RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO SET THE
SALARY OF THE SULLIVAN COUNTY PERSONNEL OFFICER
WHEREAS, the Sullivan County Legislature adopted Resolution No. 369-19 on September 19,
2019 to amend portions of Chapter A of the Sullivan County Code; and
WHEREAS, pursuant to Resolution No. 369-19, there is an Office of Civil Service
Administration headed by a Personnel Officer and a Division of Human Resources headed by a
Commissioner of Human Resources, separating the previously combined roles; and
WHEREAS, pursuant to Resolution No. 80-14, the Sullivan County Legislature appointed
Lynda Levine as the Sullivan County Personnel Officer for a six year term, expiring on February
20, 2020;
WHEREAS, there is a need to set the salary of the Sullivan County Personnel Officer for the
remainder of the current term.
NOW THEREFORE, BE IT RESOLVED, that Lynda Levine having been appointed to the
position of Sullivan County Personnel Officer for a six (6) year term, expiring on February 20,
2020 with the salary being set at $100,512.

RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO APPOINT
SIMS FOSTER AS A MEMBER OF THE SULLIVAN COUNTY LAND BANK
CORPORATION BOARD
WHEREAS, pursuant to Resolution No. 286-16, the Sullivan County Legislature authorized the
formation of the Sullivan County Land Bank Corporation (SCLBC) and appointed nine (9)
directors to serve a term of two (2) years from the date of incorporation unless appointed by
virtue of a director’s elected public office in which case it shall run concurrently with the term of
office, whichever is less; and
WHEREAS, the County of Sullivan posted a vacancy announcement for additional Board
members; and
WHEREAS, the SCLBC increased the number of directors to eleven (11) at their February 2019
meeting adding two additional community members; and
WHEREAS, a vacancy still existed and a letter of interest was received from Sims Foster,
community member; and
WHEREAS, the Sullivan County Land Bank Corporation Board recommended the appointment
of Sims Foster at its September 2019 Board meeting.
NOW, THEREFORE, BE IT RESOLVED, that Sims Foster, community member, is
appointed to the SCLBC Board, for a 2-year term that will expire on February 7, 2021 and in
accordance with relevant laws or by-laws.

NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT PURSUANT TO
SEQRA, AND TO AUTHORIZE THE PURCHASE OF PROPERTY IN THE TOWN OF
THOMPSON FOR PURPOSES OF CONSTRUCTION AND OPERATION OF A
VISITORS CENTER
WHEREAS, the Sullivan County Legislature (“Legislature”) has determined there is a
need to have a Visitors Center located in Sullivan County; and
WHEREAS, the County has identified and reviewed appraisals for a property located on
Rock Hill Drive, Rock Hill, Town of Thompson, designated as Tax Map Section 32 Block 1 Lots
36 and 37 (the “Property”); and
WHEREAS, the total land size of the Property is approximately 21 acres; and
WHEREAS, the location of the Property is especially beneficial for tourism purposes
due to the fact that it is in close proximity to State Route 17; and
WHEREAS, purchasing the Property enables the County to build and operate a Visitors
Center to welcome travelers to the region; and
WHEREAS, pursuant to the State Environmental Quality Review Act, and 6 NYCRR
617, the County declared itself Lead Agency, the purchase of the Property and its intended use
was deemed an “Unlisted” action, and the County undertook the environmental review required;
and
WHEREAS, a short form Environmental Assessment has been prepared which
concludes that the purchase of the Property and construction of a Visitors Center will not result
in a significant adverse impact on the environment.
NOW THEREFORE BE IT RESOLVED, the assessment of potential adverse
environmental impacts from the purchase of the Property and construction of a Visitors Center
has been determined not to be significant as detailed within the County’s Environmental
Assessment Form;
BE IT FURTHER RESOLVED, that the County Legislature issue a Negative
Declaration and authorizes the County Manager to sign the necessary environmental assessment
forms.

authorize agreements with consultants and engineers to undertake due diligence and ensure that
all legal requirements are met with respect to the project; to authorize a modification of the
current agreement with the Sullivan County Visitors Association to occupy and operate the
proposed Visitors Center; to mandate repayment of costs associated with the project as part of
the current agreement with the Visitors Association and with any future agreement entered into
with a County designated tourism agency pursuant to RPTL § 1202-j, until such time as all
project expenses are satisfied and paid in full.

