MINUTES FOR P.O.S.T. COMMISSION MEETING
May 19, 2017
The Tennessee Peace Officer Standards and Training Commission
met on Friday, May 19, at 9:30 a.m., at the Tennessee Law
Enforcement Training Academy, 3025 Lebanon Road, Nashville,
Tennessee.
Chair Carl Jenkins called the meeting to order.
Mr. Farris conducted a roll call, which reflected the presence
or absence of the following commissioners: Baker – present;
Chrisman – present; Hannon – present; Hulsey – absent;
Jenkins – present; Lewis – absent; Long – present;
Wallace – absent; Williamson – present; Wilson – present;
Sen. Bell – present; General Cherry – present;
Forrester - present.
Chair Jenkins recognized Vice-Chair Mike Hannon, who read the
following disclaimer: All P.O.S.T. Commissioners have
previously agreed to recuse themselves from any vote that would
constitute a conflict of interest. The most obvious of these
would include issues that involve our own departments or someone
we know personally. Because we have already agreed to this, it
should be noted that on routine matters, it will be assumed
nonverbally that these commissioners have abstained from that
vote. In bigger more controversial issues that may have a more
overt conflict of interest or may have an appearance of
impropriety applicable commissioners will still verbally abstain
from those votes.
Chair Jenkins also reminds the Commission that if anybody has
spoken to them about any of the matters on the agenda that they
are to abstain from it.
Chair Jenkins asked for a motion for approval of the May agenda.
Commissioner Chrisman moved for approval, seconded by
Commissioner Williamson. The motion carried.
Chair Jenkins asked for a motion for approval of the April 21st
P.O.S.T. Commission Meeting minutes. Commissioner Chrisman
moved for approval, seconded by Commissioner Williamson. The
motion carried.
Mr. Grisham read the recommendations given by the Informal
Disciplinary Subcommittee yesterday after hearing several
matters.

First case being Charles Logan Abernathy, formerly of the Cross
Plains Police Department. It was recommended to issue a default
order of decertification on the grounds of him being terminated
for disciplinary reasons.
In the matter of Ryan W. Dugger, formerly of the Franklin Police
Department, it was recommended to issue a default order of
decertification on the grounds he resigned in lieu of
termination for severe disciplinary reasons.
In the matter of Vance Stacks, formerly of the Memphis Police
Department, it was recommended to uphold the default order of
decertification on the grounds he was terminated for
disciplinary reasons. He requested an appeal hearing, but did
not appear.
Finally, in the matter of Adam D. Miracle, formerly of the
Tennessee Highway Patrol, it was continued to provide adequate
notice to the Respondent.
Commissioner Williamson moved for approval, seconded by
Commissioner Cherry. The motion carried.
APPEARING BEFORE THE COMMISSION/WAIVERS FOR PRE-EMPLOYMENT
REQUIRMENTS – 1110-02.03 + 1110-9-.04
Gallaway Police Department – Request a waiver for David Thomas
Nabors. Mr. Nabors in 2002 was convicted of a
misdemeanor/simple assault, which was dismissed after a
diversion period. In 2003 he was convicted of
misdemeanor/unlawful possession of weapon and paid $150 fine.
In 2004 he was convicted of criminal trespass, pled nolo
contendere, and received six months suspended sentence and six
months probation.
David Nabors was present, along with his chief.
Mr. Underwood told the Commission that the 2002 charge was
expunged and couldn’t be considered.
Mr. Nabors explained to the Commission about his unlawful
possession of a weapon charge in 2003. He told the Commission
that he and his family went to his grandparents’ house for
target practice. He stayed and ate dinner that night before
returning to Memphis to go to work. He had the weapon with him
in the vehicle. He ended up being pulled over with the weapon

