RESUME OF BUSINESS TRANSACTED DURING THE FIFTHSESSION OF TWELFTH KERALA LEGISLATIVE ASSEMBLY
The summons dated 2nd June 2007 for the Fifth Session of Twelfth KeralaLegislative Assembly was issued to Members on 4th June 2007. The Sessioncommenced at 8.30 a. m. on Tuesday, 19th June, 2007 and adjourned sine-die at4.15 p. m. on Thursday, 26th July 2007. The House met on the following daysviz. June 19, 20, 21, 22, 27, 28, 29 July 4, 5, 6, 9, 10, 11, 12, 13, 16, 17, 18, 19, 23,24, 25 and 26 (23 days of sittings). The House transacted business for 142 hoursand 46 minutes.

Questions:

On 26th July 2007 the Minister for Finance laid on the Table the statementcorrecting the answer to the unstarred questions No. 1011 dated 27th June 2007.
Adjournment Motion:
During the Session 12 notices of Adjournment Motion were received. TheSpeaker withheld consent to the 11 notices after hearing the views of Ministersconcerned. Details of Adjournment Motions in respect of which consent waswithheld on the floor of the House are given in Appendix II.
On 18th July 2007, The Speaker informed the House that an adjournmentmotion given notice of by Shri K. Sudhakaran and four others regarding thedevastation caused by monsoon in the State.has been received.
As the Chief Minister expressed the readiness of the Government todiscuss the matter, the House decided to take up the notice for discussion aftercompleting other business listed for the day.
Shri K.Sudhakaran moved the motion and spoke. 20 members belongingto both opposition and treasury benches took part in the discussion. TheMinister for Food and Civil supplies and Animal Husbandry replied to the pointsraised in the discussion. At the end of the discussion the House adopted thefollowing resolution unanimously, moved by the Chief Minister.1098/2007.

Statements under Rule 300 :
(1) On 22nd June, 2007 Shri Paloli Mohammed Kutty, Minister for LocalSelf Government and Rural Development made a statement under rule 300 aboutthe Property Tax revision in the State.
(2) On 28th June, 2007 Shri V. S. Achuthanandan, Chief Minister made astatement under rule 300 on the devastation caused by monsoon in the State.
(3) On 10th July, 2007 Shri M. Vijayakumar, Minister for Law,Parliamentary Affairs, Sports and Youth Affairs and Ports made a statement underrule 300 on the Policy on Intellectual Property Rights.
(4) On 16th July 2007 Shri Elamaram Kareem, Minister for Industries madea statement under rule 300 on the States’s Industrial Commercial Policy.

(5) On 17th July, 2007 Shri K. P. Rajendran, Minister for Revenue made astatement under rule 300 about the devastation caused by the Monsoon in theState and the relief measures taken by the Government.
(6) On 24th July 2007 Shri Kodiyeri Balakrishnan, Minister for Homeand Tourism made a statement under rule 300 about the Hawala transactionsand related crimes in the State.
Obituary Reference :
On 9th July, 2007 the Speaker made a reference on the demise ofS.Chandrasekhar, former Prime Minister of India. Chief Minister and Membersrepresenting various parties associated themselves with the sentiments expressedby the Chair. As a mark of respect to the deceased, the members stood insilence for a while. The House adjourned on that day without transacting anyother business.
On 25th July 2007 the Speaker made reference regarding the demise ofKotakuzhi Sukumaran, C. S. Gangadharan, K. Sivadasan, and A. A. Kochunni,Former Members of Kerala Legislative Assembly, and N. G. Chacko formerMember of Travancore-Cochin Legislative Assembly, as a mark of respect to thememory of the deceased the members stood in silence for a while.

V. Financial Business (1) Budget for 2007-2008
The discussion and voting on Demands for Grants in the Budget for theFinancial Year 2007-08 commenced on July 25, 2007. Twelve days were allottedfor discussion on Demands for Grants.
Out of 1080 cut motions received, 605 were moved and disposed off. Therewere 209 occasions for speech including reply by the Ministers in connectionwith the discussion and voting on Demands for Grants.
The Assembly devoted 44 hours and 48 minutes for transacting financialbusiness relating to the Budget for 2007-08. The details are given in Appendix IX
The Appropriation (No. 2) Bill, 2007, in respect of the Budget for the year2007-08 was introduced by the Minister for Finance on 23-7-2007. The Bill wastaken up for consideration and passed on the same day.
(2) Supplementary Demands for Grants for the year 2007- 08
On July 25, 2007, the Minister for Finance laid the Supplementary Demandsfor Grants for the year 2007-08
Discussion and voting on the Supplementary Demands for Grants tookplace on July 25, 2007 and the House devoted 4 hours and 25 minutes for thetransaction of the Business.

