A B.C. Supreme Court justice has sent a work-ers compensation tribu-nal decision regarding a cancer cluster at Mis-sion Memorial Hospital (MMH) back to that ap-peals body.
The Workers’ Com-pensation Board ini-tially said the breast cancer cases of Patricia Schmidt, Katrina Ham-mer and Anne MacFar-
lane were not caused by their work at MMH’s lab, but a Workers’ Compensation Adminis-trative Tribunal (WCAT) disagreed in 2010 and 2011. The WCAT hears workers’ compensation appeals and is indepen-dent of WorkSafeBC.
Fraser Health Authori-ty disputed the tribunals’ decision, and Justice John Savage’s judgment
was released this past Tuesday. The FHA want-ed the case dismissed, but Savage said sending it back to WCAT would allow them to hear any new evidence that might alter the decision.
Savage wrote that the WCAT’s decision was “patently unreasonable and cannot stand” and that, “There was no pos-itive evidence that the
petitioners’ cancer was caused by occupational factors.”
He also noted that “a higher-than-expected rate of cancer in a work-place cannot alone pro-vide evidence that the cancer was caused by occupational factors” given the Occupational Health and Safety Agen-cy for Healthcare in B.C. (OHSAH) report into the
issue states clusters of cancer in a workplace are statistically certain to arise in various places and times.
OHSAH conducted an investigation and re-leased its findings March 2004 after 11 employees at MMH were found to have cancer; seven of them breast. It conclud-ed that the risk factors were no longer present
at the hospital, and that the increased incidence of cancer could not be determined, but could have been due to:
• past exposures to chemical carcinogens or, less likely, ionizing ra-diation;
• a statistical anomaly; or
• reproductive or other non-occupational risk factors.
The air intake vent of the hospital lab was located near the incin-erator smokestack where medical waste used to be burned. The OHSAH report noted that medi-cal incineration of infec-tious wastes and plas-tics is a public concern. Mission’s incinerator was decommissioned in 1994.

Justice sends cancer cluster case back

A B.C. Supreme Court ruling last week will see the District of Mission issue a building permit for a medical clinic and pharmacy on First Avenue.
Mission’s chief administrative of-ficer, Ken Bjorgaard, expects it will be sent out this week.
A lawsuit was filed on June 25, 2012, and concluded recently.
Bjorgaard says he doesn’t yet know how much the process has cost taxpay-ers as the district is still waiting for all the costs to come in. The petitioners were granted their court costs.
Last year the District of Mission council passed a bylaw prohibiting pharmacies and medical clinics in the downtown core, which prompted legal action from numbered company 0773184 B.C. Ltd.
The company had purchased the property at 33133 First Ave. before the zoning change and said the dis-trict was aware of its intended use and received assurances such an operation was allowed, according to statements
filed in court.Mission realtor Bill Campbell, who
was the purchasing agent, said he was “happy to hear the news. I suspected this would be the result, and I’m happy it turned out this way for my clients.”
Mission Coun. Nelson Tilbury, who has a background in real estate, was one of two councillors who opposed the bylaw last year.
Coun. Jenny Stevens also voted against the change.
“If we make statements as a realtor, we’re held to account,” said Tilbury. “The same applies to cities and munici-palities.”
Changing the zoning after a business has already told you what they want to do and spent money on renovations is morally wrong, said Tilbury, adding, “As it turns out, it’s legally wrong too.”
Tilbury said he understood where the opposition was coming from, and pointed out there were a lot of unfound-ed rumours circulating. Other council-lors claimed restricting pharmacies in the area was part of the downtown revitalization process.

