1. We act for Wellington International Airport Limited (WIAL) in respect of the Wellington Airport Runway Extension Application (Application).
2. WIAL has decided to proceed with a direct referral of the Application to the Environment Court for determ ination.
3. Accordingly, please find attached two copies of the following documents:
(a) Notice of Motion seeking direct referral;

Section 87G of the Resource Management Act 1991
To: The Registrar Environment Court Wellington
1. WELLINGTON INTERNATIONAL AIRPORT LIMITED (WIAL) applies under 87G of Resource Management Act 1991 (RMA) for:
(a) An order that its Application to the Greater Wellington Regional Council and the Wellington City Council (Councils) to enable the construction, operation and maintenance of approximately a 355 metre extension to the takeoff runway available (TORA) at Wellington International Airport, largely by way of reclamation into the Coastal Marine Area (CMA) at Lyall Bay, be directly referred to the Environment Court for determination.
(b) The total length of the proposed runway extension (including the toe) from the existing land boundary and into the CMA is approximately 363m. The total construction footprint of the runway extension is approximately 13ha, which includes the CMA, road, Airport Precinct and Open Space B zoned land. The area of the reclamation is approximately 11 ha.
(c) The construction works also include an extension to the existing tunnel underpass on Moa Point Road, the construction and maintenance of a submerged wave focussing structure in Lyall bay approximately 450 metres off shore, temporary moorings with the construction exclusion area and other landscape/amenity improvement works in the locality.
(d) The Application seeks the following resource consents:
(i) 34044 - Reclamation Activities
(ii) 34047 - Temporary Structure Activities
(iii) 34048 - Earthworks Activities

2. The grounds for this Notice of Motion are:
(a) WIAL made an Application to the Councils for resource consents to extend the runway at Wellington International Airport.

(b) WIAL also requested the Application be referred directly to the Environment Court for determination.
(c) The Councils issued separate decisions on 22 July 2016 in which both Councils agreed to directly refer the Application to the Environment Court in accordance with section 87E of the RMA.
(d) WIAL received the reports prepared by the Councils pursuant to section 87F of the RMA on Friday, 7 October 2016.
(e) WIAL has decided to proceed with direct referral, and has lodged this Notice of Motion within 15 working days of receiving the Councils reports.
(f) It is appropriate that the Environment Court determine the Application for the following reasons:
(i) The significant public interest in the Application;
(ii) The technical nature of the Application and the resource consents required;
(iii) Direct referral will enable the efficient determination of the issues;
(iv) Will reduce the duplication of process as there is a real likelihood of appeals;
(v) Direct referral is consistent with the purpose of the 2009 amendments to the RMA, intended to streamline resource consent processing and reduce costs, delays and uncertainties for all parties;
(g) There is no prejudice to any party, the Application has been publicly notified and all 776 submitters are to be served a copy of this notice and affidavit of Steven Sanderson in support.
(h) All the submitters have the ability to join these proceedings under section 274 of the RMA;
(i) Sections 87C - 87G(2)(a) of the RMA have been complied with and the requirements under section 87G(2)(b) and (c) regarding service and advice to the Registrar will be complied with in due course. Where email addresses have been provided by submitters these will be used as a preference for service]; and
(j) Upon the further grounds set out in the affidavit of Steven Sanderson filed in support of this Notice of Motion.

I, Steven Sanderson, Chief Executive Officer, of Wellington swear:
Introduction
1. My full name is Steven Sanderson. I am employed as the Chief Executive Officer
for the Applicant, Wellington International Airport Limited (WIAL) and I am
authorised to make this Affidavit on its behalf.
2. I have personal knowledge of the matter set out in this Affidavit and its contents
are true to the best of my knowledge and belief.
3. I make this Affidavit in support of the Notice of Motion by WIAL to directly refer
the Application for resource consents (Application), as described in more detail
below, to the Environment Court.
Background
4. There have been significant developments in the aviation and tourism sectors,
since the last major runway extension at Wellington Airport (Airport) in 1972.
5. Currently international access to Wellington is predominantly via other Airports
within New Zealand. This is largely as the existing runway length at the Airport
does not meet the operational requirements for larger long-haul airplanes.
6. The inability for the Airport to cater for larger airplanes restricts its ability to grow
and attract direct long-haul services to Wellington. The introduction of direct long
haul flights has been identified by Wellington City Council as a key contributor1 to
help Wellington thrive by providing a new point of access for visitors to Central
New Zealand. With a longer runway, the Airport would be able to provide for
direct long haul flights to and from Wellington from destinations such as Asia and
North America.
7. WIAL has undertaken extensive consultation and considered a number of
alternatives for the runway extension. As a result the Application (discussed
below) has been lodged with the Greater Wellington Regional Council and
Wellington City Council (Councils).
The Application
8. As set out in the Public Notice2 WIAL lodged an Application for the construction,
operation and maintenance of approximately a 355 metre extension to the take

