On this the 12th day of October, 2009, A.D., at 9:00 a.m. the Commissioners’ Court of
Jackson County, Texas convened in a Regular Term, Special Session, thereof, at the Courthouse of
Edna, Texas, with the following members of the Court present, to-wit:

Minutes Approved
The Minutes of September 28, 2009 were presented.
A motion was made by Comm. Belicek, seconded by Comm. Bubela to approve.

Budget Amendments
There were none.
Consider Jackson County Historical Commission Approval to Donate Funds to the Ganado
Economic Development Committee to Purchase a Replica Neon and Metal Sign for $11,500
and Take any Necessary Action
Discussion was had concerning approval to donate the sign.
A motion was made by Comm. Bubela, seconded by Comm. Belicek to approve the donation
of the sign to the City of Ganado noting the sign should have appropriate designation printed on the
actual sign.
Motion carried.
Consider Texas Online Customer Agreement with Texas NICUSA, LLC (vendor) for
Electronic Court Filing and Take any Necessary Action
A motion was made by Comm. Deyton, seconded by Comm. Belicek to renew the contract.
Motion carried.

Consider Brush Spraying Contract at Transfer Station, and Take any Necessary Action
Comm. Bubela addressed the Court concerning a 75 acre area at the Transfer Station. He
noted that two bids were received, one for $29.86/acre from JB Commercial Spraying Service and
one for $35.90/acre from Danevang Spraying Service.
After discussion, a motion was made by Comm. Bubela, seconded by Comm. Deyton to
approve the bid from JB Commercial Spraying Service for $29.86 per acre.
Motion carried with Comm. Belicek opposed.
Consider Resolution to Apply for 2010 Indigent Defense Formula Grant and Take any
Necessary Action
A motion was made by Comm. Deyton, seconded by Comm. Bubela to approve the
resolution.
Motion carried.

Consider Contract with Texas AgriLife Extension Service for the Cost Share Purchase of Two
Computers for Extension and Take any Necessary Action
Michelle Darilek, Auditor, spoke to the Court concerning the cost share purchase of two
computers for the extension office with our cost being $725 each for a total of $1,450.00
A motion was made by Comm. Bubela, seconded by Comm. Hunt to enter into the contract
and authorize J.J. Janssen to sign the contract.

Approve and Accept the 2009 Jackson County Levy Roll
Donna Atzenhoffer, Tax Assessor, presented the 2009 Jackson County Levy Roll.
A motion was made by Comm. Deyton, seconded by Comm. Hunt to accept and approve the
Levy Roll.
Motion carried.

Consider Request for Payroll Deductions for Private Insurance Coverage’s, and Take any
Necessary Action
Liberty National and National Farm Life both requested permission to offer insurance to
employees through payroll deduction.
A motion was made by Comm. Deyton, seconded by Comm. Belicek to adopt a policy each
Company must have 20 employees enrolled to start payroll deduction and must have 10 to stay on
payroll deduction.

Consider Acceptance of 9-1-1 Equipment from Golden Crescent Regional Planning
Commission and Take any Necessary Action
A motion was made by Comm. Hunt, seconded by Comm. Deyton to accept the interlocal
agreement and authorize the Sheriff to sign.
Motion carried.

Payment Of County And Precinct Bills And Court Orders, If Any
A motion was made by Comm. Bubela, seconded by Comm. Hunt to approve the bills along
with one Court Order to Jackson County County Wide Drainage District for $2,789.82 for
September 2009.

A motion was made by Comm. Deyton, seconded by Comm. Hunt to approve the payroll

The extension report and library report were received.
Judge Stafford noted there is a 3% increase in the disposal fee at the Victoria Landfill.
Michelle Darilek noted Auditors will be here on October 27th to audit the Homeland Security
funds.
Workshop on Web Site
After discussion, it was decided that each elected official and/or department head should
meet and discuss what should and should not be on the web site and should make their own changes
if they so desire. Otherwise, they should contact the Auditor’s office for changes and updates.

