SUBJECT: Hawkins-Weir Engineers, Inc. Amendment No. 4 – Construction Phase Services for the Benson Mountain Pressure Plane Improvements Project

RECOMMENDATION: Staff recommends the approval of Amendment No. 4 to the Professional Engineering Services Agreement with Hawkins-Weir Engineers, Inc. in an amount not to exceed $81,380.00 for construction observation and project management services associated with the Benson Mountain Pressure Plane Improvements project.

BACKGROUND: The Benson Mountain Pressure Plane Improvements Project consists of the replacement of an aging water storage standpipe and associated pumping station, as well as approximately 2,385 linear feet of new waterline.

DISCUSSION: This contract amendment will provide the funds necessary for Hawkins-Weir to oversee the contractor’s work in the field, provide help with RFI’s or change orders as necessary, and properly survey and certify the completed work.

BUDGET/STAFF IMPACT: Funds are available within the Benson Mountain Pressure Plane Upgrade account (10006).

In accordance with the AGREEMENT For PROFESSIONAL ENGINEERING SERVICES for the Goshen

Ground Water Storage Tank and Benson Pressure Plane Improvements (HW Project No. 2017076),

dated Octobers, 2017, between the City ofFayetteville, Arkansas (hereinafter called Owner) and Hawkins-

Weir Engineers, Inc. (hereinafter called Engineer), Owner hereby authorizes Engineer to proceed with

engineering services as modified by this Amendment No. 4.

SECTION 1 - SCOPE OF SERVICES

1.1 Amendment No. 4 is for construction management services for the Benson Mountain Pressure

Plane Improvements (Task 8) associated with Owner's Project No. 19-18. Task 8 services are detailed in

the Engineer's attached Scope of Services dated June 2, 2020.

SECTION 2 - TIME OF SERVICE

2.1 The scope of services as defined above is based on addressing the Task 8 services within a 180-

calendar day construction Contract Time in 2020 for the Owner's Project No. 19-18. Engineer will proceed

with providing the services set forth herein immediately upon execution of this Authorization by all parties.

SECTION 3 - COMPENSATION

3.1 Owner shall compensate Engmeer for providing the services set forth herein in accordance with the

terms of the Agreement. Total payment for Scope of Services described herein shall not exceed Eighty-

One Thousand Three-Hundred Eighty and 00/100 Dollars C$81,380.00') without written approval of Owner.

These additional services adjust the Agreement's not to exceed fee to $258,670.00, but do not adjust the

not to exceed reimbursable expenses of $21,820.00.

WHEREAS, on October 3, 2017, the City Council passed Resolution 206- 17 to approve a Professional

Engineering Services Agreement with Hawkins -Weir Engineers, Inc. for engineering services related to the

Goshen and Benson Water Tank Improvements Project; and

WHEREAS, due to land acquisition delays and system functionality the project is now proposed to bid inseparate phases; and

WHEREAS, Amendment No. 3. will allow for advertisement and bidding services for the BensonMountain Pressure Plane Improvements and Benson Mountain Elevated Water Storage Tank

Improvements.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

FAYETTEVILLE, ARKANSAS:
