WHEREAS previously there was vested by Sharia Law in the Sultan a power, reference to which is made in article 121 of the Ottoman Land Code, and article 8 of the Provisional Law regulating the right to dispose of immovable property of the thirtieth day of March, 1329, to convert land of the category termed "miri" into land of the category termed "mulk" :

AND WHEREAS it is expendient that such power, in respect of all "miri" land in Palestine, be vested in the High Commissioner thereof:

Commencement of Order and publication in Palestine.

Now, THEREFORE, His Majesty, by virtue and in exercise of the powers in this behalf by the Foreign Jurisdiction Act, 1890, or otherwise, in His Majesty vested, is pleased, by and with the advice of His Privy Council, to order, and it is hereby ordered, as follows: —

1. This Order may be cited as "The Palestine (Amendment) Order-in-Council, 1933," and shall be read and constructed as one with the Order-in-Council bearing date the tenth day ot August, 1922, and intituled The Palestine Order-in-Council, 1922 (hereinafter referred to as the principal Order).

2. The following article shall be added to the principal Order after article 16 thereof, and shall be numbered article 16A:—

16A. The High Commissioner may, if he thinks fit, by order under his hand to be published in the Gazette, convert such land in Palestine of the category termed "miri", as may be described in such order, into land of the category termed "mulk".

3. This Order shall be published in the official Gazette of Palestine, and the date of such publication shall be deemed to be the date of the commencement of this Order.

No. 8 of 1933

A N ORDINANCE FURTHER TO AMEND THE INTOXICATING LIQUORS AND PUBLIC ENTERTAINMENTS ORDINANCE, 1922

B E IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof: —

1. This Ordinance may be cited as the Intoxicating Liquors Short title, and Public Entertainments (Amendment) Ordinance, 1933, and the Intoxicating Liquors and Public Entertainments Ordinance, 1922 No. 14 of 1922. (hereinafter referred to as the principal Ordinance), and the Intoxicating Liquors (Amendment) Ordinance, 1925, and this No. 39 of 1925.. Ordinance may together be cited as the Intoxicating Liquors and Public Entertainments Ordinances, 1922-1933.

2. Section 2 of the principal Ordinance is hereby amended Amendment of by the addition of the following sub-sections thereto as sub- P .n״ cipal sections (5) and (6) : - Ordinance.

"(5) A licence or the renewal of any licence may be refused at the discretion of the licensing authority with­out any cause for such refusal being assigned.

(6) Any person aggrieved by the refusal of a licensing authority to grant a licence or to renew any licence may appeal to the High Commissioner: the decision of the High Commissioner shall be final."

(232) NOTICE OF ENACTMENT

UNDER ARTICLE 17 (1) OF THE PALESTINE ORDER־IN־COUNCIL, 1922

The Intoxicating Liquors and Public Entertainments (Amendment) Ordinance, No. 8 of 1933, is enacted in the form given above and was signed by the High Commissioner on the 15th March, 1933, immediate promulgation being in the judgment of the High Commissioner indispensably necessary in the public interest.

A N ORDINANCE TO AMEND THE POST OFFICE ORDINANCE, 1930

BE IT ENACTED by the High Commissioner for Palestine with the advice of the Advisory Council thereof : —

• 1. •This Ordinance may be cited as the Post Office (Amendment) Short title. Ordinance, 1933, and. the Post Office Ordinance, 1930 (herein­after called the principal Ordinance) and this Ordinance may N o • 2 0 o f 1930־

2. Sub-section (1) of section 15 of the principal Ordinance shall be deleted and the following shall be substituted therefor: —

"The Postmaster-General may detain any postal packet believed to contain any goods subject to Customs import duty or any smuggled goods and may open and examine the packet; and if he finds any dutiable or smuggled goods may detain the packet, or deliver it on payment of any duty or fine or of any duty and fine under the

: .Ordinance for the time being in force relating to Customs and such additional charges as may be authorized by

; : ; regulat ions under this Ordinance: Provided that in the case of a letter packet such opening

and examination shall (unless the cover bears an authori­zation by the sender lor the packet to be opened in the post) take place either in the presence of the person to whom the packet is addressed or in that of such person's authorized agent but if, after notice in writing to such person requiring his attendance or that of his authorized agent left at or forwarded by post to the address on the packet such person fails to attend himself or by his

; authorized agent the Postmaster-General may open and examine the packet notwithstanding the absence of such ׳

person."

