It never ceases to amaze me how quickly time goes by. Here we are in May already and I’m already noticing the slowing down of traffic. You can almost hear a big sigh amongst those whose businesses were booming during season this year! Additionally, there is a marked difference in inventory now available in the Southwest Florida real estate market. Typically during this time of year, we will see inventory go down. However, as history has shown, home sales in Southwest Florida remain pretty steady during the summer months. Last summer, according the Multiple Listing Service for the Naples, Bonita Springs and Estero markets, we averaged 576 homes sales per month during the months of July-Dec 2011 – that is a pretty

respectable number for a region that has an “off-season.” The point is that if you are thinking about listing a property or you have a property listed currently, this is not the time to remove that listing! Based on the sales history I mentioned above, you could say that while this season is nearing an end, we could see strong sales last year well into June 2011. The reason for this is because many of our winter visitors keep tabs on Southwest Florida long after they leave. The Internet and, of course, mobile devices have allowed those visitors to continue looking at the Southwest Florida real estate market, checking the listings and keeping in touch with agents all summer long. I expect to see that trend move into this June as well, as our snowbirds have been

snatching up homes in this market all season long. Additionally, summer buyers are a little different as well. These are buyers who have been monitoring the market all season. They’ve looked at different neighborhoods, amenities, home prices, and the market stats. These folks are now serious buyers who are at the jumping off point. And,

these buyers don’t necessarily have to be in Southwest Florida. If you remove your home from the market now, you’re likely to miss these serious buyers. You’ll also miss the decrease in inventory available, which can be helpful in seeing increased showings and activity. You may also be inclined to ask your Realtor to remove your listing and just promote via word of mouth a.k.a. the “pocket listing.” This too is the wrong thing to do for the reasons stated above AND because we know that over 95% of all real estate searches take place on the Internet. If you’re selling a home in Southwest Florida, not continuing your Internet presence is just an all-around a bad idea in any season. Lastly, if you’re thinking of

selling your home and you’re looking for representation, now may be the time for me to toot a horn. Local Color(Mocking) Bird Is The Word

By Joyce Bunting One of my coworkers came into my office the other day saying that there was a car alarm going off in the parking lot. She said she had been hearing it off and on all afternoon but she couldn’t pinpoint where it was coming from. When we went to the parking lot to investigate, instead of finding hoodlums trying to make off with the boss’ Volvo, there was a little grey and black bird on a low branch alternating between car alarm sirens and a whole repertoire of calls and tunes. They don’t call them mockingbirds for nothing. You may have noticed that your surroundings have become a little more musical (or noisy depending on your preferences) lately. It’s nesting season for mockingbirds and many of the males are out singing their little hearts out trying to attract a girlfriend. I’m not much of a bird watcher but these crazy little birds are not only amazing singers and mimics, they are unusual, intelligent and playful birds that are absolutely fearless when it comes to defending their nests and their young. In nesting season, male mockingbirds will sometimes sing nonstop through the night trying to impress the females. They have a repertoire of 50 to 200 songs and sounds and this also consists of specific sounds to communicate danger to other mockingbirds in the area. If a major intruder enters their territory the birds will call to other mockingbirds to come drive the threat away. They are very social birds and, though you’ll rarely see them in flocks or large groups, they take care of each other and will sometimes watch over other species of birds’ young if they’re being unattended. Mockingbirds just don’t behave like all the other birds. For instance, when they’re on the ground they don’t hop, they run. Sometimes when they’re running along the ground they’ll lift their wings halfway, pause for a second and then extend their wings all the way. Then they’ll run a little bit more and repeat the same wing lifting. Is it some sort of mating dance? Some type of territorial marking? Evidently, no one really knows. One theory is that, by flashing the white parts of their wings, they scare bugs (the main staple of their diet) out of hiding. I don’t know if that is true but it is fun to watch. They’re also silly when they get together. They love to play and if you ever see two of them together they’ll grapple in midair, all the while growling, or will hop sideways over each other in some birdy version of leap frog. Mating? Playing? Only mockingbirds know for sure.

If you’ve ever gotten too close to a mockingbird’s nest, you’ll know firsthand that they don’t care how big you are, they will go straight for your head to keep you from their young. A 2009 study discovered that mockingbirds can recognize and differentiate between humans. A mockingbird can pick a human out of group who has threatened or seemed to threaten its nest in the past. This is not news to a certain mail carrier in Tulsa, Okla. who was targeted by an outraged mockingbird. "It goes from chimney to chimney, tree to tree, whenever it sees the mail carrier, following her down the block. It swoops down and attempts to peck at her." It left everyone else on the block alone. Evidently the mail lady got too close to a nest at one point. I’ve personally seen mockingbirds go after cats, dogs, humans, other birds – including hawks and eagles – and I’ve even seen a mockingbird attack a 5-foot long blacksnake. It chased the snake for quite a while, grabbing its tail and almost lifting it off the ground. They do not take kindly to strangers wandering too close to their homes. It’s easy to see why these birds have been the subject of many stories and songs and why five different states, including Florida, have chosen it as state bird. They’re fierce little birds filled with personality. All that singing and noisemaking can be a little annoying when you’re trying to get some sleep but remember, as Harper Lee said, “Mockingbirds don't do one thing but make music for us to enjoy. They don't eat up people's gardens, don't nest in corncribs, they don't do one thing but sing their hearts out for us. That's why it's a sin to kill a mockingbird.”

Buyer Beware: The Perils of Uninformed Bidding As an attorney focusing on real estate law in southwest Florida, I frequently receive phone calls from distraught consumers who thought they were getting a great deal by purchasing property at judicial auction, only to find out that their “steal” is riddled with title defects, unanticipated obligations and hidden costs. While many great deals are available at judicial auction, the uninformed bidder may be purchasing much more than they bargained for. The good news is that through counsel, due diligence and prudent decision making, an informed bidder can distinguish the deals from the duds. There are a variety of legal actions that may ultimately result in a judicial auction of real property. Most frequently, property is auctioned as the result of a mortgage or other lien foreclosure action in which a creditor is seeking to recover amounts due on a contract. However, simply because a lien is foreclosed does not mean that all monetary liability, or even all liens associated with the property are eliminated. A common example is the situation where a primary mortgage is foreclosed, yet fees remain due and owing to a community association for unpaid assessments. Pursuant to Florida Statutes 718.116(1)(a) and 720.3085(2)(b), the winning third party bidder becomes jointly and severally liable with the prior owner for any unpaid community association assessments which accrued prior to the sale. Oftentimes these fees are exorbitant and entirely wipe out any gain anticipated by the unsuspecting bidder, or even worse, put the bidder in a negative equity position. Another issue arises where a junior lien is foreclosed. The average consumer does not realize that when a junior lien is foreclosed and the property subsequently auctioned, the winning bidder takes title subject to any superior liens that were not eliminated by the junior lienor’s foreclosure. For instance, if a community association forecloses a lien for unpaid assessments, and a third party bidder purchases the property at the auction, he/she may take title subject to a primary purchase money mortgage. In order to avoid unanticipated liability, it is imperative that bidders take proactive measures to retain the counsel of a qualified real estate attorney to review and determine the status of title to the property. By reviewing title, the bidder can discern what, if any, issues exist and make an informed bid at the auction. Elias M. Mahshie is an associate attorney with the Law Office of Kevin F. Shrimp Skewers with Dipping Sauce

Ingredients wooden skewers1 tablespoon lime juice1 pound shrimp1 teaspoon salt1 tablespoon vegetable oil1 tablespoon ginger, minced1 teaspoon garlic, minced1 tablespoon cilantro, minced, optional1 small jalapeno pepper, finely minced1 tablespoon soy sauceMethod Soak wooden skewers in warm water. Clean shrimp but leave tail on. Combine remaining ingredients. Add shrimp to marinade mixture and refrigerate 30 minutes to 2 hours. Thread 2 shrimp on each skewer. Grill or broil on each side for about 4 minutes or until shrimp are opaque. Serve with Shrimp Dipping Sauce. Dipping Sauce1/2 cup soy sauce1 teaspoon smoked sesame oil1 teaspoon ginger, minced1 tablespoon rice wine vinegar1 teaspoon garlic, minced1/2 teaspoon red pepper flakes Combine all ingredients and serve with Shrimp Skewers.