Brittany Pernosky thinks about her sister every day.
Rachel was a spirited young Mission woman whose life tragical-ly came to an end last month. Her body was found in Chilliwack March 19 after an intense three-day search by fam-ily, friends and commu-nity members. As police continue to look for her killer, a private memorial service was held this past weekend.
Rachel grew up in Mission and attended Fraserview elementary and then went on to Mis-sion secondary.
“Rachel was wild, for sure,” said Brittany, who at age 20, was two years older than her sister. “She was all over the place, but she managed it pretty well and made sure everyone was taken care of. She was very organized that way.”
Rachel was finishing school, said Brittany.
She was popular among her friends and was a loving mother to her one-year-old son, Marco.
“She had an unbeliev-able relationship with him,” said Brittany, who visited with Rachel and her
son several times a week. “Every time someone comes through the door, he looks to see who it is.”
Rachel had a good re-lationship with Marco’s dad; she got along with everyone, added Brit-tany, who continues to have regular visits with her nephew.
The siblings were close and Brittany miss-es everything about Ra-chel, from her borrowing things without asking to her terrible jokes, and just hanging out.
“We love her and will miss everything about her.”
Brittany knew some-thing was wrong when Rachel’s friend called her to let her know Ra-chel didn’t show up to go shopping. It’s something her sister wouldn’t pass up. When Brittany saw Rachel’s phone inside her Kite Street home, she got worried.
“She was attached to that thing,” said Brit-tany. Rachel was an avid social media user and shared her thoughts on sites like Facebook and Twitter regularly.
Brittany used those same sites to let people
know her sister was miss-ing. Everyone’s worst fears were confirmed when police showed up at her house late in the evening after another day of searching.
“It was one of those things you know, but didn’t want to hear,” re-called Brittany. “It was devastating.”
The news of Rachel’s death spread quickly and the community was hit hard. Even those who didn’t know Rachel of-fered their condolences and tried to find a way to support the family, espe-cially Marco.
A March 22 benefit concert at Snipers Pool Hall raised $3,500, and another $1,000 online for the Pernoskys, and an ac-count has been opened at Envision Financial (ac-
count number 4588539) for anyone who wants to donate.
A donation box is also set up at Grab-A-Java Coffee House, where Brittany works, and a place Rachel frequented.
The Optimist Club is donating proceeds from its silent auction at its annual Talent Show on April 5 to the Pernosky fund. Up to $500 will be matched by the Optimist Club.
Clever Canadian Cou-poning is donating part of the proceeds from its April 8 class to the same fund. The class will be held at the Mission City Business Centre on James Street. For more information about this class, call 778-688-0376 or e-mail [email protected].

Service club to make changes following complaints at hunt
The Mission Elks Club will be mak-ing some changes at next year’s Easter Egg Hunt after complaints from at-tendees.
The annual event draws thousands of children and adults to Fraser River Heritage Park on Easter Sunday, and this year was no exception.
However, due to some ill-placed loud-speakers that lead to most of the crowd being unable to hear the announcer’s instructions, confusion ensued.
Complaints to this newspaper via letters and our Facebook page blamed
some of the parents who rushed into areas where only children were sup-posed to be picking up the chocolate eggs, and were pushing others to secure more treats.
Elks member Roy Archer said the truck from where volunteers tossed eggs into the grass was surrounded by parents and children, and next year, the field will be seeded with the chocolate before the event starts.
As well, they plan to utilize more of the park and spread out the crowd to make it less dense, he added.

AMBIGUOUS LOSSThere are many situations where we experience loss ambiguously. A family member suffering from a brain injury or who is becoming progressively more senile certainly fits the criteria for ambiguous loss, because they are physically present but psychologically absent. Homesickness is also a case of ambiguous loss because the person missed can be psychologically present, on the phone, for instance, but be physically absent. Choosing to move away from home or to break up with a romantic partner are clear cases of ambiguous loss, which we may have chosen in full knowledge that we would experience some sadness or melancholy. Abductions, missing persons, and cases where someone is lost are particularly difficult forms of ambiguous loss because the family and friends of the missing person simply don t know what to expect. In some cases, the ambiguity resolves, people regain their health or missing persons are found, but often the ambiguity remains and there may never be closure. Dealing with these situations requires the ability to live with ambiguity. Usually there is no easy answer, and the temptation to solve these problems only exacerbates the experience of ambiguous loss, because it holds out the prospect of closure or resolution when there is none.