in the glove box. He was 19 years old and at the time did not
have a carry permit, which was against the law.
Mr. Nabors went on to explain about the charge of trespassing
that he received in 2004. He explained that he was training to
be a bounty hunter. And when the trainer he worked with got an
assignment to look for a gentleman wanted on a domestic violence
they went to the guy’s sister’s house looking for him. They
searched the residence, but he was not there.
They subsequently went back about three weeks later to look
again, and he was not there. Then three months later Mr. Nabors
said he was arrested and charged with criminal trespassing.
Commissioner Cherry moved for approval, seconded by Commissioner
Williamson. The motion carried.
WAIVER OF BASIC TRAINING – 1110-02-.03 + 1110-9-.02
The following requests for waiver/substitution of basic training
have been reviewed and appear to meet P.O.S.T. requirements:
Ardmore Police Department – Request Mark A. White (hired
March 8, 2017) be allowed to attend September 2017 P.O.S.T.
Transition Class at TLETA. Mr. White was previously certified
in Alabama, graduating from (520 hour) Alabama Criminal Justice
Training Center in June 2010 and working for Rogersville Alabama
Calhoun Campus Police. If approved, Mr. White will also need a
six-month waiver and an additional eight hours of EVOC.
Mark White was present, along with Lieutenant David Posey.
Commissioner Williamson asked if Mr. White graduated in Alabama.
Mr. White said he graduated from the University of Alabama in
November of 2000.
Commissioner Williamson asked Mr. White how long he worked.
Mr. White said when he went to the University of Alabama he was
in law enforcement for six years. He then removed himself from
it for several years and went back and took a refresher course
and got his certification back in the state of Alabama in 2010.
Commissioner Williamson asked if Mr. White had been in law
enforcement since 2010. Mr. White said he was a police officer
in Rogersville up until 2014 and then for Calhoun Police
Department in 2016.

Commissioner Baker moved for approval, seconded by Commissioner
Wilson. The motion carried.
Ardmore Police Department is also requesting that Mr. White be
allowed to ride solo in Tennessee until graduating Transition.
Commissioner Forrester asked Mr. White if he had any training on
the differences between Tennessee and Alabama law. Mr. White
said he had not yet, but he has law books and will be studying
since he has a three-week Transition Class coming up in
September.
Vice-Chair Hannon asked Lieutenant Posey when they were having
their EVOC training. Lieutenant Posey said they were going to
go through V-Academy this time for their training.
Chair Jenkins asked if Mr. White was still employed in Alabama.
Lieutenant Posey told the Commission Mr. White was employed with
campus police at Athens College.
Chair Jenkins asked if Mr. White was going to quit working in
Athens to come work for Ardmore. Lieutenant Posey said he is
working in Athens to keep up his benefits. Mr. White is working
at the university Mondays and Tuesdays.
Commissioner Chrisman asked Mr. Grisham to refresh his memory on
solo assignments for officers in other states. Mr. Grisham told
the Commission they have allowed officers to ride solo if they
were certified in other states.
Commissioner Cherry moved for approval, seconded by Commissioner
Chrisman. The motion carried.
Chattanooga Airport Police Department – Request Mitchel A. Smith
(hired April 3, 2017) be allowed to attend the September 2017
Transition Class at TLETA. Mr. Smith previously worked for
Hamilton County Sheriff Office leaving in October 2010. He
graduated from Chattanooga Police Academy in 1989.
Nobody was present.
Chair Jenkins asked if Mr. Smith had worked since 2010.
Mr. Farris said Mr. Smith has had a seven-year break in service.
Commissioner Chrisman asked Mr. Farris if that currently meets
the requirements, and Mr. Farris said yes.

