The 8th Annual SHRM Jacksonville Conference and Expo is just three weeks away
and our conference team has been hard at work preparing for another spectacular
event! With the theme of the Art of HR, we have 25 thought provoking speakers
presenting on topics from strategic approaches with talent acquisition to becoming
an effective HR business leader. In addition, we have four session tracks if you
want to focus your efforts on a specific area: Master Series, HR Compliance, Art
of HR, and HR Development.
The conference has been certified for 9 SHRM Professional Development Credits
as well as 9 HR Certification Institute HR credits. In addition, a number of the
sessions have been certified as Business credits by the HRCI.
We are looking forward to our Business Partners and encourage you to join them
at the networking social on Thursday evening as well as visiting with them in the
Expo Hall on Friday. Without them, we wouldn’t be able to do what we do!
Time is running out to save on the registration. You must register by April 20th to
receive a discount on the walk up rate.

Every leadership team is a collection of individuals, attempting to work together to produce extraordinary results. However, each individual brings to the team his or her biases, blind spots, emotional liabilities and egos. Often these liabilities create clashes, battles over control or intentionally ignoring the truth around situations that require immediate attention. The Human Resources executive has the unique opportunity to provide guidance, counseling and insights in these circumstances – but only if the HR executive has done the work to personally grow and fully understand the root causes and strategies for addressing them.

EEOC PROPOSES CHANGES TO THE EEO-1 FORM TO ADDRESS PAY EQUITY
The U.S. Equal Employment Opportunity Commission (EEOC) released a proposed rule that would require private
employers with 100 or more employees, as well as certain federal contractors and subcontractors, to include pay data by
race, ethnicity and sex in their annual EEO-1 reports.
If ultimately approved, the new rule would take effect with the EEO-1 reports due on or before September 30, 2017.
There would be no change for the upcoming EEO-1 reports due by September 30, 2016.
Covered employers will be required to report hours worked for all employees, including salaried employees. The EEOC
has specifically requested that employers provide comments on how to report data on hours worked by salaried
employees.
The EEOC and the Office of Federal Contract Compliance Programs (OFCCP) intend to use the compensation data to
“focus agency investigations, assess complaints of discrimination, and identify existing pay disparities that may warrant
further examination.” The EEOC and OFCCP plan to develop a software tool that would allow their investigators to utilize
the EEO-1 pay data to identify pay disparities warranting agency follow-up and potential investigation.
The proposed rule was published in the Federal Register on February 1, 2016, for a 60-day comment period ending on
April 1, 2016.

THE OFFICE OF LABOR MANAGEMENT STANDARDS’ (OLMS) FINAL RULE ON PERSUADER REPORTING
The Department of Labor (DOL) released its final rule re-interpreting the “Advice” Exemption in Section 203(c) of the Labor-Management Reporting and Disclosure Act, also known as the “persuader rule.” It will appear in the Federal Register March 24, 2016.
Under this rule, employers and their hired consultants (labor consultants or law firms) must report to DOL the scope and cost of these arrangements when the consultants are hired to persuade employees about unionization. In the past, employers have not had to report when consultants merely provide advice to the employer but do not directly interact with employees.
The final rule dramatically changes the interpretation of advice such that most arrangements between employers and consultants on union issues will now need to be reported.
The final rule made some changes based on stakeholder comments, including those from SHRM. The final rule tightens up language describing persuader activities, although the revised language still contains ambiguity. The final rule defines persuader activity that must be reported as:
Direct persuasion and four types of Indirect persuasion: providing persuader materials; directing supervisors; developing personnel policies and actions; and presenting union-avoidance seminars