Mike Bocking is eye-ing a seat in the B.C. Legislature for the sec-ond time.
The Silverdale resi-dent has now laced up his running shoes and is campaigning for the May 14 provincial election. Bocking is hopeful an earlier start will give him the edge he needs in the Maple Ridge-Mission riding after losing by 68 votes to the Liberals in 2009.
In the last election, the NDP nomination meet-ing was held a month and a half before the election, but this time, Bocking was given the nod this past November to repre-
sent the party.Bocking has opened
his campaign office in Maple Ridge (22618 Lougheed Hwy.) and will be sharing an of-fice in Mission with NDP Abbotsford-Mission can-didate Preet Rai.
He is also busy meet-ing with groups and speaking to individuals about topics of concern.
“It’s time for a change,” said Bocking, pointing to issues like trust and accountability that are important to the public. From the Harmo-nized Sales Tax to the
$2 billion deficit, Bock-ing says voters have lost trust in the BC Liberals.
“The NDP is saying, change for the better, one practical step at a time,” said Bocking, noting under Adrian Dix’s lead-ership, the NDP will be careful about the prom-ises they make and will explain how each one is sustainable. “We’ve learned from watching the Liberals.”
Local issues Bocking will be fighting for are health care and the envi-ronment.
Bocking has fought against the downsiz-ing of Mission Memo-rial Hospital and has pro-tested the closure of its emergency room.
It was only after week-ly demonstrations the Liberals backed down from locking the emer-gency room doors, said Bocking.
The NDP wants to make health care sus-tainable and lower the cost of prescription
drugs, he added.Bocking is also con-
cerned about the gravel mining patchwork that exists in this province.
“I want to take a more measured and coordinat-ed approach to mining activities,” he said, add-ing the activity is gov-erned by legislation de-veloped in the late 19th century or early 20th century.
“We have to be far more sensitive to the ef-fect on the community and the environment. Big chunks of Mission and the surrounding areas sit on gravel from the last ice age. There needs to be a balance between property owners and those who want to ex-tract gravel.”
Bocking is president of the Communications, Energy and Paperwork-ers union local 2000 and has lived in Silverdale with his family since 1998. Mike and his wife Kelly have three daugh-ters and one grandchild.

The Pacific Carbon Trust orchestrated a months-long campaign of calls
and letters to discredit a report from B.C.’s Auditor General on its first two big carbon offset projects, before it could be released.
Just as the audit report was about to be made public, the trust, a Crown corporation created at taxpayer expense, participated in the leaking of selected critical letters to media outlets.
Then the Speaker of the B.C. legislature, Bill Barisoff, made a final, clumsy effort to delay the release of the report.
As soon as it was out, En-vironment Minister Terry Lake tried to discredit it, by blustering about all the highly paid experts who swore up and down that a forest reserve near Kootenay Lake, and a gas flaring reduction project near Fort Nelson, were bona fide carbon offsets worth $6 million of taxpayers’ money.
The audit states in plain lan-guage, with charts and time-lines, that the $6 million was basically given away for noth-ing. I look forward to further audits on this carbon offset scheme, assuming it survives
after the May election, be-cause these two projects aren’t the only boondoggles.
The Pacific Carbon Trust was set up in 2008 as part of former premier Gordon Campbell’s climate change program. To make the B.C. government’s operations “car-bon neutral,” the government and all of its agen-cies were required to pay the trust $25 per tonne for their carbon dioxide emissions from fuel use.
In 2011 alone, B.C. universities paid $4.46 million to the trust. B.C.’s 60 school districts paid a total of $5.36 million the same year, and the prov-ince’s six health authorities paid $5.79 million. The money is supposed to go to projects that capture carbon, thus “offset-ting” the heating of schools, the fuel burned by ambulanc-es and so forth.
The 55,000-hectare forest reserve is known as Dark-woods. The audit shows that the Nature Conservancy of
Canada decided in 2006 to buy it, using $25 million of federal taxpayers’ money. The deal closed in 2008, the same year the Pacific Carbon Trust was formed.
From 2008 to 2010, the trust bought 450,000 tonnes of carbon offset, based on independent evaluations that
all rested on the assumption that Darkwoods would
be clear-cut logged.Since the forest
was already owned by Canada’s leading conservancy, this assumptiton makes no sense. Was the conservancy going to log it, or flip it to someone who would, after accept-ing $25 million in tax money to ac-quire it? Legally, it
could not.(I would add that the as-
sumption that logging releases all of the carbon in a forest is also false. Lumber actually sequesters carbon for longer than trees, which eventually die and rot.)
The audit found a similar case against EnCana’s flare
reduction program, which the company used on many wells before the trust started offer-ing money. EnCana was sav-ing money as well as reducing emissions without collecting offsets. Therefore, the audit concluded, neither of these projects was a credible offset because the emissions savings would have occurred anyway.
Here’s the next Pacific Car-bon Trust project that should be audited. In a complicated transaction, the trust bought offsets from something called the Great Bear Carbon Credit Limited Partnership. Yes, this is the world-famous forest on B.C.’s North Coast that was subject to a preservation deal hammered out between the Coastal First Nations, the B.C. government and three U.S.-backed environmental groups.
That was in 2006. The off-set purchases were in 2009 and 2010, years after detailed preservation areas were mapped and codified in law.
Again, the trust paid for for-est that was already preserved.

