I am in receipt of MDEQ’s May 31, 2018 letter regarding lead service line removalactivities. The MDEQ requested clarification regarding 404 addresses that had previouslybeen hydro-excavated and identified as having non-copper material.
The 404 addresses that were assigned to W.T. Stevens and Waldorf & Sons wereidentified as a part of Phase IV Service Line Replacement work in 2017. The previousconstruction year ended on December 19, 2017 due to winter weather conditions.However, W.T. Stevens and Waldorf & Sons had high concentrations of copper in theiroriginally assigned zones. Therefore funding remained available under their contracts tocomplete additional addresses left over after the 2017 construction season.
As discussed on the June 11, 2018 EPA teleconference call, we scoured the ConcernedPastors Settlement Agreement to find language that requires hydro excavation as therequired method to identify service line materials. However, we requested during the callfor the State to show us the specific language in the settlement agreement, which requiresthe use of hydro-excavation. We still have not received this information. Another topicraised during the call were the health and safety concerns with the lack of reliability inhydro-excavating. As you are aware, some of the service lines that were hydroexcavated, were later found to contain lead material after they were excavated. As aresult, the City does not want to be mandated by the State to use the hydro-excavationmethod when identifying non-copper service line materials.
The City’s priorities are public health and getting the service lines replaced as quickly aspossible. Public health remains the number one concern, not cost cutting at the expense
of the residents. The City and the MDEQ are already all too familiar with the results ofputting finances before public health.

Re: Response to MDEQ’s May 31~ Letter to the City of Flint
AECOM has reviewed the files which were referenced in MDEQ’s May 31~ letter and sent to the City ofFlint on June l2~~ and cross referenced these addresses with the addresses that were hydro excavated in2017. Our findings are as follows:
a. Of the 410 addresses on MDEQ’s list, we have identified (9) declinations, (98) unable to contacthome owner, (2) obstructions), (3) abandoned homes and (19) miscellaneous.
b. AECOM is currently canvassing the declination and unable to contact lists from 2017, and willissue service line replacement work orders to the Phase V contractors for all consents granted.
The last date that work was performed under the Phase IV HVI contract was on November 17th, 2017, atwhich point both HVI contractors (ML Chartier and Dependable Sewer) from Phase IV had exhaustedtheir not to exceed contract amounts. After November 17th, 2017, excavations leading to service linereplacements or copper to copper findings were accomplished without hydro excavation equipment.
In regard to the MDEQ’s inquiry about the Phase IV address lists that WT Stevens and Waldorf havebeen working with, we are providing the following information to clarify when these lists were issued andwhere the work was to be performed:
