INDIAN PHARMACEUTICAL INDUSTRY IN 2012-13 – AN OVERVIEW
1. Pharmaceutical Exports of India
Drugs, Pharmaceuticals and fine chemicals have been Fifth largest exported principal commodity of the country accounting for 4.83% of India’s total exports. In line with last two decades India’s pharmaceutical industry, has achieved a positive trade balance and the initial estimates puts it around USD 8.75 to 9.0 billion.
As per the latest Periodic statistics released by Director General of Commercial Intelligence & Statistics (DGAFRICA), Kolkata, India’s Exports of Drugs, Pharmaceuticals & fine chemicals for the period Apr. 2012 to March 2013 stood at INR 79,410* crore recording a growth rate 25% over the corresponding period of previous year. Exports have grown by a CAGR of 18.39% over the period 2008-09 to 2012-13.

During 2012-13 India’s exports of finished dosage forms is likely to be in the region of 64%, bulk drugs in the region of 34.8 and herbals 1.2%. Finished dosage forms contribution is on the increase which indicates increased recognition of India’s pharmaceuticals world over.
The top 25 destinations of India’s pharmaceutical exports with values are given below. USA remains the top export destination with a share of 24.6% amounting to 20,239 crore and a growth of 29%. Among the top 25 export destinations exports to Russia, South Africa, Brazil, Ghana, Japan & Iran have shown remarkable growth with over 30%, with growth in Exports to Iran topping the list with 81%. Among the other major export destinations, exports to Nigeria, Canada, Kenya, Netherlands, Vietnam, Turkey, Australia, Singapore, Ukraine & Belgium have grown over 20%.

2. India In global arena:
To-day India’s pharmaceutical industry is known “Global pharmacy of the world”. India offers almost every product which has gone off patent and with a large vendor base. India’s filings of DMF’s with USFDA as of march 2013 is 3000, the highest filed by any country in the world. The below table gives complete tally of accreditations India’s exporters have received from various countries regulating authorities.
3. Opportunities for Growth
In spite of considerable achievements, several untapped business segments and markets exist and the room to enhance the country’s pharmaceutical exports is vast. The sophisticated chemistry capabilities, lateral thinking abilities in developing non-infringing processes, disciplined approach to adhere to any stringent guidelines, dedication for manufacturing excellence, etc., make India as a most favorites destination to source or outsource various components of value chain. In addition, despite our success, we are still at the periphery of this vast opportunity.

According To IMS calculations Global spending on medicine will reach USD 1100 billion by 2015,
at a growth rate of 3-6% from now on, which in fact is slower when compared to the growth rate
between 2005 and 2010 which was over 6%. Since number of efforts are being made all over
the globe to use the money spent on Health expenditure more efficiently, the focus on generics
seem to rise as it help stretches every Dollar spent longer. US share of global spending on
medicines which is now 41% is estimated to come down to 35%, while spending of high growth
17 markets led by China is likely to go up. The significant change in composition of spending
globally would be that 39 to 40% would be on generics instead of present 27%.
India as of now is poised well to take on those opportunities with their chemistry skills and the
best regulatory accreditations and the largest no of Market authorizations a single country can
ever have. The generic market is expected to touch USD 400 billion by 2015 and 70% of it is
expected to be spent in the countries of other than developed. India in the year 2009-10 has
exported 70% of its total to these markets.
A number of leading drugs go off patent every year and the generic pharmaceuticals
penetration is increasing in all the countries of the world further raising the opportunity for
exports in this segment. In 2011 USD 30bn worth of products went off patent. In USA alone
these products (mostly lipid lowering agents) are commanding a market of USD 17 billion with
93 million prescriptions. By generic market estimation the size may get reduced to USD 3bn
approximately. That is an extra USD 3 billion market opportunity opening up for generic
manufacturers. In fact the Pharmaceutical industry is now on the verge of reaching a patent
cliff. Intense science, good understanding of patents and manufacturing to the stringent
requirements of access regime, are key requirements for future success in this opportunity.
India has the requisite capabilities. Hitherto most opportunities emanated from synthetic
chemistry. The opportunities in biopharmaceuticals will be the major attraction in the next
decade. New technologies and enhanced regulatory requirements are changing the rules of
the game making production migrate to east.

