REPORT OF THE SERVICE DIRECTOR, PUBLIC HEALTH & PROTECTION 6. REVIEW OF THE LICENSING ACT 2003 AND THE GAMBLING ACT

The Service Director, Public Health & Protection presented the Committee with his quarterly report on relevant issues with regard to the Licensing Act 2003 and the Gambling Act 2005, together with ancillary matters arising from the responsibilities charged to the Committee. It was reported that the higher number of Temporary Events Notices (TEN’s), attached at Appendix 1A, reflects not only the longer reporting period, from 26th December 2016 to the 9th July 2017 but also the increase in the number of events held to celebrate the British Lions Tour and the number of applications made by Private members clubs for parties and charitable events. The Service Director, Public Health & Protection reported the outcome of the four contested applications which had been determined since the last Committee. Members were pleased to hear that all 25 underage sales tests conducted by Trading Standards had been successfully refused. Under the heading Complaints, Advice and Guidance, the Service Director Public Health & Protection advised Committee of the complaints and/or requests received from across the County Borough Council, a summary of which was set out for information. Further updates were provided in respect of Member/Officer training and the Community Alcohol Partnership (CAP) in Porth. Members were referred to the Alcohol/Gambling newsletter, attached at Appendix 1C, which will be issued on a quarterly basis to offer guidance and support to licensed premises on a number of legislative changes and issues relating to compliance with both the Licensing Act 2003 and the Gambling Act 2005. Under the Gambling Act 2005 the Service Director, Public Health & Protection updated Committee with details of enforcement activity and in conclusion Committee was informed that there is little change to the position of the Gambling Act 2005 due to the static nature of the trade and confirmed that the recovery of annual fees remains at 100%. Further to questions raised by Committee and the responses received from the relevant officers it was RESOLVED:-

7. EXCLUSION OF THE PRESS AND PUBLIC
RESOLVED that the press and public be excluded from the meeting under Section 100A(4) of the Local Government Act 1972 (as amended) for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraph 13 of Schedule 12A of the Act, namely, information relating to a particular individual. Transparency in the conduct of Local Authority business is desirable, however, personal data relating to the conduct and capabilities of individuals will be discussed and considered. Consequently, it is considered the public interest in maintaining the exemption outweighs the public interest in disclosing information.

1. PURPOSE OF THE REPORT
The purpose of the report is to update Members on relevant issues, with regard to

Members will be aware that a quarterly meeting is convened to review and discuss the implementation and progress of the Licensing Act 2003, together with any ancillary matters arising from responsibilities with which this particular Committee is charged. Such ancillary matters include the Gambling Act 2005. (There may also be ancillary matters arising from the impact of the Smoke-Free Premises Regulations, which have the potential to affect all licensed premises).

A number of Temporary Events Notices (TEN’s) notifications were used by
Private Member clubs to authorise additional hours / access to non members, for weddings, birthday parties and Charitable events.
A number of Premises Licence Holders submitted TEN's to permit extra hours for August Bank Holiday.
One licensed premises utilised the TEN’s process in order to facilitate the retail sale of alcohol in a marquee. This bridged the gap until a variation of the premises licence was granted to include the marquee as part of the licensed area.
TEN's have also been use to authorise licensable activity at outdoor events over the summer months such as 'The Big Welsh Bite' in Pontypridd and various fundraising events within the Borough.
Analysis of the TEN's applications indicate 29 related to Private Members Clubs, 41 for existing premises licences and 25 permitted community events.
A summary of TEN’s, is reproduced for Members information as Appendix 1A.

