Washington Jan 7 In the UnitedStates supreme court today opinionswere handed down by Justice Harian-in several cases Involving the questionwhether it was competent for the secre-tary of the interior upon receiving andapproving the map of definite locationof the Northern Pacific road in thestates of North Dakota and Washing-ton to make an orderS withdrawingfrom settlement odd numbered sectionsof the lands within the indemnitylimits

The test case in the list came fromJforth Dakota the title being FredHewitt plaintiff in error versus Emilalhd Fredericks Schultx The land Inquestion was settled upon by Hewitt in188 but hie proof of settlement wasrejected on th ground that the landhad been wittHfruwn In 1878 by the sec-retary of the Interior as within thelimits of the Northern Pacific indem-nity The raliroa4company then sold

land to Schultz and his wife anlthey entered upon possession of itHewitt immediately began proceedingsto recover the hind and todays de-cision which is final was in his favorreversing the supreme court of NorthDakota

The derision of the court supportedthe holding of Secretary Vllag ren-dered In IMS which decision has sincebeen followed by the Interior depart-ment The court stated that while Itwas true that previous to that date thedepartment had pursued the oppositecourse still the department had con-sistently held forth to Its findings sincethat time At best therefore JusticeHarian said the contention of the railroad people of doubt Manytitles have been acquired said he sinceMr Vitas opinion was rendered andthe court did not think the secretaryshould be reversed The opinion saM

The practice of the tend departmentIf wrong at all cannot be said to be soplainly wrong as to justify the courtalter the lapse of so many years in adjudging that it had misconstrued theact of July 2 1M4 The order of withdrawal by the secretary upon which

title of the railroad company depenile being out of the way there wasno ground to question the title of plaintiffs to the land In dispute

Justices Brewer and Shires unitedin a dissenting opinion The decisionaffects a large number of land entries