Commissioner Baker moved for approval, seconded by Commissioner
Chrisman. The motion carried.
WAIVER TO ATTEND ANOTHER ACADEMY – P.O.S.T. Rule 1110-02-.03(3)
Murfreesboro Police Department – Request Matthew S. Meguair
(hired April 17, 2017) be allowed to change academies from Metro
Nashville Police Academy where he attended in 2013, leaving for
family medical issues. He is scheduled to attend TLETA
July 2017, if approved.
Matthew Meguair was present, along with Sergeant Justin
Lemanski.
Commissioner Chrisman asked Mr. Meguair about the circumstances
surrounding him leaving the Metro Nashville Police Academy.
Mr. Meguair said that at the time he went to the police academy
his wife, who had an eight-month baby at home, ended up having a
7-millimeter kidney stone. Mr. Meguair had to leave the academy
to take care of her.
Commissioner Chrisman asked Mr. Meguair if he left his
employment with Metro at that point. Mr. Meguair said yes.
Commissioner Chrisman asked Mr. Meguair if there were any
disciplinary actions or any other problems besides the family
medical leave. Mr. Meguair said no. Mr. Meguair said that
Metro told him that he was eligible for re-hire.
Commissioner Baker moved for approval, seconded by Commissioner
Wilson. Commissioner Chrisman abstained from the vote. The
motion carried.
APPLICATIONS FOR TRAINING OFFICER – 1110-04-.03
P.O.S.T. Investigators have reviewed and approved two
applications for Training Officer, and they appear to meet
criteria for approval.
The officers listed below, if any, will be informed that they
have one year to complete instructor development or approved
substitute.
Commissioner Wilson moved for approval, seconded by Commissioner
Baker. The motion carried.

Chair Jenkins decided to go ahead and clear the people appearing
first before going through the rest of the agenda.
WAIVERS OF SIX-MONTH RULE
The following departments are requesting a waiver of the six-
month rule to keep their officer(s) and the departments in
compliance.
Clay County Sheriff Office – Request a 2nd six-month waiver this
year for Samuel F. Wood (hired August 1, 2016). Mr. Wood
experienced a medical issue at TLETA in August 2016 and had to
drop. And he is currently not medically cleared to attend a
Basic class.
Samuel Wood was present, along with Deputy Chief Jeff Allen.
Mr. Wood told the Commission the cardiologist screening he had
after his medical issue at TLETA was inconclusive. He has since
seen another cardiologist; however, he would not clear him to go
back to work.
The new cardiologist referred Mr. Wood to see a pulmonologist,
and he is now testing with the pulmonologist.
Chair Jenkins asked Mr. Wood what his job is with Clay County.
Mr. Wood said he’s interim SRO and has been doing some court
security, transports, and corrections.
Commissioner Forrester asked Mr. Wood if he’s doing any law
enforcement functions. Mr. Wood said no.
Chair Jenkins said if Mr. Wood is an SRO he is in a law
enforcement capacity. Mr. Wood said they didn’t have an SRO and
asked him to go check in with the schools in the interim.
Deputy Chief Allen told the Commission Mr. Wood is no longer
fulfilling the SRO position. They have since hired an SRO and
have changed Mr. Wood’s status to transports and courtroom
security.
Commissioner Chrisman asked Mr. Wood if he knew when he would
get a definitive answer from the pulmonologist. Mr. Wood said
he didn’t know, but his appointment was August 10th.
Commissioner Chrisman told Deputy Chief Allen due to Mr. Wood’s
medical condition they need to be careful with his assignments,

given his cardio issues. Deputy Chief Allen said they have
lightened Mr. Wood’s duties, but he said he would welcome any
advice the Commission may have as to what to do.
Commissioner Williamson asked the Commission if they had said
before that two consecutive six-month waivers weren’t allowed.
Chair Jenkins said Mr. Wood should be in the academy within six
months.
Commissioner Forrester said he thought the statute said one
year. Mr. Grisham said the statute was changed to say six
months. Mr. Underwood said there is no prohibition against
multiple six-month waivers; however, the policy says six months
is six months, not 12 months or 18 months.
Chair Jenkins asked Deputy Chief Allen what he hired Mr. Wood
for. Deputy Chief Allen said he hired Mr. Wood initially as
court security and that then Mr. Wood approached him asking for
a road position.
Chair Jenkins said if Mr. Wood doesn’t go to the academy until
October that he really would need three six-month waivers.
Mr. Underwood said the real issue would be Mr. Wood is not
working in a law enforcement capacity.
Chair Jenkins asked Deputy Chief Allen if it would be better to
just withdraw the request until they know Mr. Wood is healthy
and able to go to the academy.
Mr. Grisham told the Commission he would suggest granting the
waiver for Mr. Wood because the clock is ticking. Plus, he
needs to be certified to work in the courtroom as well.
Commissioner Williamson asked how many waivers can the
Commission continue to do. Mr. Grisham said there is no limit.
However, the intent would be for Mr. Wood not to work full-time
for more than six months, which he is not. Chair Jenkins said
he was hired in August, so he’s had a year of working full time.
Deputy Chief Allen told the Commission that if something were to
happen with Mr. Wood medically and he were unable to go to the
academy in October they will withdraw the application at that
time.
Chair Jenkins reminded Deputy Chief Allen that if Mr. Wood is in
the court that he needs to be a certified officer. Mr. Wood can
do transportation or be a jailer. Deputy Chief Allen said

