Charles H. Duckett, M. D. , President of the Board of MedicalExaminers of the State of North Carolina, called this meetingto order at 8:45 p. m. , September 30, 1987, at the SheratonImperial Hotel, Research Triangle Park, North Carolina.
The Board members present at this meeting included: EbenAlexander, Jr. , M. D. ; John Thomas Daniel, Jr. , M. D. ; Harold L.Godwin, M. D. ; Hector Himel Henry, II, M. D. ; and Mrs. MarthaKirkland Walston.

MC ELROY, Richard Allen, M. D. , Landis, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Henrythat the Board advise Dr. McElroy the Board of MedicalExaminers of the State of North Carolina will offer Dr. McElroythe opportunity to enter into a Consent Order with the Boardcontaining the following conditions:
1. Dr. McElroy shall forthwith surrender his DEA prescribingprivileges in all schedules of controlled substances;
2. Dr. McElroy shall take the North Carolina examinationfor licensure (FLEX Components I and II) in December,1987, to demonstrate his medical knowledge. Failureof Dr. McElroy to achieve a passing score, as defined inN. C.A. C. 32B.0111, shall be cause for such further actionby the Board as it may deem necessary;
3. Dr. McElroy shall cease administering Vitamin B-12injections in situations where there is no valid medicalneed or reason therefor; and
4. Dr. McElroy shall appear before the Board of MedicalExaminers for further interviews on an informal basisat such times and places as the Board may request.

On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Henry and seconded by Dr. Godwinthat the Board offer Dr. gureshi the opportunity to enter intoa Consent Order with the Board of Medical Examiners of theState of North Carolina containing a Reprimand and stating:
1. The Board of Medical Examiners reprimands Dr. gureshi andadmonishes him to keep fully apprised of all lawsapplicable to the handling of controlled substances; and
2. Dr. gureshi shall appear before the Board of MedicalExaminers for further interviews on an informal basisat such times and places as the Board may request.
FISHER, John Apfel, M. D. , Goldsboro, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Henry that the Board offer Dr. Fisher the opportunity to enterinto a Consent Order with the Board of Medical Examiners of theState of North Carolina containing a Reprimand and stipulating:
1. The Board of Medical Examiners reprimands Dr. Fisher for hisunprofessional conduct in becoming habituated to the con-trolled substance Preludin;
2. Dr. Fisher shall surrender his DEA prescribing privilegesfor substances in Schedules 2 and 2N;
3. Dr. Fisher shall continue his attendance at AA and NA, aswell as his participation in the programs of the PhysiciansHealth and Effectiveness Committee of the North CarolinaMedical Society;
4. Dr Fisher shall provide to the Board of Medical Examinersa current report on his status from Dr. Clark and shall pro-vide an additional report prior to appearing for aninterview with the Board; and
5. Dr. Fisher shall appear before the Board of MedicalExaminers for further interviews on an informal basisat the Board's meeting in March, 1988, and at such othertimes and places as the Board may request.
WYMAN, Robert West, M. D. , Selma, North Carolina
On October 2, 1987, the Board of Medical Examiners unanimously
adopted a motion made by Dr. Godwin and seconded by Dr. Duckettthat the Board offer Dr. Wyman the opportunity to enter into aConsent Order including a Reprimand with the Board of MedicalExaminers of the State of North Carolina and that this ConsentOrder also contain the following stipulations:
1. Dr. Wyman shall surrender his prescribing privileges inSchedules 2 and 2N;
2. Dr. Wyman shall continue his psychiatric therapy untilsuch time as his therapist shall recommend discontinuance;
3. Dr. Wyman shall provide a written progress to the Boardof Medical Examiners from his Psychiatrist immediatelyprior to his next scheduled meeting with the Board; and
4. Dr. Wyman shall appear before the Board of MedicalExaminers for further interviews on an informal basisat the March, 1988, meeting of the Board and at such othertimes and places as the North Carolina Board of MedicalExaminers may request.
HILL, Ivor Dennis, M. D. , Cape Town, South Africa
On October 2, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Duckett:
that the Board send a letter to Dr. Simon inquiring if Dr.Hill is a physician who would qualify for VisitingProfessor status and whether the Dean of the Bowman GraySchool of Medicine recommends Dr. Hi 11 for licensure;
that the Board review Dr. Simon's response at the nextmeeting; and
that the Board of Medical Examiners of the State of NorthCarolina consider issuing a license to Dr. Hillspecifically limiting his activities to Bowman Gray Schoolof Medicine and its affiliated institutions, waiving therequirement for the standard certificate of ECFMG, andallowing Dr. Hill a period of two years plus an extensionof three to pass the North Carolina examination forlicensure (FLEX).