Resume of Business Transacted during the Fifth Session of the TwelfthKerala Legislative Assembly
According to the calendar of sittings of the Fifth Session of the TwelfthKerala Legislative Assembly, five days were slated for Private Members’Business viz., June 22 and 29, 2007, July 6, 13 and 20, 2007.
On July 6 and 13, 2007, the House was adjourned before time and on July20, 2007 there was no sitting as decided by the House. Hence Business on

Private Members’ Bills could be transacted only on June 22, 2007 and businesson Private Members’ Resolutions could be transacted only on June 29, 2007.During the Session the House devoted One Hour Forty seven Minutes in totofor Private Members’ Business.
Private Members’ Bills
On June 22, 2007 motions for leave to introduce 16 Bills and discussion on3 pending Bills were listed in the business. But only Motion on leave tointroduce 10 Bills have come up before the House. The Ministers concernedopposed motions on these Bills. The Kerala Hotel Workers’ Welfare Fund Bill,2006 given notice of by Shri M. Murali was withdrawn by leave of the House.The discussion were inconclusive. For want of time motion for leave on theremaining six Bills could not be introduced and the discussion on the threepending Bills also could not be taken up. Details regarding the name of memberswho moved the motions for leave to introduce Bills and the results thereof aregiven in Appendix X)
Private Members’ Resolutions
Two days (ie., June 29 and July 13, 2007) were set apart for PrivateMembers’ Resolutions. As decided by the House, there was no sitting on July13, 2007 and hence the business slated for July 13 could not be transacted.
On June 29, 2007 the day set down for Private Members’ resolutions fourresolutions came up before the House. The discussion on the resolution givennotice of by Shri V. S. Sunilkumar, which was moved earlier on March 23, 2007was concluded. After the reply, by the Minister for Law, Parliamentary Affairs,Sports, Youth Affairs and Ports the resolution as amended was unanimouslyadopted by the House.
Thereafter the first resolution given notice of by Shri Babu M. Palisseryfor 29-6-2007 was moved in the House. After the reply by the Minister for Law,Parliamentary Affairs, Sports, Youth Affairs and Ports, Shri Babu M. Palisserywithdrew the resolution by leave of the House.
The Second resolution given notice of by Shri A. M. Yousuf was notmoved due to the absence of the Member.
The Third resolution given notice of by Smt. E. S. Bijimol was moved inthe House and the discussion thereon was inconclusive.

THE KERALA MONSOON FISHERY (PELAGIC) PROTECTION BILL, 2007
The traditional fishermen in Kerala earn their income for subsistence byfishing especially during monsoon season in which chakara appears. Thegeneral fishing ban being imposed by the Government during monsoon, putthem into much hardship and Government have decided to permit the traditionalfishermen for pelagic fishery without harming the juvenile fish and fish eggfound in the sea bed, which are necessary for the rejuvenation of sea wealth.
The Bill seeks to achieve the above object.

THE KERALA APPROPRIATION (NO. 2) BILL, 2007
The Bill is introduced in pursuance of Clause (1) of Article 204 of theConstitution of India, to provide for the approapriation out of the Consolidatedfund of the State of Kerala of the moneys required to meet the expenditurecharged on the Consolidated Fund of the State and the grants made by theLegislative Assembly in respect of the estimated expenditure of the Governmentof Kerala for the Financial Year 2007-2008.
THE KERALA FINANCE BILL, 2007
The Bill seeks to amend the following enactment to give effect to thefinancial proposals of Government of Kerala for the financial year 2007-08 asannounced in paras 143 to 145, 148 to 154, 157, 158, 160, 161, 163 to 177, 179,182 to 185, 187 to 197 and 199 to 203 in the Budget Speech, namely :—
1. The Kerala Stamp Act, 1959 (17 of 1959)
2. The Kerala General Sales Tax Act, 1963 (15 of 1963)
3. The Kerala Chitties Act, 1975 (23 of 1975)
4. The Kerala Motor Vehicles Taxation Act, 1976 (19 of 1976)
5. The Kerala Tax on Luxuries Act, 1976 (32 of 1976)
6. The Kerala Value Added Tax Act, 2003 (30 of 2004)
THE KERALA FINANCE (NO. 2) BILL, 2007
The Bill seeks to amend the Kerala Tax on Paper Lotteries Act, 2005 togive effect to the financial proposals of Government of Kerala for the financialyear 2007-08 as announced in para 199 in the Budget Speech.