Mr. Wood is a corrections officer. Mr. Grisham said Mr. Wood
can be in the courts, but he can’t work more than 20 hours a
week without being certified.
Commissioner Chrisman moved for approval, seconded by
Commissioner Williamson. The motion carried.
Wilson County Sheriff Office – Request four six-month waivers
(budgetary constraints) for Billy Burns, II (hired January 8,
2016, as a court officer). Mr. Burns will be attending TLETA
Basic July 2017.
Sergeant Jeremy Rich was present.
Chair Jenkins asked Sergeant Rich why they need four waivers and
asked what Mr. Burns has been doing. Sergeant Rich said
Mr. Burns has been working in corrections, and then they
transferred him to the court. Now that it is a requirement to
have court officers certified it puts a big strain on their
budget due to the amount of court officers they have.
Commissioner Forrester asked Sergeant Rich what day Mr. Burns
began working in a law enforcement capacity. Sergeant Rich said
that Mr. Burns started with Wilson County Sheriff Office in
March of 2013, and he was transferred to the court in January of
2016.
Commissioner Forrester asked Sergeant Rich why they didn’t just
ask for four waivers all at once. Sergeant Rich did not know
why the Department chose to do it this way. Sergeant Rich did
go on to say that he was told they are under budget restraints
because of having so many officers needing to go to the academy.
Mr. Farris told Commissioner Forrester he enclosed the
Department’s letter in the information the Commission has. The
Department didn’t ask for four, but after the letter came
Mr. Farris asked for four waivers because by the time Mr. Burns
graduated the academy they would need four waivers.
Commissioner Wilson asked Sergeant Rich how many people will the
Department be sending to the academy. Sergeant Rich said that
at this time just Mr. Burns.
Commissioner Wilson asked Sergeant Rich how many deputies they
have. Sergeant Rich said they have approximately 160 certified
officers and 250 in corrections.

Commissioner Wilson asked why they can’t send one officer to the
academy. Sergeant Rich said he wasn’t over the budget and
didn’t know.
Commissioner Cherry asked how many court officers they have.
Sergeant Rich said they have approximately 25 court officers.
Commissioner Cherry asked how many were certified. Sergeant
Rich said about half of those are certified officers, and the
other half are part-time officers.
Commissioner Baker told the Commission that it’s important to
note that whatever the Commission decides to do with Mr. Burns
will probably set a precedent for future cases.
Commissioner Cherry moved for approval, seconded by Commissioner
Bell.
Chair Jenkins tells the Commission if they don’t approve this
Mr. Burns will have to go home and that it’s not his fault.
Commissioner Williamson said that when smaller departments come
to the P.O.S.T. the Commission tells them if they can’t afford
to run a police department then close them. Commissioner Long
agreed and said they have the money. Commissioner Wilson also
agreed.
Commissioner Bell is questioning why the sheriff of the
department is not before the Commission explaining why they
can’t afford to put Mr. Burns through the academy.
Commissioner Wilson asked for a roll call vote.
Mr. Farris conducted a roll call vote.
Commissioner Baker, no; Commissioner Chrisman, no; Vice-Chair
Hannon, no; Commissioner Long, pass; Commissioner Williamson,
no; Commissioner Wilson, no; Forrester, no; Commissioner Bell,
yes; General Cherry, yes. The motion does not pass.
Commissioner Bell moved to approve three waivers, seconded by
Commissioner Long.
Commissioner Cherry asked if the Commission denies the fourth
waiver will the Department be able to stay in compliance.
Mr. Farris said Mr. Burns will need to serve in corrections from
today to July 9th.