EXPORT PROMOTIONAL ACTIVITIES UNDERTAKEN DURING THE YEAR 2012-13
a) Southeast Asia Pharma & Healthcare show:
Council organized India Pavilion at Southeast Asia Pharma & Healthcare Show held during 17-
19th April 2012 at Kuala Lumpur, Malaysia. 22 companies participated in the event. It was 2nd
time Council participated in the event.
b) Visit to Ukraine and Azerbaijan
At the instance of Department of Commerce, Director General took part in the Indian
delegation to Ukraine and Azerbaijan, under the leadership of Shri Ravi Kapoor, Joint Secretary,
Department of Commerce during 11-18th April 2012. During the visit to Ukraine, it was
understood that that pharmaceuticals’ exports to Ukraine have almost come to a stagnant
position due to various reasons. The Ukrainian authorities have notified that they would
register medicines exported from countries which are members of PICS only. In case of
medicines which are to be imported from other countries, like India (who is not a member of
PICS), product registrations would be granted based on actual inspection by Ukrainian
authorities and full analytical testing of imported medicines, consignment-wise. In view of the
above, the exports of pharmaceuticals to India have been adversely affected and several
representatives of Indian pharma companies working in Kyiv (Ukraine) have requested
Pharmexcil to take immediate measures for improving the situation. Council took up the issue
and arranged for signing of MOU between Ukraine FDA and DCGI.
c) IPhEB, St. Petersburg:
Council participated in the 2nd edition of exhibition-cum-Conference for the first time by
taking about 180 sq.meters of space. Fourteen member companies participated in the event.
Meeting with local importers were organized with the help of organizers and Indian Mission.
d) Africa Health:
Council participated in Africa Health held at Johannesburg, South Africa during 9-11th May
2012 for the first time by organizing India Pavilion in 180 sq.meters of space. Though the
participants in our pavilion got reasonable business enquiries, the event being only the 2nd
edition, the visitors flow was not up to the expectations of participants.
H.E. Sri Virendra Gupta, High Commissioner of India in South Africa along with Sri Nandan
Singh Bhaisora, Acting Consul General in Johannesburg visited India Pavilion and interacted
with participants in our pavilion. He briefly explained about pharmaceutical market in South
Africa. Undue delays in issue of visas by South African embassy in India were brought to his notice
and he assured that he would take up this issue with external affairs ministry of South Africa.
International Events:

e) CPhI SEA
As part of Brand India Pharma project, Council participated in CPhI Southeast Asia held during
10-12th May 2012 at Jakarta, Indonesia. 35 member companies participated in the India
pavilion. Initially there was lots of resistance from local industry and government for extending
support to our Brand India Pharma Campaign. Even the Embassy was finding it difficult to get
support. However, after talking to senior members of local associations, an extremely strong
body in Indonesia, things have improved and highly successful Press Conference and Business
Seminar could be organized. Chairman and Vice-Chairman of GP FARMASI (National
Association) themselves participated actively in the business seminar. With the continued
efforts of Embassy, senior officials from Indonesian FDA also participated and made good
presentation. His Excellency Ambassador delivered his introductory speech and attracted
appreciation of all participants with his offer for collaborative investment in Indonesia. The
Department of Pharmaceutical services, Govt. of Indonesia has also sent an officer indicating
its interest to discuss with Pharmexcil / Government of India for attracting investment in their
API sector .
f) CPhI China 2012
Council participated and organized India Pavilion at CPhI China held during 26-28th June 2012.
Ten member companies participated in the pavilion. It was 3rd time Council participated in the
event.
g) Expo-BSM in Arogya, Sri Lanka – 17-19th August 2012
For the first time, Council organized Expo-cum-BSM in Sri Lanka during 17-19th August 2012.
At the advice of Indian Embassy in Sri Lanka, this BSM was organized along with ‘Arogya’ which
was organized by Government of Sri Lanka. 22 companies participated in the Expo. With help
of Indian embassy, Chamber of Commerce of Sri Lanka and local professional event managers,
Council made elaborate arrangements to invite local pharma buyers to the Expo. Over 200
pharma buyers visited and had business discussions with the exhibitors.
A few weeks before the above event, Hon’ble Minister for Commerce & Industry , Govt. of India
visited Sri Lanka, who assured the Sri Lankan Government all help from India in setting up
Industrial Parks in Sri Lanka. Subsequently, a Task Force was formed, where Executive Director
is one of the members. At the instance of Indian High Commission in Sri Lanka and officials of
department of Commerce, a delegation headed by Director General, comprising of
representative of five companies and Ramky Pharmacity, Executive Director of Pharmexcil,
visited Sri Lanka and held meetings with Ministry of Industries/Health to explore the
possibilities of setting up Pharma Industrial Parks in Sri Lanka. The visit of Indian delegation
was well publicized in the local papers. Government of Sri Lanka is very keen to set up Industrial
Parks in association with Govt. of India. Subsequently, Ramky Pharmacity had submitted a
proposal to Sri Lankan Government.