VERWOERDT, Adriaan, M. D. , Durham, North Carolina
On October 2, 1987, the Board of Medical Examiners unanimously
adopted a motion made by Dr. Daniel and seconded by Dr. Duckettthat the Board request the Ethics Committee of the NorthCarolina Psychiatric Association to report its actionconcerning Dr. Verwoerdt to the Board of Medical Examiners; andthat, if the Ethics Committee does not provide this report, theBoard request Dr. Verwoerdt to obtain the information for theBoard of Medical Examiners' review.
LLEWELLYN, Charles E. , M. D. , Durham, North Carolina
On October 2, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr. Duckettthat the Board request the Ethics Committee of the NorthCarolina Psychiatric Association to report its actionconcerning Dr. Llewellyn to the Board of Medical Examiners; andthat, if the Ethics Committee does not provide this report, theBoard request Dr. Llewellyn to obtain the information for theBoard of Medical Examiners' review.
CHELATION THERAPY
On October 2, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Danielthat the Board authorize its attorney to communicate with theattorney representing the physicians who practice chelationtherapy stating, if his clients are, in fact, involved with aresearch protocol, the Board of Medical Examiners of the Stateof North Carolina has no difficulty accepting this typeof activity; but, if his clients are not involved with aresearch protocol, the Board of Medical Examiners believesthese physicians should not engage in administering chelationtherapy in the treatment of diseases for which its efficacy hasnot been established.
MILLER, Norman Eric, M. D. , London, England
On October 2, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board of Medical Examiners of the State ofNorth Carolina issue Dr. Miller a license specifically limitinghis activities to Bowman Gray School of Medicine and itsaffiliated institutions, waiving the requirement for thestandard certificate of ECFMG, and allowing Dr. Miller a periodof two years plus an extension of three to pass the NorthCarolina examination for licensure (FLEX).
LAU, Thomas Joseph, M. D. , Gainesvi lie, Florida
On October 3, 1987, the Board of Medical Examiners adopted amotion made by Dr. Godwin and seconded by Dr. Henry that theBoard issue Dr. Lau a dated license for a period of one year.
KUHN, Brenda Gail, M. D. , Hackensack, New Jersey
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Henrythat the Board deny approval of Dr. Kuhn's licensureapplication based on the following reasons:
(1) the podiatry education, which the Board has no way toverify or to evaluate, short of going to that school,
(2) the accelerated program at Juarez of nine or tenmonths, which is far short of the months required, and
(3) the rotations at the Beckman Tower downtown hospitalin New York, where:
(a) at least one required residencywas not in a program in which there was an approvedresidency, and
(b) two other residencies, which were notrequired rotations, may not have been in programswith approved residencies.
Dr. Kuhn stated, "I wi 11 withdraw my application. " The Boardof Medical Examiners then rescinded its action and accepted Dr.Kuhn's withdrawal of her application for medical licensure inthis state.
DAVIS, Ben Keith, M. D. , Colorado Springs, Colorado
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Danielthat the Board deny approval of Dr. Davis' licensureapplication based on the fact that he has failed to satisfy theBoard of Medical Examiners of his qualifications for licensurein this state because of Dr. Davis' difficulties with thecriminal law authorities in the state of Colorado.
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a further motion made by Dr. Duckett and seconded byDr. Daniel that the Board advise Dr. Davis, once he hascompleted the terms of his probation in Colorado: both with the
criminal authorities and the medical licensing Board, the NorthCarolina Board of Medical Examiners wi 11 be prepared toreconsider a licensure application from him; and that the Boardalso advise Dr. Davis, should he elect to submit such anapplication in the future, the Board requests that, at such atime, he provide the Board of Medical Examiners with a currentpsychiatric report, including: prognosis, diagnosis, and anyinformation affecting medical licensure.
MAHAN, Robert Gary, M. D. , Winter Haven, Florida
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr.Duckett that the Board issue Dr. Mahan a dated license for aperiod of one year based on the following stipulations:
Dr. Mahan shall continue his participation in AA;
Dr. Mahan shall associate himself with the PhysiciansHealth and Effectiveness Committee of the North CarolinaMedical Society;
Dr. Mahan shall appear before the Board prior to theexpiration of this dated license; and
Dr. Mahan shall provide tangible evidence showing that hehas complied with the Board of Medical Examiners'stipulations concerning participation in AA and involvementwith the Physicians Health and Effectiveness Committee.
BEASLEY, J. Frank, M. D. , Morganton, North Carolina
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Henrythat the Board extend Dr. Beasley's dated license for a periodof two years; and that the Board interview this physician priorto the expiration of this dated license.
CARSON, Rickey R. , M. D ~ , Raleigh, North Carolina
On October 3, 1987, the Board of Medical Examiners reviewedinformation indicating Dr. Carson's dated license expiresOctober 31, 1987. The Board also reviewed informationindicating that this physician now lives in Tennessee and doesnot intend, at this time, to practice medicine in NorthCarolina. On October 3, 1987, the Board of Medical Examiners
unanimously adopted a motion made by Dr. Duckett and secondedby Dr. Daniel that, if Dr. Carson requests further licensure inthis state, the Board advise him to submit another applicationfor the Board of Medical Examiners' consideration.
MAYFIELD, Michael Eugene, M. D. , Winston-Salem, North Carolina
On October 3, 1987, the Board of Medical Examiners adopted amotion made by Dr. Duckett and seconded by Dr. Daniel that theBoard allow Dr. Mayfield to continue his training with norestrictions placed on this physician's license.
BUNN, David Glenn, M. D. , Whitevi lie, North Carolina
On October 3, 1987, the Board of Medical Examiners adopted amotion made by Dr. Duckett and seconded by Dr. Daniel:
that the Board endorse a request for reinstatement ofDr. Bunn's controlled substance prescribing privileges inSchedules 2 and 2N;
that the Board extend Dr. Bunn's dated license for a periodof one year;
that the Board advise Dr. Bunn to continue participation inAA and the Physicians Health and Effectiveness Committee'sprogram in Pinehurst;
that the Board instruct Dr. Bunn to provide progressreports from Dr. Clark at six month intervals;
and that the Board instruct Dr. Bunn to obtain at leastfifty hours of continuing medical education prior to theOctober 1988 meeting.
WYNNE-ROBERTS, Caroline Rosales, M. D. , Hi llsbororough, NC
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Danielthat the Board offer this physician the opportunity to take theNorth Carolina examination for licensure (FLEX Component I andII) in June 1988.
GAMBLE, Robert Keith, M. D. , Howard Beach, New York
The Board informed this physician that his clinical clerkships
do not meet the statutory requirements for medical licensure inthe state of North Carolina. On October 3, 1987, the Board ofMedical Examiners unanimously adopted a motion made by Dr.Duckett and seconded by Dr. Daniel to offer this physician anopportunity to withdraw his application and receive a feerefund. Dr. Gamble withdrew his application for a license topractice medicine in this state.
HURD, Douglas Burdett, M. D. , Rochester, Minnesota
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Henrythat the Board deny approval of this licensure application onthe basis of the fact that Dr. Hurd's medical education doesmeet the requirements of N. C. Gen. Stat. Sec. 90-9.
KHAN, Shahina R. , M. D. , Gaffney, South Carolina
On October 3, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Henrythat the Board deny approval of Dr. Khan's licensureapplication on the basis of the fact this physician's graduatemedical education and training does not comply with therequirements for medical licensure in North Carolina as setforth in N. C. Gen. Stat. Sec. 90-13 and 21 N. C.A. C. 32B.0213.
ANORECTIC STATEMENT
On October 2, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Duckettthat the Board adopt the following statement as the opinion ofthe Board of Medical Examiners of the State of North Carolinaregarding anorectic prescribing and that the Board develop aletter stating this opinion.
It is the opinion of the North Carolina Board of MedicalExaminers that under special circumstances anorectic agentsmay fill a limited adjunct role in the treatment of obesityin individual patients, if such treatment primarilyinvolves diet, exercise, behavior therapy and frequentsupervision by the physician.
If used, anorectic agents should be used for short term,non-repetitive periods of not more than twelve weeks.
Anorectic agents may produce drug dependency in some
patients.
The policy of the North Carolina Board of Medical Examinersregarding the use of amphetamines and methamphetamines fortreatment of obesity is still in effect. There are noindications for use of these drugs in weight control.
On October 2, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel:
that the Board issue a statement prepared by Dr. Alexandercombining the Medical Society's position on Amphetamineprescribing and the Board of Medical Examiners' opinion onAnorectic prescribing into one document; that the Boardsend this combined statement to the North Carolina MedicalSociety and the Journal; that the Board send a letter withthis statement ~in icating, after consuitation and inputfrom various groups, this is the Board of MedicalExaminers' statement on Amphetamine and AnorecticPrescribing; and that the Board provide copies of thiscombined statement to its investigative staff so that theinvestigators may appropriately utilize this information.
