1215 corresponding to R.S.Plot No.1275 and 1276 measu­

2. That previously Monilal Mahato father of the

complainant wa~ in possession of the tank and its ail

by rearing and catching fishes ~nct by irr~gating his

paddy land with the water of the tank. On the death of

Monilal Mahat.o the complainant and his brother are in

possession of the aforesaid tank and it:; au by rearing

and c11tching fishes and by irregating thelr cultivable

land.

3. That the complainant and his brother ma de improve-

ment of the tank and have throuehen spawns in the tRnk

and there were/are a good no.of fishes of the sald tank.

4. That on 16,05.2020 at a hout 9 A. M. the qforesaid

accused persons by farming !ind unla.wful Assembly with

interim to comunil loss of the complainants property

with the help of fl3hing ~et. The accused pers ons c! ught

fishes from the tank with the help of"Tano-JRl".Th!.' a ccu.!

a nd his brother M'inoranjan and same of the Vl.llage r o includins the witness protested against the high ha r ded activities of the above persons. But the a ccused pers on a became frawed up alongwith two N.V.F hacklled th e compl a ir ant and his bro~her and asulted them fixed and blows . The a ccused persons were arms,with Lathi,Da and sickle. The nama o:f the N.V.F is Sanjoy Tudu and Bana';)ehari who are attached with Purulia(M) P.s. 5o That the accused person brought a Van and they with the help of Van tokk the entire fishes. The complai­nant has subtained a loss of Rs.70,000/-(Seoenty t hou sand) 6. That on 15.06.2020 the said accused persons ·1 to 18 by farming and unlawfull assembly against crimi­nally tress-pass i.nto the Tank and its ail and. caught fishes with the help of fiqhing net weighting about 3 quintals of fishes inspite of the objection raised by the complainant and his brother and the accu:sed person curate the fishes 111 · a Van. On 15.06.2020 the l)Omplainant has sus tained a loss of Rs.1,50,000/- the fishes were c-"lught and talcen way by the accu.r,ed person rear and · nurcha.r by the complainant and his brother. 7. That t})e . complainant had been to Thana 0?1 16 . 05. 2020. But the Tha?1R Officer refused to give receip~ and ultima tely t he complainant on 18.05,2020 sa i d the petition of co1nplain to the .Officer-in-Charge ?un.111-'l ( M) P. S • . by