h) Delegation to LAC countries 1-15th Sep 2012
A trade delegation to Mexico, Guatemala, Panama and Costa Rica was organized during 1-15th
September 2012. Twenty one members participated in the delegation. One-to-One meetings
and Meetings with FDA officials were organized in all the places with the help of respective
Indian embassies.
i) Annual Meet – 26-28th Sep 2012
Council celebrated its 8th Annual Meet during 26-28th Sep 2012 coinciding its Annual General
Meeting at Hyderabad. Following activities had been organized during the Meet:
India – Asia Pacific Pharma Business Meet: 82 delegates from 68 pharma companies from 14
Asia Pacific countries attended the Business Meet and over 270 Indian delegates participated
and had fruitful business discussions.
Pharma CEOs Conclave: For the 3rd time, Council organized Pharma CEOs Conclave on 27th
Sept 2012. CEOs of Ranbaxy, Shasun, Laurus Labs, Vimta Labs, Natco Pharma have
participated in the Panel Discussion and Mr. Venkat Jasti moderated the discussions. Members
of Panel as well as participants actively participated in the discussions and expressed their
views / concerns on Indian Pharma’s target of achieving 25bn exports by March 2014. Sri J S
Deepak, Joint Secretary, who was the Chief Guest of the Conclave, positively received the
opinion of the participants and assured all possible assistance from Government of India.
Export & Patent Awards: Council conferred Export & Patent Awards to over 60 deserving
member companies. Sri Rajasekhara Vundru, Joint Secretary, Department of Pharmaceuticals,
Sri R P Thakore, Director General, AP Drug Control Administration had distributed the Awards.
j) CPhI Worldwide 2012
Brand India Pharma campaign, launched in CPhI Japan in March 2012, was continued in CPhI
Worldwide 2012. India was declared as focus country by the organizers of CPhI. Council
organized Business Seminars, Press meetings, participation in Innovation Awards, One-to-One
Meetings, Cultural programmes etc., with the help of Indian embassy in Spain and IBEF.
Secretary, Additional Secretary and Join Secretary of Department of Commerce participated.
The theme pavilion and India pavilion were well appreciated by the members and media.
Council advised all the member industries to extensively use the Rx logo so that the effect of
Brand India Pharma lasts long
k) Supplyside West:
Council participated in Supply Side West for the 3rd time by organizing India pavilion. There
were 10 companies participated through our pavilion. In view of better location this time, the
participants got good response and appreciated the efforts of Council.

l) Medica 2012:
Council participated in Medica 2012 held during 14-17th November 2012. This is 2nd time
council participated in the event. There were 10 companies participated in India Pavilion.
During Council’s participation in the previous year, there were some problems as part of the
area allocated was facing to the wall. This time, with lot of persuasion, the organizers divided
big block into the two parts so that there was more visibility to the participants.
m) CPhI India:
Council organized India-Pharmexcil Pavilion in CPhI India held during 21-23rd November 2012.
This was the 7th time Council participated in the event. As in the previous years, members
received good response during the show. Brand India Pharma designs were continued in this
event also.
n) Apteka
Council participated in Apteka held during 3-6th December 2012 at Moscow. Twenty one
companies took part in the India Pavilion. A BSM was organized in the same venue with the
help of our Mission in Moscow. His Excellency Ambassador of India in Russia attended event
and interacted with the participants.
o) Trade delegation to CIS countries
A Trade delegation to CIS countries (Russia, Moldova, Belarus and Turkmenistan) was organized
during 2-15th December 2012. Twenty four companies participated in the delegation. One-to-
one meetings with the local buyers and meetings with FDA officials were organized with the
help of embassies in all the four countries.
p) International Buyer-Seller Meet at IPC
Council organized International Buyer-Seller Meet coinciding 64th IPC held at Chennai during
7-9th Chennai. 36 prominent buyers from 22 countries were invited for the Meet and over 100
Indian delegates took part in the Meet
q) International Buyer-Seller Meet at World Ayurveda
Council organized International Buyer-Seller Meet coinciding 5th World Ayurveda Congress
held at Bhopal during 9-11th December 2012. Twenty five buyers from various countries and
over 110 Indian delegates participated in the Meet.
r) Trade delegation to Iran
At the instance of Department of Commerce, Council organized a trade delegation to Iran
during 17-19th December 2012. Twenty six companies participated in the delegation. Indian
Embassy in Iran and local Chamber of Commerce had extended its full co-operation in
organizing Business Meetings and meetings with Drug Regulatory authorities. As per