Captain Richard Glasgow with Atoka Police Department was
present. Chair Jenkins said they were not on the agenda.
Captain Glasgow said he wrote a letter requesting a waiver, and
Mr. Mines requested that he attend P.O.S.T. today.
Mr. Farris said that Mr. Mines was in training today and will
look into it.
Chair Jenkins continued with the agenda.
APPLICATIONS FOR CERTIFIED INSTRUCTOR – 1110-03-.04
P.O.S.T. Investigators have reviewed and approved 9 applications
for certified instructor. They appear to be in order and meet
minimum standards, and they have completed the minimum hours in
attendance of required courses.
The instructors listed below, if any, will be informed they have
one year to complete instructor development or approved
substitute.
Officers listed below, if any, request a waiver of the one-year
training officer requirement.

CURRICULUM AND TESTS - 1110-04 & SPECIALIZED TRAINING
CURRICULUM – 1110-04-.09
P.O.S.T. Investigators have reviewed and approved 107 in-service
and specialized training classes this month as they appear to be
in order and meet or exceed minimum standards set forth by the
Peace Officers Standards and Training requirements. They have
made note if these training offerings meet the P.O.S.T.
requirements for firearms, EVOC, mental illness, and CSA.
Commissioner Long moved for approval, seconded by Vice-Chair
Hannon. The motion carried.

OLD BUSINESS
The Rules Committee has requested a motion to move forward with
the filing of the rules.
Mr. Underwood said they’re preparing to go forward with filing
the Notice of Hearing after the approval by the Attorney General
and the Governor.
Commissioner Chrisman moved for approval, seconded by
Commissioner Baker.
Commissioner Forrester asked the Commission about the discussion
they had last month regarding the proposed changes to the rules.
Mr. Underwood said they’re prepared to go forward with
Chapters 1 through 7 only, which will encompass the initial
Basic training and definitions.
Commissioner Forrester asked Mr. Underwood if it would be better
to submit all the rules at once. Mr. Underwood said if they did
that it would delay the process. So, they will submit
Chapters 1 through 7, and then do Chapters 8, 9, and 10
subsequently.
The motion carried.
NEW BUSINESS/ITEMS FOR DISCUSSION
Ripley Police Department was audited by P.O.S.T. and found to be
in compliance.
Chair Jenkins asked who did that. Mr. Farris did. Chair
Jenkins asked Mr. Farris if there was anything the Commission
needed to know. Mr. Farris said no. Mr. Farris went on to say
that they were missing four or five documents out of 119, but
they rectified that and are now in compliance.
Commissioner Long moved for approval, seconded by Vice-Chair
Hannon. The motion carried.
Captain Richard Glasgow was back before P.O.S.T. with the waiver
letter he had written.
Mr. Farris said that the Commission has seen a lot of these this
year. It seems that Captain Glasgow’s mental health training
was holding the department up from receiving their salary
supplement.