off runway available (TORA) at the Airport. This will largely involve the
construction of a reclamation at the southern end of the existing runway into the
Coastal Marine Area (CMA) at Lyall Bay.
9. The total length of the proposed runway extension (including the toe) from the
existing land boundary into the CMA is approximately 363m. The total
construction footprint of the runway extension is approximately 13ha, which
includes the CMA, road, Airport Precinct and Open Space B zoned land. The
area of the reclamation is approximately 11 ha.
10. The construction works also include an extension to the existing tunnel
underpass on Moa Point Road, the construction and maintenance of a
submerged wave focussing structure in Lyall Bay approximately 450 metres off
shore, temporary moorings within the construction exclusion area and other
landscape/amenity improvement works in the locality.
11 . It is proposed that activities and transport movements during construction will
occur during the day and at night, seven days a week, subject to a number of
restrictions .
12. A 15 year lapse period for all resource consents is sought.
13. WIAL has applied for the following resource consents from the Councils:
(a) 34044 - Reclamation activities (unlimited duration sought):
Coastal permit to reclaim and use approximately 11 hectares of the CMA
to the south of the Wellington Airport runway in Lyall Bay, including any:
• Associated destruction, disturbance, deposition and discharge of
sediment and dust to the foreshore and seabed and to air during
construction of the reclamation;
• Disturbance of the foreshore and seabed associated with the
mooring of vessels during construction of the reclamation;
• Diversion and dewatering during construction of the reclamation;
• Generation of construction related noise.
(b) 34047 - Temporary Structures Activities (10 year duration sought):

Coastal permit to construct, use and maintain temporary structures
including moorings for construction related purposes, lighting structures,

site establishment facilities, machinery and equipment in the CMA
associated with the construction of the proposed runway extension and
associated project works, including any:
• Associated destruction, disturbance, deposition and discharge of
sediment and dust to the foreshore and seabed and to air during
construction of the structures;
• Disturbance of the foreshore and seabed associated with the
mooring of vessels during construction;
• Diversion and dewatering during construction of the structures;
• Generation of construction related noise.
(c) 34048 - Earthworks Activities (10 year duration sought):
Land use consent to undertake earthworks associated with the
construction of the proposed runway extension and associated project
works including the removal of a hillock to develop a construction
compound site and any associate discharges of sediment laden water to
land where it may enter water.
(d) 34049 - Air Discharge Activities for Construction (10 year duration
sought):
Discharge permit to discharge dust to air earthworks activities associated
with the construction of the proposed runway extension and associated
project works including the removal of a hillock, stockpiling and the
handling of fill and construction materials.
(e) 34050 - Beach Nourishment Activities (10 year duration sought):
Coastal permit to deposit natural materials onto the Moa Point Beach
foreshore for the purpose of beach and amenity enhancement.
(f) 34045 - Permanent Structures Activities (10 year duration sought):

Coastal permit to construct permanent structures and related project
works including a submerged surf wave focusing structure in Lyall Bay, a
protection structure over part of the Moa Point waste water outfall
pipeline and all other ancillary structures, including:

• Associated destruction, disturbance, deposition and discharge of
sediment and dust to the foreshore and seabed and to air during
construction of the structures;
• Disturbance of the foreshore and seabed associated with the
mooring of vessels during construction of the structures;
• Generation of construction related noise.
(g) 34046 - Occupation of CMA are activities (35 year duration sought):
Coastal permit to occupy the CMA for construction purposes, temporary
and permanent structures, and ongoing maintenance work associated
with the proposed runway extension and related project works including
the toe of the reclamation below mean high watermark, a submerged surf
wave focusing structure in Lyall Bay and a protection structure over part
of the Moa Point wastewater outfall pipeline including:
• Associated destruction, disturbance, deposition and discharge of
sediment and dust to the foreshore and seabed and to air from
the maintenance of these structures;
• Generation of noise from maintenance activities.
(h) 34051 - Storm water Discharge Activities Post Construction (35 year
duration sought):
Coastal permit to discharge storm water from the extended Wellington
Airport runway directly to the CMA and to land adjacent to the CMA
where it may enter the waters of the CMA.
(i) SR357837 - Land Use Activities (unlimited duration sought)

Land use consent for the construction, operation and maintenance of the
proposed runway extension and associated project works on land and
road reserve including:
• Temporary site offices and associated facilities;
• Lay down and stockpiling areas;
• Construction, modification, upgrading and use of internal site
access ways;

• Construction, alteration and upgrading of existing network utilities
to provide for construction related activities and the long term
use of the runway and taxiways;
• Earthworks, including associated transport, and vegetation
clearance;
• Modification and upgrading of the Moa Point Road underpass
and other associated roading upgrades;
• Generation of construction related noise;
• Construction and use of runway infrastructure and structures on
land including (but not limited to) ancillary structures, fencing and
navigational aids, beach remediation and landscape/amenity
im provem ents;
• The continued use of reclaimed land for airport purposes.
Reasons for Direct Referral Request
14. Direct referral of the Application is sought by WIAL for the reasons set out in the
request for direct referral lodged with the Councils on 29 April 2016, and
subsequently granted on 22 July 2016. Copies of the request to the Councils and
the subsequent decisions are attached at Appendix A and Appendix B.
15. In summary, WIAL considered that a direct referral was more appropriate for the
following reasons;
(a) the significant public interest in the Application and the nature of airport
developments generally raises the likelihood of appeals to the
Environment Court;
(b) the technical nature of the Application is likely to result in multiple expert
witnesses addressing the same effects, along with complex evidential
issues. WIAL considered it was more appropriate for these issues to be
heard and determined by the Environment Court who are more familiar
with the complexities the Application gives rise to;
(c) the ability of the Environment Court to direct expert conferencing and/or
mediation on the Application;

(d) a streamlined decision making process will ensure finality to all parties
and a reduction in the timeframe in which parties are required to be
engaged in the process; and
(e) a reduction in the costs incurred by all parties as a result of a one stage
hearing process.
Eligibility for Direct Referral
16. I have been advised that there are certain requirements that must be met under
the Resource Management Act 1991 (RMA) in order to directly refer a matter to
the Environment Court.
17. I set out the process that has been undertaken in progressing the Application to
meet these requirements:
(a) The Application and a request to have the matter directly referred to the
Environment Court pursuant to 87D of the RMA were lodged with the
Councils on 28 April 2016.
(b) The Application was publicly notified by the Councils on 2 July 2016.
(c) WIAL elected to have an extended public submission period for the
Application which closed at 4.30pm on 12 August 2016.
(d) The Councils released separate decisions on WIAL's direct referral
request on 22 July 2016, granting the request.
(e) A total of 776 submissions were received on the Application, with
approximately 34 being accepted by the Councils as late submissions in
accordance with section 37 A of the RMA.
(f) The Councils released separate section 87F reports on Friday, 7 October
2016.
(g) WIAL now files its Notice of Motion to have the Application determined by
the Environment Court within 15 working days of receiving the section
87F reports from the Councils as required by section 87G(2)(a) of the
RMA.

Conclusion
18. I consider that if the Application is not directly referred it will ultimately end up
before the Environment Court. Engagement in two hearing processes would
create significant time and cost delays not just for WIAL but all parties involved.
19. In these circumstances where there is considerable public interest in the
Application I consider that a more effective and efficient approach would be for
the Application to be directly referred to the Environment Court for determination.
