
with a history of successful outcomes in a
variety of nursing settings. Therefore I bring
a unique, individual perspective to Board
discussions. I bring empathy and the ability
to see things from other people’s perspective,
but at the same time I am also logical,
responsible and fair. I bring old school and
new school nursing experience to the table,
which is helpful. Most importantly I bring a
full commitment to faithfully protect the
public with my promise to fully study and
consider the issues brought before the Board
and to vote on these matters with my heart,
regardless of any outside influences.
What is one of the greatest challenges of
being a Board member?
For me the greatest challenges to serving on
the Board are time management and
prioritization. I am a full time LPN, a RN
nursing student, a single dad of a 13 year old,
and now a Board member! Making time to
satisfactorily meet all the Board job
requirements while balancing parenting
responsibilities, maintaining my full time
nursing job, achieving success in nursing
school, as well as maintaining my hobbies
such as gardening is my great challenge.
Nursing is a profession built around time
management and prioritization, so I am
ready to take on this great challenge!
How would you describe your experience as a
Board member?
My experience as a Board member has been a
positive and professional one so far. The
Board staff and fellow Board members have
all been very friendly and helpful as I learn
the duties of the position. Some Board
members share cookies and coffee with the
group, and everyone genuinely cares about
each other. There is a lot of studying and
preparing required for the bi-monthly Board
meetings, which requires personal discipline,
but I have found that the prep work gets
easier as my routine becomes established.
What would you say to someone who is
considering becoming a Board member?
To anyone considering becoming a Board
member, I would say visit the Board website
and apply! Being a Board member is a
worthwhile thing to pursue and will elevate
your professional competency and make you
a better nurse and a better person in general.
You will gain perspective of the nursing
regulation process and understand how
things get done in Columbus. Being on the
Board will enable you to refine your level of
personal maturity and you will make a
difference in the safety of the public through
your Board actions. •