An extent of 126.01.500 acres of surplus land located in Re-survey number2,86/1&2 of Raroth Village in Kozhikode Taluk in Kozhikode District was takenover by the Government from M/s. Malabar Produce and Rubber Company asper the provisions of the Kerala Land Reforms Act, 1963 and an extent of 98.50acres, out of the said land was proposed to be transferred by the Government tothe Central Reserve Police Force as per G. O. (MS)No. 408/95/RD dated 9thAugust 1995 for the purpose of setting up of a training complex. Subsequentlythe above proposal was cancelled by the Government as per G. O. (MS) No.224/97/RD dated 31st March, 1997, considering the fact that a good number ofpersons in occupation of the said land are landless poor labourers, eligible forassignment of excess land under section 96, of the Kerala Land Reforms Act,1963 and also considering the grave law and order problem that may arise ifmass eviction is carried out.
2. The High Court of Kerala in O.P. No. 1703/96 has directed that if theGovernment does not want the land for the public purpose, it shall be assignedto the landless persons in terms of the Kerala Land Reforms Act, 1963 or theKerala Land Assignment Act, 1960, without giving any weightage to theencroachers, for their occupation during the period of their encroachment.
3. A number of applications filed by persons, including those now inoccupation of the said land, for assignment, pursuant to the notification issuedby the District Collector, Kozhikode, are under active consideration of theGovernment.
4. The High Court of Kerala in its judgment in O.P. No. 13326 of 1996directed the Government to evict the persons who are in occupation of the saidland and to allot the same for the public purpose intended and in C.C.C No. 1189of 2000 in the above said O.P. allowed time till 31st July, 2006 to comply withthe directions.
5. Some more time was required by the Government to examine the matterand to consider and take decisions on the applications filed by persons,including the present occupants and difficulties would arise if proceedings foreviction of the occupants were taken, without examining the applications.The Government, therefore, considered it necessary, in the public interest, tostay the proceedings for eviction of the present occupants for a temporaryperiod. As the Legislative Assembly was not in session and the evictionproceedings had to be stayed immediately, the Kerala Temporary Stay ofEviction Proceedings Ordinance, 2006 (41 of 2006) was promulgated by theGovernor on the 26th day of July, 2006 and was published in the Kerala GazetteExtraordinary No.1232 dated the 26th July, 2006.

6. A Bill to replace Ordinance No. 41 of 2006 could not be introduced in,and passed by, the Twelfth Legislative Assembly of the State of Kerala during itssession which commenced on the 18th day of September, 2006 and ended onthe 26th day of October, 2006. So, the Kerala Temporary Stay of EvictionProceedings Ordinance, 2006 (52 of 2006) was promulgated by the Governor onthe 30th day of October, 2006 and was published in the Kerala GazetteExtraordinary No. 1716 dated the 30th October, 2006.
7. A Bill to replace Ordinance No. 52 of 2006 could not be introduced in,and passed by, the Twelfth Legislative Assembly of the State of Kerala duringits session which commenced on 27th day of December, 2006 and ended on the29th day of December, 2006. So the Kerala Temporary Stay of EvictionProceedings Ordinance, 2007 (14 of 2007) was promulgated by the Governor onthe 4th day of February, 2007 and was published in the Kerala GazetteExtraordinary No. 208 dated the 5th February, 2007.
8. A Bill to replace Ordinance No. 14 of 2007 could not be introduced in,and passed by, the Twelfth Legislative Assembly of the State of Kerala during itssession which commenced on the 2nd day of March, 2007 and ended on the29th day of March, 2007. So the Kerala Temporary Stay of Eviction ProceedingsOrdinance, 2007 (40 of 2007) was promulgated by the Governor on the 30th dayof March, 2007 and was published in the Kerala Gazette Extraordinary No. 645dated the 2nd April, 2007.
9. The Bill seeks to replace the said Ordinance by an Act of the StateLegislature.