feedback, all participants got good response in the Business Meetings. Subsequent to the
delegation, Embassy sent a list of medicines in shortage, which do not require registration /
plant inspection. The list of was circulated to the members immediately.
s) Delegation to ASEAN countries
Council organized a trade delegation to Vietnam, Taiwan, Philippines and Singapore during 13-
26th January 2013. Mrs. Mridul Jain, Joint Secretary, Department of Commerce joined the
delegation for two countries i.e. Philippines and Singapore. Apart from organizing BSM in all
the places, a press conference was organized in Philippines and Biotech related conference in
Singapore. All the meetings were well attended by the local pharma companies. Delegates
from about 26 Indian companies benefited from the meetings.
u) RBSM at Vibrant Gujarat
International Business Meet inviting buyers from African countries was organized coinciding
Vibrant Gujarat during 8-10th January 2013 at Ahmedabad. There were about 60 buyers from
African countries and over 260 Indian delegates. Participated in the one-to-one meetings.
t) Arab Health
Council organized India pavilion at Arab Health 2013 held during 28-31st January 2013. 32
companies participated in the pavilion. It was the 8th time council participated in the event.
More pharma companies are interested to participate in this event in view of increasing
enquiries for pharma products from the visitors from Africa and GCC countries. During the
exhibition, all the visitors were informed about IPHEX and also efforts were made to identify
the buyers who can be invited as sponsored buyers.
v) Bio Asia
Council organized Business Meet/Technical Conferences on the occasion of BioAsia held at
Hyderabad during 28-30th January 2013 by inviting 30 international delegates. It was a good
opportunity for the overseas delegates to understand the developments that were taking place
in biotech / biopharmaceuticals front in India
w) BSM / Expo at Algeria & Nigeria
Council organized a BSM at Algeria and Expo at Nigeria during 3-8th March 2013. There was
good response from the members to participate in the event. 56 companies comprising of 76
delegates participated in the event. There was good response from the local buyers also.
About 120 delegates in Algeria and over 780 in Nigeria attended. In Algeria, His Excellency
Indian Ambassador, senior officials from Indian Embassy, big local pharma company
representatives participated in the dinner meet. His Excellency explained briefly about
Algerian markets, drug regulatory systems etc. For the benefit of local pharma companies, His
Excellency explained in detail about Indian pharma industry and its strengths, in French

language. The pre-event efforts of Indian embassy and our event manager showed good
results as there were about 123 local pharma delegates who attended the meet and interacted
with the Indian pharma delegates. As per the feedback received from Indian companies, all the
participants got good business leads.
In Nigeria, a dinner meet was organized by Pharmexcil at the Indian High Commissioner’s
office. His Excellency High Commissioner of India Sri Mahesh Sachdeva explained about
Nigerian markets, drug regulatory systems, strengths and weaknesses of Nigeria which have to
be considered while doing business with Nigeria. Sri Rajeev Kher , Additional Secretary also
addressed the gathering. Expo was inaugurated by His Excellency Sri Mahesh Sachdeva. Sri
Rajeev Kher, Additional Secretary, Department of Commerce, Govt. of India and Dr. Paul Ohrii,
Director General of NAFDAC, Nigeria were the other dignitaries on the dais. His excellency
said that Council’s efforts in operating a warehouse in Nigeria would help the Indian exporters
to stock and distribute their products. Press and media present in the inaugural meeting had
interaction with His Excellency High Commissioner and Additional Secretary, Director General,
NAFDAC, and Director General Pharmexcil.
Additional Secretary, Director General and Executive Director visited place where it is proposed
to open a warehousing facility by Pharmexcil for the benefit of exporters to Nigeria.