Club Ice The Temporary Event Notice (TEN) provided by Mr Parry related to the provision of the retail sale of alcohol and live and recorded music to be held at Club Ice, Broadway, Pontypridd between 21.00 to 05.00hrs on the 29th/30th July 2017. Objections to the TEN were received from South Wales Police who cited concerns over the applicants’ ability to promote the crime and disorder licensing objective. Objections were also received from Environmental Health Officers who expressed concern in respect of the promotion of public safety and public nuisance licensing objectives. At Sub Committee Hearing, Members heard from the applicant and from Police and Environmental Health Officers and subsequently determined to refuse the application on the basis that the applicant could not satisfy them that they could adequately promote the licensing objectives.

Gareth Owen Rees Ltd The initial variation application was to permit 24/7 alcohol sales and to permit late night refreshment from 23.00hrs until 05.00hrs. The applicant subsequently amended the application to reflect alcohol sales from 06.00hrs to 02.00hrs and late night refreshment from 23.00hrs until 02.00hrs. Objections were received from Police, Trading Standards, Environmental Health, Trading Standards, Child Protection, Health Board, Local Authority, Cllr Bradwick and Cllr Forey. Following mediation immediately prior to the Hearing, an agreement was reached for the sale of alcohol from 08:00 until midnight and late night refreshment from 08:00 until midnight. 4.3 Compliance & Enforcement
(i) Prosecutions/Infringements
The Licensee of an Off Licence in the Porth area is in the process of being prosecuted for an offence under the Licensing Act 2003, in respect of the sale of alcohol to a person under the age of 18 following a test purchase under the direction of Trading Standards Officers.
(ii) Test Purchasing
Trading Standards Officers have conducted 10 underage sales test purchases at off licences in the Borough during the period. One Off Licence sold alcohol to the volunteer, and as a result is the focus of a prosecution by Trading Standards.

Licensing Enforcement Officers conducted 5 test purchases at Late Night Takeaway Premises. One of these premises sold food after their permitted time, and as a result were invited in for interview. They were subsequently issued with a formal warning about future behaviour. Following this intervention the premises submitted an application for their licence to be extended for a further one hour.
(iii) Premises Inspection & Infringements 17 premises in the Borough were inspected in the period between 10th July 2017 and the 9th September 2017. The relevant Performance indicator for the Licensing Team is the premises licences found to be broadly compliant following inspection by Licensing Officers. Officers will consider confidence in management, compliance with licence conditions and business competency when determining the risk rating of the premises when considering whether they are broadly compliant.
Our current performance indicates that 79% of premises inspected are broadly compliant.

(iv) Complaints, Advice and Guidance Cynon Valley
Officers have continued to support the Pub watch schemes in Aberdare and Mountain Ash over the period. The Licensees are working well together and in a number of instances excluded patrons from Pub Watch Member premises for up to two years.
Officers have undertaken a large number of multi agency pre application advice visits with prospective applicants as advocated within our Licensing Policy.
Joint enforcement visits with South Wales Police have been undertaken at on and off licensed premises in Mountain Ash and Aberdare following complaints and intelligence passed by partner agencies. One of these premises is now the subject of an application for the Review of the Premises License. Following intelligence received, test purchases have been conducted at a number of the takeaway premises in the Cynon Valley. A formal warning was issued to one of these premises, for selling food after their permitted time.