Amendment of section 15 of the principal Ordinance.

telegraph work and replace it, if necessary, in such position and manner as may be determined by the District Commissioner."

Amendment of section 47 of the principal Ordinance.

4. in section 47 of the principal Ordinance the words "in carrying out any undertaking" shall be deleted.

Amendment of section 48 of the principal Ordinance.

5. In section 48 of the principal Ordinance the word "such shall be deleted.

Addition to section 86 of the principal Ordinance.

6. The following proviso shall be added to section 86 of the principal Ordinance:—

"Provided that nothing in this section shall extend to the opening, detaining, or delaying of a postal packet returned for want of a true direction, or returned by reason that the person to whom the same is directed is dead, or cannot be found, or shall have refused the same, or shall have refused or neglected to pay the postage thereof, or to the opening or detaining or delaying of a postal packet under the authority of this Ordinance, or in obedience to an express authority in writing under the hand of the High Commissioner."

This Ordinance amends the Post Office Ordinance, 1930, by:—

(a) substituting a new sub-section in the place of the first sub-section of section 15 of the Post Office Ordinance. 1930׳, giving the Posmaster-General power to open any postal packets believed to contain dutiable or smuggled goods in the absence of the owners of such packets, and

(b) substituting a new section in the place of section 44 of the Post Office Ordinance, 1930 (the wording of which is equivocal) with the object of making it clear that a public body having control of a road should advise the Postmaster-General one month before it undertakes any work on such road which is likely to expose any telegraph work to risk or damage, and

(c) adding a proviso based on a provision of the English Law (section 56 (2) Post Office Act, 1903, (Imperial)) to section 86 of the Post Office Ordinance, 1930, with the object of exempting, in certain specified cases, officers of the Post Office who would otherwise be liable to the penalties prescribed in that section.

The opportunity has been taken to remove certain surplus words from sections 47 and 48 of the Post Office Ordinance. 1930. These are merely drafting amendments.

CUSTOMS ORDINANCE, 1929

REGULATIONS MADE UNDER SECTION 230

IN EXERCISE of the powers vested in him by section 230 of No. 11 of 1929. the Customs Ordinance, 1929, the High Commissioner has made

the following regulations :—

Citation. 1. These regulations may be cited as the Customs (Amendment) Regulations, 1933, and the Customs Regulations, 1929-1932, and these regulations may together be cited as the Customs Regulations, 1929-1933.

Interpretation. 2. In these regulations, the term '*principal regulations" shall mean the regulations made under the Customs Ordinance, 1929, and published in the Gazette Extraordinary of the fifteenth day of March, 1929.

Substitution of 3. Regulations 7 and 8 of the principal regulations, as enacted new regulations i n regulation 2 of the Customs (Amendment) Regulations, 1932, regulatfons 7 and shall be deleted and the following shall be substituted therefor:— 8 of the principal regulations. <<7־ The following overtime fees shall be paid by the public

Provided that the minimum charge to an applicant for such attendance shall be: —

(a) When work is performed, for half an hour, or in the case of item (13), for half an hour in respect of each officer detailed for attendance.

(b) When no work is performed and subject to due notice being given by the applicant before the expiry of the first hour of attendance that the services of the officer or officers detailed for attendance are not further required, for such hour, or in the case of item (13), for such hour in respect of each such officer. Should such notice not be given, any officer detailed for attendance shall remain on duty up to the period stated on the application or until receipt from the applicant of notice that he is no longer required and the appropriate charge assessed to the nearest half hour after receipt of such notice (or if the notice is received at a precise hour or half hour assessed as to that hour or half hour) shall be made in accordance with the terms of the application for the attendance given.

8. When the overtime services of any officer are required during the same period in connection with vessels, means of conveyance or goods imported or exported by land, sea or air on account of more than one master, agent, consignee, importer or exporter, overtime fees in full shall be paid by each master, agent, consignee, importer or exporter in respect of the the whole period worked."