National Events:
a) Sri Lanka delegation to Hyderabad
There was a communication from High Commission of Sri Lanka in India stating that a high level
delegation lead by Hon’ble Dy. Minister for Industries, Government of Sri Lanka was visiting
India during 19-21st April 2012. The main purpose of their visit was to understand the
functioning of pharma clusters in India. The High Commissioners office requested Pharmexcil
to make arrangements for their visit to some clusters. Though it was not under purview of
Council, arrangements were made to visit to Genome Valley in Hyderabad and Pharma City in
Vizag. The delegation was well received by the organizers of Genome valley and Pharma City. A
mail was received from the Srilankan High Commissioners’ office appreciating the assistance
rendered by Pharmexcil.
b) Interactive meeting with DCGI:
On the occasion of Dr. G N Singh, DCGI visit to Mumbai, an interactive meeting was organized
on 26.4.2012, where about 20 members along with some of the Committee members attend
and discussed about various issues. Subsequently, a circular was issued to all members to
inform their issues so that all the issues would be compiled and submitted to DCGI for
consideration.
c) USFDA workshops
In association with DIA & US FDA, Pharmexcil organized workshops on Generic Drug
Applications with US FDA at Mumbai, Hyderabad, Goa and Chandigarh on 30th April, 2nd, 4th,
7th May 2012 respectively. Two senior officials from US FDA participated in the workshops.
With the financial support from Department of Pharmaceuticals, Council offered a concession
of Rs.2000/- per participant, subject to a maximum of 40 participants at each place. Since it
was an important and useful subject for the members, Council put efforts in communicating to
the members about the workshops. There was good response for the workshops at all the
places. Over 200 professionals participated.
d) Interactive meeting with Controller General Patents:
On the occasion of Sri Chaitnya Prasad taking over as new Controller General of Patents,
Pharmexcil organized an interactive dinner meeting on 2nd May 2012 at Mumbai. Joint
Secretary of Department of Pharmaceuticals also participated in the meeting.
e) Visit of Hon’ble Minister to Brazil 14-17th June 2012
At the instance of Department of Commerce, Council joined the delegation led by Hon’ble
Minister for Commerce & Industry to Brazil during 14-17th June 2012. Representatives of
Fifteen of our member companies joined the delegation. Executive Director participated on
behalf of Council

f) Meeting with DCGI at Hyderabad
During the visit of Sri G N Singh, DCGI to Hyderabad on 196.2012, an interactive meeting with
Pharma related associations was organized by the office of DDC(I). Sri Venkat Jasti, Dr. V
Satyanaryana, Director General and Regional Director attended on behalf of Council. A circular
was sent to members informing about the meeting and collected inputs. A presentation
compiling the issues raised by members was presented by Director General in the meeting.
g) Interactive meeting with Ambassador designate to Tanzania
Sri Debanth Shah, Ambassador Designate to Tanzania was in India during the last week of June
2012, who was keen to meet the pharma exporters to Tanzania and find out issues, if any.
Accordingly, an interactive meeting was organized on 22nd June 2012, which was well attended
by our members.
h) IPR & Regulatory meeting
With fund support from Department of Pharmaceuticals, a seminar on IPR and Regulatory
matters was organized on 22nd June at Mumbai. Dr. Gopakumar Niar, Mrs. Rubeena Ansari,
Mrs. Andreya Fernades, Dr. S Padmaja, Dr. Mlind Joshi made presentations on IPR and
Regulatory subjects.
i) Interactive meeting with DG, AP Drug control administration
With a view to help the exporters of AP State to interact with the Director General and other
senior officials of AP Drug Control Administration, council organized a meeting on 5th July 2012
at Hyderabad. About 60 members participated and interacted with the officials.
j) Consultative committee meeting
Department of Commerce held First Pharma Consultative Meeting under the chairmanship of
Hon’ble Minister for Commerce, Industry and Textile on 3rd July 2012. Sri Lanka Srinivas made
a presentation as member of the group. Council provided the assistance as required by DoC.
k) Seminar on Regulatory / IPR at Chennai
With the financial assistance from Department of Pharmaceuticals, Council had organized a
Seminar at Chennai on 24th August 2012 on Regulatory & IPR. Advisor – Patent Facilitation
Center had assisted the council in organizing the event successfully. About 50 members
participated.
l) Seminar on Recent changes on Service Tax
Hyderabad Chapter of Rotary club organized a seminar on recent changes on Service Tax on 22-
08-2012. Council co-organized the event by extending a nominal financial assistance to the
organization. Good number of our members also participated and got clarifications on Service tax