Provincial Sales Tax on April Fool’s Day.The rollout of the Harmonized Sales Tax by then-
Premier Gordon Campbell was a colossal bungle during his time in office. The HST was praised by economists as sensible tax policy, and approved by many in the business community as easier to ad-minister. But too many people felt betrayed by the way the tax was introduced, particularly due to the fact it came on the heels of an election where no mention of the HST was made.
And after the damage had been done, no attempts at explanation could turn the tide of opposition.
In the summer of 2011, residents had their say in a province-wide referendum, rejecting the HST in favour of a return to the PST. So here we are, again. Back in a world with two taxes, the GST with a few exemptions, and the PST with quite a few. There’s a great explainer on the provinces website to untangle it all — just visit http://gov.bc.ca/pst and click “What’s taxable, what’s not.”
Suffice to say, for many things the average British Columbian will save money with the return to the PST. On things like home repairs and renovations, child safety equipment, smoke detectors, bikes, movie tickets, golf memberships, haircuts, basic cable, gym memberships and buying a new house, the return of the PST is good news and will mean significant savings.
The unfortunate impact, however, is the loss of the provincial rebate of up to $230 a year for low-income individuals, which now drops to $75. As usual, the most vulnerable feel the shift most keenly. Meantime, the rest of us will adjust, as we always do.

Mission Elks, Save On Foods and all the won-derful volunteers who gave up their Easter Sunday for the annual Easter Egg Hunt at Fra-ser River Heritage Park.
It is with great dis-appointment in many of the Mission resi-dents that I write this letter. You people, and you know who you are, need to stay home from these events. This was for children and if you were a kid in amongst all those adults you were sure to be hurt.
There was so much pushing and shov-ing and not listening to the announcer I am ashamed to have been around such rude peo-ple. You wreck it for the kids, many of whom will never go back due to parents who are also disgusted.
I would suggest to the great people who put this on to maybe spread it out a bit. It is a huge park and if you split it up the crowds won’t seem as bad and maybe it will be a bit easier to control.
Again, thank you for doing this for the kids, even though this insan-ity was present.

The finance department cashiers have moved downstairs to the lower floor, along-side the development services and engineering departments.

Due to the huge popularity of last year’s compost giveaway event, we are doing it again. A big thank you to all Mission residents who have embraced the idea of using their Rot Pots for diverting food waste from the landfill. You are making a big difference; curbside compost tonnages are up by 60 per cent.
Reward yourself by picking up your free Rot Pot compost at the Mission Landfill (32000 Dewdney Trunk Rd., just east of the Stave Lake dam) on April 20, between 10 a.m. and 2 p.m. There will be enough for everyone, so please make use of the entire time window to avoid unnecessary delays.
Quantities will be limited to one cubic yard per customer (District of Mission residents only, please). Bring your pickup truck to be loaded by
machine, or bring a shovel and a container to pack up some compost yourself. Please note that Rot Pot compost is not a potting soil, but intended to be mixed into existing flower and vegetable beds as a soil conditioner and slow-release fertilizer.
Larger quantities (upwards of 15 cubic yards) of Rot Pot compost can now also be purchased directly from the processor. Please phone 604-826-7379 for additional information. District staff will be cleaning water mains beginning April 15, 2013 for approximately five weeks in the following areas generally described as:
• West Heights area south of Seventh Avenue
• Gill Avenue industrial park
• Flats area from CPR tracks to Harbour Avenue
• Hatzic area from Lougheed Highway to
McEwen Avenue• Shook Road, Moore
Avenue, McKenzie Street, Benbow Street
These areas represent about 20 per cent of the entire water system. Work will begin at 10 p.m., beginning Mondays and will be completed by 5 a.m., ending on Fridays. Each night an area of approximately five city blocks will be cleaned. The process will create extremely
discoloured and debris-laden water as the water main side walls are scoured to remove accumulated debris. It is extremely important that water users do not use any water including hot/cold water taps, toilets, etc., during the cleaning process.
District staff will be delivering a notice to the affected areas which will provide more detailed
information about the program and scheduling, to your mailbox, mail slot
or front door on the morning of the work proceeding through your neighbourhood.