Consider and Approve Resolution Authorizing Signatures under the County’s 2009 Texas Community Development Block Grant Program Contract #R-729300, and Take any Necessary Appropriate Action Rhonda Stasny presented a Resolution naming the County Judge, County Auditor and the County Treasurer as the Signators for completing State of Texas Purchase Vouchers and Request for Advance/Reimbursement on contract #R-729300. Consider Purchase of Vehicle for Pct. #2 Constable, and Take any Necessary Action Cyndi Poulton, Constable Pct. #2, spoke to the Court concerning a change in the purchase price of her vehicle. The HGAC contract price is $7,364.21 more than originally requested. After discussion, a motion was made by Judge Stafford, seconded by Comm. Bubela to approve the additional amount of $7,364.21 to be paid from Unallocated General Fund. Motion carried. Consider Re-Appointment of Donna Atzenhoffer as an Appraisal District Director for a Term Expiring December 31, 2011, and Take any Necessary Action A motion was made by Comm. Belicek, seconded by Comm. Bubela to re-appoint Donna Atzenhoffer as an Appraisal District Director. Motion carried. Receive Report from Sheriff on Jail Operations Andy Louderback, Sheriff, reported on Jail operations. Consider Approval of the Following Contracts Previously Approved by the Jackson County Juvenile Board: a. Texas Juvenile Probation Commission State Financial Assistance Contract 2010 – 2011 Biennium; b. Texas Juvenile Probation Commission State Financial Assistance Contract 2010 – 2011 Biennium – Amendment Number One; c. Hays County Juvenile Board Contract and Agreement for Secure Long-Term and Short-Term Residential Service of Juvenile Offenders; d. Victoria County Juvenile Justice Center Contract and Agreement A motion was made by Comm. Bubela, seconded by Comm. Hunt to approve contracts. Motion carried. Clerk’s note: A copy of the contracts on file among the exhibits of Comm. Court. Consider Approval of Jackson County Juvenile Probation Contracts: a. Lighthouse 2911 Contract; b. Lighthouse 2911 Contract Amendment #1; c. Pegasus Schools, Inc. Judge Stafford noted these contracts have not been approved by the Juvenile Board yet. Consider Order for Routine and Reoccurring Claims and Take any Necessary Action A motion was made by Comm. Bubela, seconded by Comm. Consider Data Reporting Improvement Plan Pursuant to Article 60.10, Texas Code of Criminal Procedure, and Take any Necessary Action A motion was made by Comm. Belicek, seconded by Comm. Consider Releasing Bond From Sanchez Oil & Gas Corporation, and Take any Necessary Action A motion was made by Comm. Deyton, seconded by Comm. Belicek to release the bond from Sanchez Oil & Gas Corporation. Motion carried. Consider Increasing Limits on Flex Plan Cafeteria Deductions for Employees, and Take any Necessary Action The current limit for employees is $3,000. After discussion, a motion was made by Judge Stafford, seconded by Comm. Hunt to raise the limit to $3,600 per year. Motion carried. Consider Price Adjustment Approvals on Servers in District Clerk office and Library, and Take any Necessary Action Discussion was had concerning price increase on the servers in the District Clerk’s office and the Library. The increases are as follows: District Clerk - $67.75 increase; Library - $91.52 increase.
A motion was made by Comm. Belicek, seconded by Comm. Bubela to approve the increases, which will still be paid out of respective capital outlay budgets. Motion carried. Consider County Choice Silver Aetna Medicare Advantage Plan Renewal Confirmation for the 2010 Plan Year, and Take any Necessary Action Judge Stafford noted this plan allows retired County employees to stay on insurance until eligible for Medicare. A motion was made by Comm. Deyton, seconded by Comm. Bubela to approve the plan. Motion carried. Consider Notification of Intent and Resolution to Accept the Energy Efficiency and Conservation Block Grant (EECBG) and Take any Necessary Action A motion was made by Comm. Belicek, seconded by Comm. Hunt to approve the Resolution. Motion carried. Resolution as follows:
Consider Preliminary Energy Assessment Agreement and Take any Necessary Action A motion was made by Comm. Bubela, seconded by Comm. Deyton to approve the agreement and name Comm. Belicek as the contact. Motion carried.

Consider Payment of County and Precinct Bills, and Court Orders There were 2 Court Orders. One for John D. Mercer for $7,786.25 and one for Wayne Myers for $7,322.40 for shelving in the County Clerk’s office that had been previously approved by Court to be paid from County Clerk Records Management and now will be paid from County Records Management. A motion was made by Comm. Hunt, seconded by Judge Stafford to pay the County and Precinct bills and the two Court Orders. Motion carried.