m) Interactive Meeting with European Commission
On the occasion of Mr. Stefan Fuehring, Policy Officer, looking after quality, safety and efficacy of medicinal products in the Directorate General of Health and Consumers, European Commission visit to Hyderabad, Council organized an interactive meeting on 13.9.2012 at Hyderabad. He made a presentation on Quality of Medicines and Technology Solutions on Falsified Medicines and EU Directive on New rules on importing APIs into the European Union. About 60 members participated and interacted with him.
n) Interactive meeting with senior officials of AYUSH department
Joint Secretary and other senior officials of Department of Ayush Department, New Delhi had visited Hyderabad on 15th Sept 2012 on the occasion of Bio-diversity programme. Taking advantage of their presence in Hyderabad, Council organized interactive meeting with them for the benefit of members in AYUSH sector. CEO of AP Medicinal Plant Board, CEO of National Medicinal Plant Board, Director of CIMAP, Commissioner of Ayush also participated and interacted with the members. About 35 members participated in the meeting event with short notice.
o) Interactive Meeting with Chairman of Exim Bank
Council organized an interactive meeting with the Chairman of Exim Bank on 30th November 2012 at Hyderabad. About 30 members attended the meeting and interacted with the Chairman and other senior officials of Exim Bank. Presentation made in the interactive meeting was made available in the website.
p) UKTI-FDCA Meetings:
Council associated with UK Trade & Investment in organizing interactive meetings at Mumbai, Hyderabad and Ahemdabad. In order to take advantage of senior officers visiting from MHRA, Council organized meetings with DCGI also at Delhi.
q) Market Quick start programme
For the benefit of members in Herbal/Nutraceuticals sector, Council, in association with Engredea, USA organized a ‘Market Quick Start programme’ on 3rd December 2012 at Hyderabad. About 25 companies participated in the meeting.
r) Interactive meetings with GS1 at Ahemdabad and Mumbai
At the instance of DGFT, GS1 organized workshop/webinars at Mumbai and Ahmedabad on
17th and 19th December 2012 to enlighten the exporters about bar coding on secondary
packing. During the interactive meetings, there were some issues as regards to mono cartons.
As per earlier GS1 guidelines, mono cartons were considered as Primary packing, which was
later on changed to Secondary packing. It was understood that GS1 stated that the change was
made at the instance of Council, whereas there was no such communication from Council side
to this effect. Secretariat immediately took up the issue with GS1. Subsequently, GS1 made
the necessary changes in the guidelines making mono cartons as Primary packing.

s) Interactive meeting with Unani exporters:
At the request of Medicinal Plant Board, AP, Council organized an interactive meeting with the
exporters of Unani medicines on 22nd December 2012 at Hyderabad. About 20 exporters
participated and interacted with the officials of Medicinal plant board.
t) Interactive meeting on EU directive & IPHEX at Mumbai
Keeping in view importance of the issue of EU directive, Council organized an interactive
meeting on this subject on 4th February 2013 at Mumbai. This meeting was well attended by
members, who appreciated the efforts of Council. During this meeting members were also
informed by Council’s flagship event ‘IPHEX’ and invited their participation.
u) Meeting with Serbian visitors
Council received a communication from Embassy of Serbia that some pharma companies was
visiting India looking for herbal/dietary products. Council circulated the information to the
members asking them to fix up meetings with the delegates directly. As many members could
not get opportunity to meet them, Council organized a dinner meet also on 21st February 2013
with the Serbian pharma companies and many members participated and interacted with the
delegation.
v) Interactive meeting on Foreign Trade policy
At the advice of Jt. DGFT, Hyderabad, an interactive meeting with the exporters was organized
on 14th February 2013 at Hyderabad. Council compiled all the points/issues received from the
members and submitted to the senior officials attended the Interactive meeting from Ministry
of Commerce/DGFT.
w) Meeting with Ambassador in India on IPHEX
A meeting with Ambassadors of various countries in India was organized in New Delhi to inform
about launching of IPHEX. Road Shows also organized in Mumbai and Ahmedabad.

Other Important activities under taken / Representations made:
a) New EU Directive for export of APIs:
European Union had announced a new Directive for export of APIs which comes into effect from 1.7.2013. As per the new directive, either India is to be listed as one of the countries conforming to EU GMP or every API exporters to EU are required to submit a Written Confirmation issued by a Competent Authority stating that the unit conforms to WHO GMP standards. Immediately after announcing this Directive, Pharmexcil, after consultation with the industry, represented to Department of Commerce / DCGI explaining the implication of the Directive. Based on the feedback from industry during many interactive meetings organized by Pharmexcil, Government announced DCGI as Competent Authority for issuing Written Confirmations. After the announcement of Competent Authority, Council interacted with office of DCGI & industry in finalizing the guidelines for issuing Written Confirmations.
b) Bar coding:
With the vacation of stay order on implementation of bar coding by Hon’ble High Court of Madras, notification issued by DGFT on bar coding on secondary & primary packing with effect 1.7.2013 had become compulsory. As industry was not ready for implementing bar coding on primary packing, Council made several representations for exemption of bar coding on primary packing. Considering the requests from industry, Department of Commerce extended the time for implementing bar coding on primary packing till 1.7.2014. Thus bar coding on secondary packing came into effect from 1.7.2013. Pharmexcil continuously helping the industry in sorting out various issues, like requirement of bar coding for the batches produced 1.7.2013, requirement of bar coding for APIs, definition of mono cartons etc. with the help of Department of Commerce / DCGI
c) Service Tax on Commission paid to agents:
Council sent a representation to DGFT requesting for increasing the limit of exemption of FOB value from 1% to 1.2% subsequent to increase of rate of Service Tax from 10% to 12%
d) Excess interest by Customs:
Council represented to DGFT bringing to its notice that Customs is charging interest on unitized imports under Advance Licenses @ 18% as per their notifications against 15% allowed as per DGFT notification and requested to consider to charge at 15% in view of problems faced by exporters.
e) Issue of Licenses for APIs not covered under DCGI List
A representation was made to DCGI bringing the problems faced by the exporters in case of exporting old APIs not covered in the list of DCGI, though such products have been exported over the past 15 years. It was suggested to delegate the powers to Zonal offices for issuing such licenses or process the applications by DCGI Delhi on fast track basis within a time frame of 7 days.

