Variances Requested

1. non-residential FAR of 2.3 which is approx. 15% more non-residential density than would otherwise be permitted (2.0 FAR); and

2. continued non-residential use of the 3rd floor which, although consistent with the existing use and Certificates of Occupancy issued for the building, would not otherwise be permitted.

The criteria for area variance relief under Subtitle X, Chapter 10, are asfollows:

1. the Property is affected by exceptional situations or conditions;**

2. strict application of the Zoning Regulations will result in practical difficulty to the Applicant; and

3. the granting of the variance will not cause substantial detriment to the public good or substantially impair the intent, purpose, or integrity of the zone plan.

** Exceptional situations or conditions may arise from one factor or a confluence of factors and, when a public service or non-profit organization has inadequate facilities, the need to expand an existing building may itself constitute the kind of exceptional condition that justifies a variance.