Join the Adopt-a-Block Society for Earth Day April 21 from 11 a.m. to 3 p.m. for an afternoon of activities for all ages. There will be a street litter cleanup, gardening projects and children’s activities including barrel painting, crafts table, mural painting, and planter decorating.

The Hatzic Elementary School stu-dents were selected last Thursday by a group of seven judges who studied each display and interviewed the creators. Students were judged on the project content, its importance to Canadian his-tory, and presentation.

More than 35 volun-teers hit the streets March 17 to pick up litter along Lougheed Highway as part of Adopt-a-Block’s St. Patrick’s Day Pick ‘n Pub event.
The second annual af-fair was a success, ac-cording to organizers as in excess of 500 lb of litter was removed from the stretch of road from Cloverdale Paints to the Mission RCMP station. Some of the more unique finds were car parts, an office chair, soccer ball, clothing and Japanese kids’ books.
Volunteers were feted with a $10 Sunday brunch at Rockwell’s Bar and Grill, plus games and prizes donated by down-town businesses.
The group’s next big event is Earth Day on April 21 at the Adopt-A-Block office. For more information call 604-826-9423.

Feb 12, 1930-March 23, 2013Surrounded by family, John passed away at home on March 23, 2013. A much loved husband, father, grand-father and loyal friend, John leaves to mourn, his wife Rose, sons Rodney (Tom) and Brian (Bryan), step-children Fiona (Kent), Lorna, Ruth (Doug), Dawson (Elizabeth). Missing their Poppa are grand-children Devon, Chris, Sean, Chelsea, Curtis, Jasmine, Thomas, Brandon, Daniel and Violet and great grand-daugh-ter Brooklyn. Also grieving are Nephew Boyd (Lorraine, Jen-nifer), Niece Lesley (Al, Mi-chael) , cousins including Les-lie, Patsy, Richard, Colin (Christina) and Chris, John’s many friends and his dog Mol-ly. John was predeceased by his father Frederick, mother Joan and sister Sheila.John was born in Winnipeg. He completed his B.Sc (geolo-gy) at the University of Manito-ba. Following his early career as a geologist (survey and oil fi eld geophysics) John took teacher training at UBC. He found his vocation teaching high school math and science for over 30 years (3 years in Langley and then at Mission Secondary School).Special thanks go to Dr. Scott Bakker, Chilliwack Hospital staff, Home and Palliative Care services for their wise, compassionate care. Thanks also to dear friends El, Woody and Suzy who helped ease John’s fi nal days.Johnny-the-rock will be re-membered as a loving, gener-ous, smart, funny man whose interests spanned history, poli-tics, geology and fi lm. SEPT; Bud(GT) Bud Sept, the only child of George and Josephine, born October 13, 1927, in Medicine Hat, Alberta, died peacefully March 30, 2013 at age 85 surrounded by his family. Bud was predeceased by his loving fi rst wife Betty and is survived by his devoted wife Barbara. He will also be missed by his loving daughters Bobbi and Joanne (Norm), step children Kim (Doug), Rick (Eileen), Roxann (Rob), and Kirk as well as 12 grandchil-dren, 4 great grandchildren, and many friends. Bud was a successful business man and retired with a lifetime member-ship in the Life Underwriters Association of Canada. He lived life passionately with many community contributions,including fi refi ghting (Quesnel) and as President of both the Kinsmen Club and K40 (Mis-sion). Bud’s contributions to health care awarded him an Honorary Life Membership with Mission Memorial Hospi-tal for his service as Chairman of the BC Health Association, President of the Canadian Long Term Care Association, and many years on the hospi-tal board, as well as the Board of Pleasant View Care Home. Bud embraced life through his love of people, music, fi shing, building homes, RVing and time spent in Vernon. Bud had a passion for travel that led him around the world. He will always be remembered for his positive attitude, sense of hu-mor, boisterous laughter and helping others. A Celebration of Life will be held at St. Paul’s Presbyterian Church, 8469 Cedar Street, Mission on Fri-day April 5th at 1:30 pm. The family wishes to thank Dr. Keith Wong and the staff at Pleasant View for their loving care. In lieu of fl owers, dona-tions in memory of Bud can be made to Pleasant View Care Home.