f)Issues of Nutritional Products:
There were many complaints from members dealing with nutritional products that they were facing lot of problems subsequent to the commencement of operations by FSSAI. Council brought their issues to the notice of DoC. Department had taken up the issues actively and met the officials of FSSAI and DGFT officials to sort out the same
g) Issue of Licenses without brand names
Another major issue handled by Council was the decision taken by DCGI to issue Licenses without brand names. The notification caused lot of confusion among the exporters as the exports were expected to hampered severely. Council immediately sent out a circular seeking the views of members. Based on the feedback from the members , Council sent a representation to DCGI requesting to consider issuing Licenses with brand names for export purpose. Council’s representation was considered favourably and Department of Health sent a communication on 9.11.2012, clarifying that the earlier notification is not applicable for issue of CoPPs, GMP certificates, Free Sale Certificates etc.
h) Representation to AP Drug Administration on CoPPs:
Some of the members informed that AP Drug Administration was issuing the CoPPs for each product and per country basis at a cost of Rs.500 for each certificate. Director General along with representatives of BDMA met the DG, AP Drug Control Administration and gave a representation requesting them to issue CoPPs for each product manufactured by the companies without mentioning country name.
I) Compilation of important information:
With the help of ex-CDSCO official, list of WHO GMP certified units in India was compiled and CD was prepared. Along with this information, the CD contains information about DMFs/ANDAs filed by Indian companies with USFDA, CoS issued by EDQM etc. Council had sent these CDs to various embassies, given to visitors at various exhibitions, free cost.
j) World Pharma Trade Center:
With lot of persuasion by Pharmexcil, AP Government agreed to allot 3/5 acres of land at Hi-tech city, Hyderabad, for establishing World Pharma Trade Center. Council would further pursue with the concerned departments for allotment of land soon.

AUDITORS REPORT TO THE MEMBERS OFPHARMACEUTICALS EXPORT PROMOTION COUNCIL OF INDIA, HYDERABAD.
1. We have audited the attached Balance Sheet of M/s Pharmaceuticals Export Promotion
Council of India as at March 31, 2013 and the Income and Expenditure under the reference
to this report. These Financial Statements are the responsibility of the Company’s
management. Our responsibility is to express an opinion on these financial statements
based on our audit.
2. We have conducted our audit in accordance with generally accepted auditing standards in
India. These standards require that we plan and perform the audit to obtain the reasonable
assurance whether the financial statements are free of material misstatements. An audit
includes, examining on a test basis, evidence supporting the amounts and disclosures in the
financial statements. An audit also includes assessing the accounting principles used and
significant estimates made by management, as well as evaluating the overall financial
statements. We believe that our audit provides a reasonable basis for our opinion.
3. The provisions of companies (Auditors Report) Order, 2003, issued by the central
Government of India in terms of Section 227 (4A) of The Companies Act, 1956, are not
applicable to the Company, as M/s Pharmaceuticals Export Promotion Council of India is
registered as a company Licensed to operate Under Section 25 of the Companies Act, 1956.
4. Further, We report that-
a) We have obtained all the information and explanations, which to the best of our knowledge
and belief were necessary for the purposed of our audit.
b) In our opinion, proper books of account as required by law have been kept by the company,
so far as appears from our examination of those books.
c) The Balance Sheet and Income and Expenditure Account dealt with by this report are in
agreement with the books of account.
d) On the basis of written representations received from the directors as on 31st March, 2012
and taken on record by the Board of Directors, we report that none of the directors is
disqualified as on 31s March, 2012 from being appointed as a director in terms of clause (g)
of sub-section (1) of section 274 of the companies Act, 1956.

e) The Company has neither paid not provided for cess payable u/s 441A of the Companies
Act, 1956 since the aforesaid section is not yet been made effective by the Central
Government.
f) In our opinion, and to the best of our information and according to the explanations given to
us, the said accounts together with the notes thereon/ attached thereto give in the
prescribed manner the information required by the Act, and also give a true and fair view in
conformity, with the accounting principles generally accepted in India.
I. In the case of the Balance Sheet, of the state of affairs of the Company as at March 31,
2013.
ii. In the case of Income and Expenditure Account, of the EXCESS of Income and
Expenditure for the year on that date.