ORDER BY THE HIGH COMMISSIONER-IN־COUNCIL UNDER SECTION 33

IN EXERCISE of the powers vested in him by section 33 of the No. 42 of 1927. Intoxicating- Liquors Ordinance, 1927, the High Commissioner-

in-Council is pleased to order, and it is hereby, ordered, as follows: —

Citation.

Excise duty on wine.

1. This Order may be cited as the Excise Duty (Wine) Order, 1933.

2. The excise duty on wine manufactured and issued for consumption in Palestine prescribed in schedule II to the Intoxicating Liquors Ordinance, 1927, as enacted in the Order under that Ordinance by the High Commissioner־in-Council dated the first day of April, 1930, and published in the Gazette Extraordinary of the same date, is hereby revoked, and excise duty at the following rates shall from the date of this Order be imposed on such wine:—

(a) For each litre not exceeding fifteen decrees of alcohol 3 mils

(b) For each litre exceeding fifteen, but not exceeding twentv-five, degrees of alcohol 8 mils

(237) WIDTH AND ALIGNMENT OF ROADS ORDINANCE, 1926

ORDER BY THE HIGH COMMISSIONER־IN־COUNCIL UNDER SECTION 3

No. 24 of 1926. IN EXERCISE of the powers vested in him by section 3 of the Width and Alignment of Roads Ordinance, 1926, the High Commissioner-in-Council is pleased to order and it is hereby ordered as follows:—

The Width and Alignment of Roads Ordinance, 1926, shall apply to the following roads:—

(a) from the junction of the Jerusalem-Hebron road at kilometre 33.300 to El Majdal, passing through Beit Jibrin, Iraq El Manshiya and El Faluja; and

(b) from Bab el Wad at kilometre 24 of the Jerusalem-Jaffa Road to Beit Jibrin, passing through Hartuv and Zakariya.

(238) WIDTH AND ALIGNMENT OF ROADS ORDINANCE, 1926

ORDER BY THE HIGH COMMISSIONER UNDER SECTIONS 4 AND 5

IN EXERCISE of the powers vested in him bv section 4 of the No. 24 of 1926. Width and Alignment of Roads Ordinance, 1926, and section 5 of that Ordinance as enacted in section 3 of the Width and No. 23 of 1927. Alignment of Roads (Amendment) Ordinance, 1927, the High Commissioner is pleased to order and it is hereby ordered as follows:—

1. No permanent work of improvement within the meaning of the Width and Alignment of Roads Ordinances, 1926-1927, shall be carried out within a distance of ten metres from the centre of the roads to which the Width and Alignment of Roads Ordinance, 1926, is applied by the order of the High Commissioner־in-Council made under section 3 of that Ordinance, dated the thirteenth day of March, 1933, and published in this Gazette.

2. The roads to which reference is made in paragraph 1 hereof shall be widened to a width of twenty metres, and the alignment thereof shall be in accordance with a plan, copies of which are available for inspection at the offices of the District Officers, Hebron and Jerusalem-Bethlehem-Jericho Sub-Districts, and of the District Engineer, Jaffa District, and the Engineer in Charge, Public Works, Jerusalem District.

NOTICE OF APPOINTMENTS OF ASSISTANT SETTLEMENT OFFICERS BY THE HIGH COMMISSIONER UNDER SECTION 4

IN EXERCISE of the powers vested in him by section 4 (1) of the Land Settlement Ordinance, 1928, the High Commissioner has been pleased to appoint the persons whose names are set forth in the schedule hereto to be Assistant Settlement Officers in any area in respect of which a Settlement Order has been made under section 3 of the said Ordinance and the High Commissioner has authorised the said persons to act for any Settlement Officer appointed to any such area for the purposes and subject to the provisions of the following:—

The Correction of Land Registers Ordinance, 1926, section 12;

The Land Settlement Ordinances, 1928-1932, sections 7, 8, 9, 21, 22 (1), 22 (3), 24, 26, 27 (5) and 27A. Provided that:

(a) the actions of the said Assistant Settlement Officers shall in every case be subject to the approval of the Settlement Officer of the area concerned;

(b) the said Assistant Settlement Officers shall not adjust the rights of the owners of the land affected by the lay-out of a fresh boundary in place of the original boundary; and
