Please find submitted herewith the variance application and associated requiredsubmittal materials requesting a variance to permit a primary structure with less setbackthan required.
The site is identified as 8016 Belhaven Ave, Pasadena, Md as shown on the plat ofBelhaven Beach, Lots 60A, 608, 61A and 61 B. This site is a 17, 784 square foot lot,zoned R-1. The site is not located within the Chesapeake Bay Critical Area. The site isserved by a private well and a private septic system. The property fronts a Public 40-footimproved right-of-way, known as Belhaven Ave. This lot is a legally buildable by virtue ofthe record plat that is recorded in Book 1, Page 3 of the Plat Records.
This site is currently vacant consisting of woods in fair condition. The owner proposes toconstruct a new Single-Family Dwelling with associated driveway sidewalk andstormwater management. The proposed house meets the setback to the rear, & bothside yards for the R-1 zoning.
The applicant is seeking a variance to permit a primary structure to have less front yardsetback than required. The required setback from a front yard is 40 feet. We arerequesting a variance of 15. 1 feet to the front yard setback, allowing a 24-foot-deep by30 feet wide house to be constructed. We feel this is the minimum relief necessary toconstruct a home on this legally buildable lot as the septic system is utilizing almost 3/4of the lots buildable area, the site perced for mound systems and even though thesystem is sized for only a 750 sf home, the smallest home size allowed by health, themounds are large and take up a large portion of the lot, we have asked healthdepartment for as many variances as they would allow to the mounds to hold the homeback off the street as far as possible. The maximum footprint that can be built on this lotwithout a variance is a 9-foot-deep by 41-foot-wide box because of the setbacks to the
septic system and well. And constructing an 9' deep home would not conform with theother homes in the neighborhood, as the average width of a home in this neighborhoodmay vary from split foyer, ranchers to shotgun style homes but all deeper than 9'.Therefore, we are applying for variance to permit a deeper home that will better suit theneighborhood and be more in character with the existing neighborhood. We feelconstructing such a shallow home would create an eye sore in the neighborhood.
We feel that the variances requested above will not alter the essential character of theexisting neighborhood, but in fact will mimic the existing character of the neighborhoodand provide for a home that is more suited for the neighborhood. There are multiplehomes in close proximity to this site that are closer to the road than the permitted 40',8024 Maywood as shown on the site plan is only 23' from the right of way, 8028Maywood, only 21' from the right of way, there is another house on the corner ofBelhaven and Maywood that sits 27' from one right of way and only 15' from the other.We feel asking to be as close as 24. 9' to the right of way is mimicking other homes onthis street. We feel that granting these variances will not confer on the applicant anyspecial privileges, as the Belhaven Beach subdivision consist of Lots of the same sizeand shape throughout the community. We also feel that denial of the variances willdeprive the applicant of the rights commonly enjoyed by other properties in theneighborhood and cause unwarranted hardship that would deny the applicantreasonable and significant use of the entire lot. The owner is not requesting thesevariances based on conditions or circumstances that are the result of actions by theapplicant. And last the granting of these variances will not adversely affect water qualityor adversely impact fish, wildlife or plant habitat in the Chesapeake Bay Critical Area asthe site is not within the Chesapeake Bay Critical area. Also, a grading permit will beapplied for and stormwater management will be address for all new imperviouscoverage in accordance with the State Stormwater Management Manual.
We respectfully submit that this legally buildable lot is not reasonably developablewithout the relief requested.