Following advice and guidance provided by Licensing Officers to a licensed premises in Ynysybwl concerning a Music festival in August, the festival went ahead without any major issues. Officers are working in conjunction with the Youth Offending Team and Hirwaun YMCA, in producing a DVD outlining the dangers of alcohol. Once completed, the DVD will be shown in schools and youth clubs throughout Rhondda Cynon Taf.
Rhondda
Advice was provided to an individual who was planning a “boxing” event in the rear garden of a residential property. Following advice provided by both our Licensing Officers and South Wales Police, the event was cancelled and the boxing ring removed. Complaints have been received regarding outside seating of a members club in Ynyshir. The committee have been spoken to and the seating arrangements returned as per conditions outlined on the License.
Officers have supported Upper Rhondda and Porth Pubwatch meetings throughout the period. Officers facilitated a meeting of Responsible Authorities to assist a prospective new applicant for a new off licence in the Porth area.
Visits to off licenses in the Tonypandy and Penygraig areas have been undertaken with South Wales Police following concerns about proxy sales and Anti Social Behaviour
Officers have conducted multi agency visits in conjunction with the Security Industry Authority and South Wales Police to a number of on licensed premises, looking at the provision of door staff and compliance with license conditions. Non compliance was identified at one of the premises visited in Tonypandy, and a formal warning provided.
Taff Area
Officers have attended Pubwatches in Pontypridd, Treforest and Pontyclun throughout the period. The Pubwatches continue to be well attended and proactive, when appropriate, in the exclusion of disorderly patrons.
Following concerns raised by CCTV Operatives, Officers have liaised with the Police and Security Industry Authority (SIA) following allegations of inappropriate behaviour towards patrons by members of door staff at a licensed premises in Pontypridd. Investigations are complete and the member of door staff removed from the Security Industry Authority database.

Officers have facilitated multi agency meetings that have resulted in the smooth running of outdoor events in the Beddau area. Officers have carried out visits to all licensed premises in the Church Village area following numerous complaints of noise, underage drinking and anti social behavior in the area. Officers met with the management of an on licensed premises in Pontyclun, following concerns regarding the operating practice within the premises. As a result, the premises has been closed whilst the management employ a new Designated Premises Supervisor.
(v) Community Alcohol Partnership (CAP) – Porth
The Community Alcohol Partnership has continued to be a success, with school engagement activities taking place in both Porth County School and Ysgol Gyfun Cymer. A Proxy sales initiative has taken place in partnership with Morrisons Supermarket in Porth, where Ysgol Gyfun Cymmer school pupils created signs outlining to the public the dangers of proxy sales and the consequences of being prosecuted for proxy purchasing.
Targeted youth engagement operations have continued to take place, and as a result anti social behaviour in the Porth area has been reduced by 28%. .
(vi) Alcohol/Gambling Newsletter
The second edition of the Alcohol/Gambling Newsletter was distributed. The newsletter focussed on what is required as part of a Licensed Premises Inspection, and provided an inspection checklist. A copy of the newsletter is reproduced for Members information as Appendix 1C. The newsletter has been received positively by the Licensees.

5.3 Recovery of Annual Fees
As a result of the static nature of the trade, there is little change to the position, where 100% recovery of annual fees is the standard, primarily due to the robust provisions contained within the legislation which allow for withdrawal of the licence/permit for non-payment of appropriate fees.

Proxy Sales South Wales Police are reminding all licensed premises to show extra care and attention when it comes to Proxy Sales. A proxy sale is the sale of alcohol to a person aged over 18 for a person who is under 18. Watch out for youngsters hanging around outside your shops or even in your beer gardens asking adults to purchase alcohol for them.
It is illegal and heavy fines of up to £5000 can be handed out!!

Is your Premises Licence kept on the premises? Is your Licence Summary on display? Does your CCTV work as per your condition?
Does it record as it should and can you download footage if we made a request?
Have you trained your staff? Have you kept records? Have you altered your premises layout/extended your premises? Need a licence variation? Where is your refusals register? Are your staff completing it regularly? Is the DPS checking it? Are your Personal Licences on the premises? Is your DPS still current? Do you know your permitted hours? Have you told your staff? Are you required to have door staff? / Is your door staff log up to date?

This would include a medium, hypnotist, race night or bingo night to name but a few! Please contact us if you need any further advice and guidance.
Having entertainment at your licensed premises?
The tips below may help to avoid unnecessary noise nuisance complaints. Check your licence/club premises certificate for permitted times and activities. Close/manage your windows and doors. Is your artist playing through your noise limiter? Set your levels – you know your weaknesses.
Don’t let the artist dictate the volume. Conduct noise checks around the perimeter of
your premises. Keep a log of your checks. Any queries speak to your licensing officer or environmental health officer.