Commissioner Bell asked Mr. Underwood if there was a requirement
that this matter be on the agenda before the Commission could
take the matter up. Mr. Underwood said the Commission needs to
vote to put it on the agenda before they can hear the matter.
Commissioner Cherry moved to have the matter put on the agenda,
seconded by Commissioner Chrisman. The motion carried.
Chair Jenkins asked Captain Glasgow to explain to the Commission
what happened with his mental health training.
Captain Glasgow said he signed all the other officers up for
training and neglected to get his own. He was contacted in
April that he was missing his mental health training.
Chair Jenkins asked if Captain Glasgow was the only one who
missed it, and Captain Glasgow said yes. He didn’t realize that
he never went through the course himself.
Commissioner Long moved for approval, seconded by Commissioner
Chrisman. Commissioner Baker abstained from the vote. The
motion carried.
WAIVERS FOR SIX-MONTH RULE
Crockett County Sheriff Office – Request a six-month waiver for
Silvia S. Amador (hired August 22, 2016). Ms. Amador failed
driving in January 2017 TLETA Basic class and is returning
May 7, 2017, to complete it.
Vice-Chair Hannon asked if Ms. Amador finished the class.
Mr. Grisham said yes. Mr. Farris asked Mr. Grisham if he
remembered off the top of his head. Mr. Grisham went to see if
he was correct.
Dickson Police Department – Request a six-month waiver for John
Suddoth (hired March 13, 2017). Mr. Suddoth will be attending
TLETA Basic July 2017.
Commissioner Forrester moved for approval, seconded by
Commissioner Chrisman. The motion carried.
Hamilton County Sheriff Office – Request six-month waivers for
Cory P. Mullins and Jodi S. Terry (hired March 20, 2017). Both
will be attending TLETA Basic July 2017.

Vice-Chair Hannon moved for approval, seconded by Commissioner
Bell. The motion carried.
Lauderdale County Sheriff Office – Request a six-month waiver
for DaSean Laray Adams (hired September 1, 2016). Mr. Adams has
had to drop the last two TLETA classes. First, for family
medical reasons and then academic problems. Attending TLETA
Basic July 2017.
Mr. Underwood said the Commission may want to pass on this one
until Mr. Grisham comes back in to speak on it.
Moore County Sheriff Office – Request a six-month waiver for
Cory D. Prater (hired February 27, 2017). Mr. Prater will be
attending TLETA Basic July 2017.
Commissioner Baker moved for approval, seconded by Commissioner
Williamson. The motion carried.
Mr. Grisham came back in and said that both women had passed the
class.
Commissioner Chrisman moved for approval, seconded by Vice-Chair
Hannon. The motion carried.
Chair Jenkins asked Mr. Grisham about the Lauderdale waiver.
Mr. Grisham said the Department wants to send Mr. Adams back
through Basic. He hasn’t completed the whole class.
Commissioner Wilson asked if his tuition is gone. Mr. Grisham
said yes. Mr. Grisham said the first time they gave him a
credit because he had a family medical reason for dropping the
class. However, the second time Mr. Adams flunked out.
Commissioner Baker moved for approval, seconded by Commissioner
Williamson. The motion carried.
Paris Police Department – Request six-month waivers for Daniel
Andres and Jonathan Baxter (hired April 4, 2017). Both will be
attending TLETA Basic October 2017.
Commissioner Baker moved for approval, seconded by Commissioner
Wilson. The motion carried.
Perry County Sheriff Office – Request a six-month waiver for
Joseph Donaldson (hired February 3, 2017). Mr. Donaldson will
be attending TLETA Basic July 2017.

Commissioner Chrisman moved for approval, seconded by Vice-Chair
Hannon. The motion carried.
Portland Police Department – Request a six-month waiver for
Sarah Ulakey (hired April 3, 2017) but worked for five months
previously for Springfield PD August 2014 to January 2015.
Ms. Ulakey will be attending TLETA Basic July 2017.
Commissioner Baker moved for approval, seconded by Commissioner
Wilson. The motion carried.
WAIVERS OF IN-SERVICE – RULE 1110-09-.05
Requests for a waiver have been received for the following
officers so that they will remain in compliance with P.O.S.T.
guidelines as well as the department. They are not eligible for
salary supplement.
Memphis Police Department – Request in-service waivers for Leon
Dickson and Kevon J. Love, who are on leave with pay for an
officer involved shooting investigation, and are eligible for
2016 salary supplement pay.
Commissioner Williamson moved for approval, seconded
Commissioner Baker.
Mr. Farris said they’ve been on leave. They did 32 hours of
training, but they didn’t do the firearms training.
Commissioner Williamson said firearms is mandatory, so they
can’t waive it.
Commissioner Cherry said he doesn’t understand why they couldn’t
do the training with another firearm. Mr. Grisham agreed.
Commissioner Williamson wants to amend his motion to approve
without the salary supplement. Commissioner Baker seconded the
motion. Commissioner Forrester abstained from the vote. The
motion carried.
WAIVERS OF EIGHT-MONTH RULE
The following officers are requesting a waiver of the
eight-month rule. They will receive 2016 salary supplement
payment if they completed 2016 in-service requirements.