SATISFIED AND PAID IN FULL
WHEREAS, with the advent of a new economic era, the Legislature, on behalf of
Sullivan County (the “County”) wishes to build a Visitors Center to welcome travelers from
around the world and familiarize them with the beauty and benefits of life and tourism in
Sullivan County; and
WHEREAS, the Sullivan County Visitors Association (Visitors Association) is the
County’s designated tourism agency; and
WHEREAS, the Visitors Association wishes to occupy and operate a Visitors Center on
behalf of the County; and
WHEREAS, a location has been identified on Rock Hill Drive, Rock Hill, New York in
proximity to State Route 17, Exit 109 (Tax Map Section 32 Block 1 Lots 36 and 37 (the
“Property”); and
WHEREAS, the Visitors Association agreed to undertake the preliminary due diligence
analysis required to determine the viability of building a Visitors Center and to purchase the
Property from private land owners; and
WHEREAS, the Visitors Association has entered into a contract for the Property and,
along with the County, has determined its suitability for a Visitors Center, and the County wishes
to purchase the Property and fund the siting, construction and all associated ancillary expenses in
connection with the construction of the Visitors Center (“Project”);
WHEREAS, the Project shall be paid and repaid for through use of a portion of the room
tax funds authorized by RPTL § 1202-j; and

WHEREAS, the Visitors Association seeks space within the Visitors Center to best
enable its staff to serve the needs of the County, tourism vendors and the traveling public and has
represented that it is authorized and committed to negotiating a lease with the County; and
WHEREAS, the Visitors Association acknowledges and agrees that reimbursement of
the County’s cost of the Project shall be through use of the State-authorized room tax funds and
that payment to the County (by separate agreement setting forth specific terms of repayment)
shall be made prior to undertaking other authorized tourism-related actions; and
WHEREAS, in the event the Visitors Association transfers the Property to the County,
on terms acceptable to the County in its sole and exclusive discretion, the County agrees to
purchase the Property from the Visitors Association, at a cost not to exceed $425,000.00, plus
associated costs, subject to all legal requirements and agreed upon due diligence, and subject to
the County’s ability to bond the cost of the Project.
NOW THEREFORE BE IT RESOLVED, the Sullivan County Legislature authorizes
the County Manager to negotiate an agreement for the acquisition of the Property for
$425,000.00, plus legally required costs and fees, subject to legal requirements, to enter into
agreements for necessary professional services including, but not limited to, title searches,
environmental tests, bonding, engineering and otherwise; and
BE IT FURTHER RESOLVED, the total Project cost shall not exceed four million five
hundred thousand ($4,500,000.00) dollars; and
BE IT FURTHER RESOLVED, the Chairman of the Legislature and/or the County
Manager are authorized to execute the real property transfer and related documents required to
own the Property; and
BE IT FURTHER RESOLVED, that all documents and agreements shall be approved
by the County Attorney in conjunction with Special Counsel; and
BE IT FURTHER RESOLVED, that the general authorizations set forth herein are
subject to the adoption of future resolutions legally required to construct a Visitors Center and to
bond the cost of the Project; and
BE IT FURTHER RESOLVED, that the County Legislature has relied upon the
representations of the Visitors Association with regard to the purchase and transfer of the
Property as well as the pro rata repayment of the bond amount, not to exceed $4,500,000, and
that the current agreement with the Visitors Association is deemed to be modified to reflect the
representations made herein and the commitment of the Visitors Association to terms of
repayment; and
BE IT FURTHER RESOLVED, that the Legislature affirms its commitment to the
Visitors Center Project at a total cost not to exceed $4,500,000.00, under terms favorable to the

County, and further affirms its intention to formally modify the current agreement with the
Visitors Association to reflect the outline of the Project and to enter into a triple net lease
agreement with the Visitors Association to occupy and operate the Visitors Center in furtherance
of the mission of the Visitors Association and the County’s commitment to tourism, and
BE IT FURTHER RESOLVED, any and all future agreement with a Sullivan County
designated tourism agency as required by RPTL § 1202-j shall contain a provision that mandates
repayment of the pro rata share of the bond until such time as the bond is satisfied; and
BE IT FURTHER RESOLVED, that the Project is a viable and useful County purpose;
and
BE IT FURTHER RESOLVED, that the County Manager is hereby authorized to create a
Capital Account for funding of the Project and to advance $425,000.00 from the General Fund to
the Capital Project Fund for purposes of purchase of the Property.

URGING NEW YORK STATE TO CLASSIFY EMERGENCY MEDICAL SERVICES
AS ESSENTIAL SERVICES FOR THE PURPOSES OF STATE AID
WHEREAS, throughout New York State, volunteer emergency medical services play a vital role
in keeping our communities safe, and
WHEREAS, in addition to working hard to safeguard the public, volunteers also work hard to
generate the funds necessary to purchase up-to-date equipment, maintain buildings and vehicles,
as well as to address other issues relating to the efficiency of operations, and
WHEREAS, by classifying emergency medical services as “essential services”, organizations
will be able to tap into an increased number of funding sources, and in turn, will be able to keep
our communities safer.
NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature supports the
classification of emergency medical services as “essential services” for the purposes of state
funding eligibility; and
BE IT FURTHER RESOLVED, that the Sullivan County Legislature supports the legislative
intent in S.1381 and A.1582, and
BE IT FURTHER RESOLVED, that copies of this resolution be sent to the counties of New
York State encouraging member counties to enact similar resolutions.
BE IT FURTHER RESOLVED, that the Clerk to the Sullivan County Legislature is hereby
directed to forward copies of this resolution to Governor Andrew M. Cuomo, Sullivan County’s
New York State Legislature representatives and all others deemed necessary and proper.