Ingredients 2 cups uncooked orzo pasta1/2 cup chopped fresh basil leaves1/3 cup chopped oil-packed sun-dried

tomatoes2 tablespoons olive oil3/4 cup grated Parmesan cheese1 lemon (zest & juice)1/2 teaspoon salt1/2 teaspoon ground black pepper

Method 1. Bring a large pot of lightly salted water to a boil. 2. Add orzo and cook for 8 to 10 minutes or until al dente. 3. Drain and set aside. 4. Place basil leaves and sun-dried tomatoes in a food processor. 5. Pulse 4 or 5 times until blended. 6. In a large bowl, toss together the orzo, basil-tomato mixture, olive oil, the zest of one lemon, the juice of one lemon, Parmesan cheese, salt and pepper. 7. Serve warm or chilled.

Sun-Dried Tomato Basil Orzo

Ingredients4 eggs1 pkg. yellow cake mix13-oz. pkg. lemon Jell-O mix3/4 cup Florida's Natural® Brand orange

juice1/2 cup canola oil Glaze1/3 cup lemon juice2 cups powdered sugar Optional1 can mandarin oranges, drainedSeveral fresh mint sprigsMethod 1. Preheat oven to 350°F degrees. 2. Mix eggs until frothy. Blend in cake mix, Jell-O mix, orange juice, and canola oil. Mix for 10 minutes. 3. Pour into greased and floured bundt pan. Bake for 50-60 minutes until knife comes out clean. Let set for 10 minutes. Turn onto cake plate. 4. Mix lemon juice and powdered sugar in bowl for glaze. 5. With a toothpick, poke several holes on surface of cake. Pour glaze over top. 6. Garnish base of cake with mandarin orange slices and mint sprigs.

I wanted to clear up some common real estate terminology myths and misunderstandings. What is a buyer’s agent? A buyer’s agent or buyer’s specialist is an agent who represents a consumer interested in purchasing a home. This differs from a listing agent (seller’s agent), which is the agent most think of when you hear real estate agent. A listing agent represents the homeowner in selling the property. AnnaMaria Andriotis, SmartMoney.com’s real estate journalist, spoke openly on her endorsement of a buyer’s agent for every homebuyer. Statistics show that 90+ percent of property searches occur online and only 4 percent start at open houses. It is amazing how such a dramatic shift occurs over time due to

Little Known Unsafe Foods For Dogs by Maria Elena There comes a time in every dog's life when they get the chance to enjoy a little bit of what's on our dinner plate. Some crumbs, or even a small spill gives their "vacuum" like instincts a chance to dine on some treats. But dogs don't know what can hurt them. Several foods that we consume daily are potentially dangerous or even fatal for dogs.Doggy Diet Dogs should already be on a quality dog food diet. Table scraps and human food should be avoided because they can contain heavy grease and fats that can lead to many health and weight problems. Later in life, dogs may experience problems such as pancreatitis from these foods. Dog foods, particularly "lean" brands can help to avoid these issues. Another problem with human foods is that we tend to flavor them with salt. While salt is still part of a dog's daily diet, the excessive amounts that we tend to use can cause them kidney and liver problems. In addition to this problem, dogs will instinctively lick salted areas and foods, much like a horse would. Avoid giving your dog any foods that are heavily salted, or even allowing them to lick up some excess salt that you may have spilled while cooking.Troublesome Foods For Your Dog Your dog's overall health shouldn't be your only concern, however. There are many foods that can actually cause immediate problems. Among the well-known hazardous foods for dogs is chocolate. While very tasty and a sweet we tend to celebrate with (Valentines, Easter, Christmas), chocolate contains a chemical known as theobromine, which quickly accumulates in their body. It actually does the same for us, but we can metabolize it quickly enough to prevent any danger. Dogs cannot do this, so poisoning can result, which can even become deadly. Keep these sweets away from your dog. Other items that contain this chemical are some types of favored drinks. Tea and coffee can also cause poisoning, so be sure to properly dispose of old grounds or tea bags. Another popular, yet often overlooked food item is the grape. These simple fruits don't appear to be harmful, but can actually cause kidney failure in dogs. This also applies to raisins, which are basically dried grapes, and of course, wine. Though you wouldn't give raw eggs to your dog, there are many ways they can get a hold of this food. When cooking eggs, we usually throw the shells into trash cans, or there could also be some spillage on the floor or countertops. Egg is an ideal breeding ground for salmonella, which is toxic to dogs as well as humans. Be sure to clean up and properly dispose of your trash. For those who have a garden, tomatoes are a very popular item to grow. This fruit is tasty and adds flavor to various meals. But for a dog, it can be dangerous. Tomatoes can cause tremors and heart arrhythmias, and can be difficult to diagnose. While the tomato is dangerous, the plant itself can be deadly. Because dogs will naturally eat plants, avoid growing these in your garden, or allowing your dog access to that area. Apples, cherries and peaches all contain seeds and pits. Astoundingly, these very nutritious fruits can be potentially dangerous to your dog. Unlike humans, dogs will consume the entire fruit, seeds and all. The seeds in these particular plants actually contain trace amounts of cyanide, which is why we don't eat the core or pits. If your dog wants to enjoy some apples or similar fruits, be sure to slice the cores out