Hamilton County Parks and Recreation – Request an eight-month
waiver for Wayne Gann who retired May 10, 2016, completing all
IS training.
Commissioner Chrisman moved for approval, seconded by
Commissioner Baker. The motion carried.
Memphis Police Department – Request listed waivers for the
following officers who did not complete either 2016 IS Training
or eight months and are not eligible for 2016 salary supplement
payments.

Commissioner Chrisman moved for approval, seconded by
Commissioner Baker. The motion carried.
Commissioner Long brought up to the Commission that he had been
approached about officers riding alone when they’re part time or
reserve officers, but they can’t when they’re full-time
officers. Mr. Grisham said that they tell people they can’t
ride alone until they’ve completed their Basic, which is 80
hours. And that is going to go to 120 hours in October.
Commissioner Long said he was approached and asked why the rules
were so stringent on full-time officers as opposed to part-time
officers or reserve officers. Mr. Underwood said it probably
stemmed from whether or not the officers were trained in
Tennessee or out of state.
Mr. Underwood said that the criteria to evaluate it is have they
been certified before, have they been through the academy, have
they ever worked after attending the academy, and how long was
the break.
Mr. Grisham said that what he believes Commissioner Long is
asking is why a part-time officer or a reserve officer can ride
alone after having 80 hours, but a full-time officer must go to
a full academy before they can ride alone. Commissioner Long
agreed that’s what he was asking.
Mr. Underwood said they can look at that in the drafting of the
rules. Mr. Grisham said the definition of “part time” are those
that assist full-time officers.
Commissioner Chrisman asked Mr. Grisham what the intent of that
rule was when it was first enacted. Mr. Grisham said that is
just how it developed over the years and how it was interpreted.
Commissioner Forrester said he looked up the training
requirements rule, and it does say that once they complete the
required training they are able to drive solo. Commissioner
Long asked if that was for part-time officers, and Commissioner
Forrester said yes.
Mr. Underwood said they will look at this rule in the rulemaking
hearing, also.

Mr. Grisham had some things to discuss with the Commission.
First, Mr. Grisham reminded the Commission of the conference and
opening ceremonies Monday and that if anybody needed
transportation to let him know.
Also, Mr. Grisham said that the decertification meeting will be
June 15th and the business meeting will be June 16th.
However, in July the meeting will need to be moved up due to the
sheriff conference that month. The July meeting will need to be
on the 14th.
Chair Jenkins asked where the sheriff conference was going to be
held. Mr. Grisham said in Sevierville. He thought about just
having the P.O.S.T. meeting up there, but he’d have to get
another hotel.
Commissioner Williamson asked when the July meeting will be.
Mr. Grisham said if they decide to have it in Nashville it will
need to be July 14th. If they are able to have it in Sevierville
it will be July 21st.
Mr. Grisham said he would pursue the meeting being in
Sevierville in July and will let the Commission know at the June
meeting.
Finally, Mr. Grisham told the Commission the academy asked for a
budget improvement to get two more Basic classes done a year.
The July class is full, and now they’re working on the October
class. The Governor put in his budget half of that amount, and
it passed. However, they can’t do a new class with three new
instructors. So starting next January they are going to ask for
a waiver from the Commission to increase the class size to 120.
Mr. Underwood said the legislation proposed by the
administration regarding the audits authority and fingerprinting
for academies that are not attached to agencies have been
improved. They are able to get records coming from Walter State
and Cleveland State and that they should be able to get
background checks on those prior to enrollment.
Secondly, the compensation for in the line of duty death has
been increased. It was a one-time payment of $25,000. It is
now increased to $50,000 for five years.

years.