Dr. Alexander requested the staff to provide him with a copy ofthe Medical Society's statement on Amphetamine Prescribing.
NORTH CAROLINA PSYCHIATRIC ASSOCIATION
The Board adopted a motion that the staff send the NorthCarolina Psychiatric Association a copy of the Board of MedicalExaminers' Order on Charles Llewellyn, M. D. , and that the Board

request this Association to notify the Board of MedicalExaminers of any North Carolina Psychiatric Association actionconcerning Dr. Llewellyn.
DAY, Phillip Mark, M. D. , Grover, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Henry and seconded by Dr. Duckettthat the Board send the following letter to Dr. Day:
At a meeting held during October, 1987, the Board of MedicalExaminers instructed that you provide a progress report fromthe Physicians Health and Effectiveness Committee in accordancewith the Consent Order effective February 20, 1987, stipulatingthat you shall furnish a progress report from the PhysiciansHealth and Effectiveness Committee for the Board of MedicalExaminers' review by June 1, 1987.
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a further motion made by Dr. Henry and seconded by Dr.Duckett that the Board schedule Dr. Day for an interview at theDecember, 1987, meeting, as stipulated by the Consent Order.
ROBERTSON, Logan Thomson, M. D. , Canton, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Danielthat the Board offer Dr. Robertson the opportunity to enterinto a Consent Order with the Board of Medical Examiners of theState of North Carolina containing a Reprimand, placing Dr.Robertson's licensure in a probationary status for a period offive years, and stipulating:
1. The Board of Medical Examiners formally reprimands Dr.Robertson.
2. The Board places Dr. Robertson in a status of probationfor a period of five years from the date of entry of afinal order in this case.
3. Dr. Robertson shall surrender his prescribing privilegesaccorded by the United States Drug EnforcementAdministration for controlled substances in allschedules, 2 through 5 inclusive.
4. Dr. Robertson shall exercise proper supervision of all hisemployees, insuring that they not undertake in the course

of their employment with Dr. Robertson the performance ofmedical acts which the Board has not authorized these in-dividuals to perform, and that they not hold themselves outas having any status which requires Board approval unlessthe Board has approved such status.
5. Dr. Robertson shall respond to or meet with the Board ofMedical Examiners upon reasonable request of the Board.
GRIER, Raymond Edward, M. D. , Greensboro, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr.Alexander that the Board offer Dr. Grier the opportunity toenter into a Consent Order: ( 1) revoking his North Carolinamedical license based on N. C. Gen. Stat. 90-14 (a) 13; (2)suspending the revocation based on compliance with theconditions imposed on his licensure in the state of California;(3) stipulating Dr. Grier shall submit to such monitoring ofhis practice activities as the North Carolina Board of MedicalExaminers deems necessary and (4) stipulating Dr. Grier shallappear for an interview with the Board at the end of six months.
WILLIAMS, Johnnie Lee, M. D. , New Bern, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr. Godwinthat the Board offer Dr. Williams the opportunity to enter intoa Consent Order based on the conditions imposed on hislicensure in the state of New York.
ROGERS, Charles Wilburn, M. D. , Chapel Hill, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr.Alexander: (1) that the Board send Dr. Rogers a registeredletter documenting his non-compliance with the Order of theBoard of Medical Examiners of the State of North Carolina.
BARRY, William, M. D. , Fayettevi lie, North Carolina
On October 1, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Danielthat the Board offer Dr. Barry the opportunity to enter into aConsent Order which will remain in effect for the duration of

his court ordered probation containing the followingstipulations:
1. Dr. Barry shall be and remain of high moral character;
2. Dr. Barry shall obey all state and federal laws;
3. Dr. Barry shall refrain from the use of all mind-altering substances, including alcohol;
4. Dr. Barry shall associate himself with a Psychiatrist ofhis choice or with a personal physician who will providethe Board with a current status report on Dr. Barry'sgeneral emotional and physical health and another statusreport at the end of six months;
5. Dr. Barry shall attend a minimum of three AlcoholicsAnonymous meetings each week;
6. Dr. Barry shall contact the Physicians Health andEffectiveness Committee of the North CarolinaMedical Society and involve himself in itsprogram;
7. The Board of Medical Examiners shallalso notify this group of Dr. Barry's situation;
8. Dr. Barry shall provide the Board with a reportfrom the Physicians Health and Effectiveness Committeeat the end of six months; and
9. Dr. Barry shall appear before the Board at theend of six months.
STANLEY, Karl Harvey, M. D. , Whitevi lie, North Carolina