of them, and just feed them the meat. Avocados are a completely different story, however, as every part of this fruit is deadly for a dog. It can lead to difficulty of breathing and the accumulation of fluids in their chest. Do not allow your dog access to any form of avocado, including dips. While most nuts would naturally be okay for a dog to eat, the macadamia nut contains chemicals which can cause weakness, muscle tremors and even paralysis. These nuts are popular in chocolate dipped products and even trail mix snacks. Don't let your dog sneak from your snack bag while you're out on the road, camping, or traveling. A quality dog diet should consist of dog food and supplements that you discussed with your vet. While dog food seems like a bland food, and you're tempted to spice it up with some of your own daily portion, be sure that you avoid giving them anything that can potentially hurt them.

Are Recent Stock Market Advances SustainableU.S. investors are riding a wave of mostly good news, but many risks remain. The S&P 500 Index closed at 1402 on March 15, 2012, the first time the index closed above 1400 since June 5, 2008.1 The latest upward progression began in October 2011 when the debt crisis in Europe showed signs of receding and economic reports in the United States began displaying a more positive outlook. Between October 3, 2011, and March 23, 2012, the S&P 500 gained 27%, and U.S. investors have been riding a wave of mostly good news. • Economic activity in the manufacturing sector, including new orders and production, expanded in February 2012 for the 31st consecutive month.2

• Real gross domestic product, a gauge of economic growth, accelerated 3.0% during the fourth quarter of 2011, compared with 1.8% during the third quarter of the year.3

• Although the unemployment rate remained high at 8.3% for February 2012, the rate declined from 9.0% in February 2011, creating optimism that the worst period of high unemployment may be over. The question on the minds of many investors is: Will this momentum last, or is another crisis waiting in the wings? Risks remain, both within the United States as well as abroad. The European sovereign debt crisis appears to have stabilized, at least temporarily, thanks in part to the recent agreement among Greek private debt holders to accept a proposed restructuring of Greek sovereign bonds. If Europe is plunged into another crisis, Standard & Poor’s believes the fallout would affect U.S. business spending and equity prices.4

Domestically, the recent escalation in oil prices has the potential to curtail consumer spending, especially if prices rise further. Standard & Poor’s estimated that each $10 increase in the price of a barrel of oil subtracts 20 basis points (.20%) from growth in gross domestic product in each of the subsequent two years following the price hike, assuming the cost remains elevated.4

What Investors Can Do Given questions that remain about the long-term health of the global economy, investors may want to consider the following: • Consider overweighting equity holdings to U.S. stocks and emerging markets.5 This strategy could potentially avoid problems related to the euro zone. When analyzing potential holdings, review a company’s revenue sources to avoid significant exposure to Greece, Portugal, Italy, and other crisis-prone countries. In the United States, recent strong returns may create a scenario where the potential for future short-term gains is likely to be more muted. • Keep bond holdings short term.6 Federal Reserve Chairman Ben Bernanke has stated that the Fed will continue to keep the federal funds rate low in an attempt to stimulate economic growth. But interest rates are likely to go up sometime, and when they do, bond prices are likely to fall. Consider keeping the majority of your bond holdings short term so that if interest rates increase unexpectedly, you will not be locked into long-term holdings that decline in value. Investing in both stocks and bonds always involves risks, but avoiding securities associated with the euro zone and keeping bond holdings short term may help you avoid economic problems either in the United States or abroad. Experts: Use Reviews To Be A Smarter Shopper As a shopper, sometimes being first isn’t the best idea. With all the easy access to online information, it’s better to benefit from the advice of others before making purchase decisions. “Smart shoppers should refer to the vast collection of online reviews covering everything from hotel rooms to car dealerships,” says Steve J. Bernas, from the Better Business Bureau. “No one should make a purchase before doing their homework,” says Bernas. “Knowing what others think before you buy - and even knowing what others think of the place you’re buying from - can save you from making mistakes, and more importantly can save you money.” Bernas concedes that not all reviews can be trusted. “It’s possible for restaurants or online merchants to write their own glowing reviews, or for competitors to pan the competition. I always advise shoppers to read online reviews to get a feeling of what people think. Even if you don’t purchase online, it’s worth visiting just to see what others are saying about that item you’re considering.

Cars.com: Known for its automotive expert-reviews, Cars.com recently started asking car owners to write their own reviews for both cars and dealerships. The Insomnia Wakeup CallSleep Deprivation Is A Serious Health Risk It’s 3:30 a.m. and you’ve just rolled over in bed for what seems like the 500th time. As you watch the minutes on the clock tick by, all you can think about is how tired you are going to be tomorrow. While the cause of your insomnia may vary night to night, the outcome is still the same: you’re not asleep. You’re also not alone. The U.S. Centers for Disease Control and Prevention report that somewhere between 50 and 70 million adults in the United States have chronic sleep and wakefulness disorders. According to the National Institutes of Health, sleep disorders account for approximately $16 billion in annual health care costs, and Cornell University psychologist and sleep expert James Maas estimates that sleep deprivation and sleep disorders cost the American economy at least $150 billion a year. Sleep deprivation is not only costly, but dangerous too. After a review of national behavioral health data, the CDC found that one in 20 adults reported nodding off or falling asleep while driving at least once in 30 days. Short term sleep loss can lead to slower reaction times, headaches, aches and pains, irritability, shorter attention span and hindered decision making. The health effects of chronic insomnia are more difficult to study, largely because individuals with insomnia are oftentimes simultaneously suffering from other health ailments, and it becomes difficult to determine the difference between a direct correlation and a mere statistical association. However, there is documented association between sleep deprivation and diabetes, weight gain, hypertension, and lower immunity. All of these maladies can lead to even greater health

problems, including heart failure, stroke, kidney disease and death. Considering the risks of not sleeping, it is not surprising that so many people turn to pharmaceuticals for help. According to IMS Health, Americans spent about $2 billion on prescription sleep drugs in 2010. In 2010 alone, 60 million prescriptions for sleep aids were written. Unfortunately, sleep aids carry their own medical risks. As is the case with many prescription drugs, there is a chance of increased tolerance and physical and psychological dependency. Many sleep aids on the market come with side effects that range from bizarre to dangerous. Sleep aids have been connected with various incidents of sleep walking; everything from night eating to actually getting into vehicles and driving, while still asleep. Most recently, a study by researchers at Scripps Clinic Viterbi Family Sleep Centre in San Diego has linked hypnotic sleeping pills to a 4.6 percent greater risk of death and a 35 percent increased risk of cancer among regular pill users. So is there another answer to alleviating insomnia? Maurice Bard, founder and CEO of Mediflow Inc., a company that makes waterbase cervical pillows, is hopeful. “Before turning to prescriptions or other more drastic measures, you should examine some non-pharmaceutical remedies that could help your sleep problems.