SIGNIFICANT ACCOUNTING POLICIES & NOTES ON ACCOUNTS ANNEXED TO AND FORMING
PART OF FINANCIAL STATEMENTS FOR THE YEAR ENDED 31st MARCH, 2013
I. SIGNIFICANT ACCOUNTING POLICIES:
1.1 GENERAL
a) The Financial Statements are prepared on the basis of historical cost convention, in
accordance with applicable accounting standard and on the basis of going concern.
b) Entrance Fee receipts are credited to General Reserve.
1.2 FIXED ASSETS
Fixed Assets are stated at cost of acquisition, less accumulated depreciation.
1.3 DEPRECIATION
Depreciation on Fixed Assets is provided on straight Line Method at the rates and in the manner
prescribed in Schedule XIV of the Companies Act, 1956 in respect of assets acquired during the
year, depreciation has been provided on the pro-rata basis, duly applying the necessary rate.
1.4 INVESTMENTS
Investments are stated at cost. Interest on the same is being accounted for on accrual basis.
1.5 TRANSACTIONS IN FOREIGN CURRENCY
Transactions in foreign currency are recorded at the rate of exchange in force at the time of
occurrence of the transaction.
II. Notes on Accounts
2.1 M/s. Pharmaceuticals Export Promotion Council of India (hereinafter called “Pharmexcil”)
is promoted by Ministry of Commerce & Industry, Government of India and had been
registered as Company under section 25 of the Companies Act, 1956 and by virtue of the
provisions of Companies Act, the word “LIMITED” is not required to be suffixed in its’ name.
2.2 M/s. Pharmexcil has been set up by the Ministry of Commerce & Industry to act as Nodal
Agency for issue of Registration cum Membership Certificate the Pharmaceutical exports
throughout the country under the provisions of Foreign Trade Policy being announced by Govt.
of India from time to time.
2.3 As M/s. Pharmexcil is a Section 25 Company not for Profit, Income & Expenditure Account
has been prepared instead of Profit & Loss Account.

2.4 The expenses in respect of code activities are subject to sanction/confirmation of the
Government of India and Grant-in-aid received from the Ministry of Commerce is subject to
adjustments on account of Government Audit objections, if any, partial/non fulfillment of
conditions laid down for eligibility of such Grant-in-aid, clarification by M/s. Pharmexcil and the
final decision of the Ministry in respect of the same.
2.5 Of the total depreciation computed in accordance with Schedule XIV of the Companies Act,
60% is adjusted against the Capital Grant given by the Government of India for acquiring theses
assets and balance amount is charged to Income & Expenditure Account.
2.6 Unutilized MDA advance of the beginning of the year stood at Rs.10,27,955/- and during
the year under review, the amount of Advance received from Ministry of Commerce under this
head stood at Rs.2,71,82,000/-. As against this, the amount utilized during the year was
Rs.2,71,82,000 /- and amount returned back to Ministry was Rs.10,27,955/- and accordingly,
the closing balance is Nil.
2.7 Pursuant to the approval by the Ministry of Commerce for grant of Marketing Development
Assistance(MDA) to individual exports under certain eligible scheme, M/s. Pharmexcil has,
during the year, reimbursed the members Rs.1,40,18,538/-(Previous year 1,15,13,194/-).
2.8 During the year under review, an amount of Rs. 3,51,91,044/- was utilized for
reimbursement of Product Registration Charges received under MAI Scheme
2.10 There are no dues to small Scale/Ancillary Industrial Undertaking as at the Year end.
2.11 Membership Fee was accounted on receipt basis and accordingly, no provision has been
made for Membership dues for the year.
2.12 The Council is registered under Section 12AA of the Income Tax Act, 1961 and accordingly,
no income tax is payable on the surplus, subject to the fulfillment of the conditions laid down
for this registration. One of the conditions laid down in this regard is spending of the amounts
pertaining to accumulation of income within the specified period (5 years). Non-compliance of
this may result in tax on the portion of the accumulated income not utilized for the purpose. In
the case of Council, this amount remaining unutilized for the purpose within the period of 5
years amounted to Rs.60,00,000, which may come under the tax levy. The Council is taking
steps of filing an application before the Assessing Authority seeking additional time for fulfilling
this obligation.