THE KERALA PROMOTION OF TREE GROWTH IN NON-FOREST AREAS(AMENDMENT) BILL, 2007
In consonance with the National Forest Policy, 1988, the Kerala Promotionof Tree Growth in Non-Forest Areas Act, 2005 was enacted to promote thecultivation of trees in non-forest areas of the State to increase the green cover,preserve biodiversity and arrest soil erosion and also to increase availability oftimber and bamboo for the industry. The Act has provisions liberalizing thefelling and transport regulation with regard to trees on private lands. However,indiscriminate felling of trees in certain ecologically sensitive areas of the Statehad taken place under the cover of the liberalized provisions of the Act. Thereare many ecologically sensitive areas in the State under private ownershipwherein over exploitation and unsound management practices therein would leadto irreversible, degradation of the ecology of the area. As a precautionarymeasure, Government consider it necessary to regulate tree felling in certainareas for protecting the ecology of the area or in public interest. The Governmentintend to limit the restriction on felling of trees by small holders to twelvespecified tress only in the notified area. To encourage tree planting outside thenotified area, the restriction on felling of trees in the private areas is limited tosandal only and the owners are free to cut all other species without permission.Restriction on transport of timber of certain species is also felt necessary toprotect the forest wealth of the State. In order to achieve the above objectives,the Government have decided to make necessary amendments to the KeralaPromotion of Tree Growth in Non-Forest Areas Act, 2005.
2. As the Legislative Assembly was not in session and as the aforesaidproposals had to be given effect to immediately, the Kerala Promotion of TreeGrowth in Non-Forest Areas (Amendment) Ordinance, 2006 (43 of 2006) waspromulgated by the Governor of Kerala on 5th day of August, 2006 and waspublished as Ordinance No. 43 of 2006 in the Kerala Gazette ExtraordinaryNo.1291 dated the 7th day of August, 2006.
3. As a Bill to replace, Ordinance No.43 of 2006 by an Act of the StateLegislature could not be introduced in and passed by, the Legislative Assemblyduring its session which commenced on the 18th day of September 2006 andended on the 26th day of October 2006, the Kerala Promotion of Tree Growth inNon-Forest Areas (Amendment) Ordinance, 2006 (54 of 2006) was promulgated bythe Governor of Kerala on the 30th day of October, 2006 and. was published inthe Kerala Gazette Extraordinary No. 1718 dated the 30th day of October, 2006.
4. As a Bill to replace Ordinance No. 54 of 2006 by an Act of the StateLegislature could not be introduced in, and passed by, the Legislative Assemblyduring its session which commenced on the 27th day of December, 2006 and

ended on the 29th day of December, 2006, the Kerala Promotion of Tree Growthin Non-Forest Areas (Amendment) Ordinance, 2007 (22 of 2007) was promulgatedby the Governor of Kerala on the 4th day of February 2007 and was publishedin the Kerala Gazette Extraordinary No. 222 dated the 5th day of February, 2007.
5. As a Bill to replace Ordinance No. 22 of 2007 by an Act of the StateLegislature could not be, introduced in and passed by the Legislative Assemblyduring its session which commenced on the 2nd day of March, 2007 and endedon the 29th day of March, 2007 the Kerala Promotion of Tree Growth in Non-Forest Areas (Amendment) Ordinance, 2007 (31 of 2007) was promulgated by theGovernor of Kerala on the 30th day of March, 2007 and was published in theKerala Gazette Extraordinary No. 636 dated the 2nd day of April, 2007.
6. The Bill seeks to replace the said Ordinance by an Act of the StateLegislature.
THE KERALA APPROPRIATION (NO. 3) BILL, 2007
The Bill is introduced in pursuance of Clause (1) of Article 204 of theConstitution of India, read with article 205 thereof, to authorise payment andappropriation of certain further sums from and out of the Consolidated Fund ofthe State of Kerala required to meet the supplementary expenditure charged onthe Consolidated Fund of the State of Kerala and the grants made by theLegislative Assembly for the expenditure of the Government of Kerala for thefinancial year 2007-2008.
