Srinagar, Jun 26: Huge deployment of police and paramilitary forces was put in place at Sonawar area of Srinagar a day after a local youth was killed in Indore by un- known persons. Accord- ing to the reports received by KNS, authorities on Thursday imposed re- striction in some areas of Sonawar area after clash- es between some youth and forces was reported. At 4 P.M when the last rites of the slain Tahir Hussain Dar were offered at his ancestral grave- yard, some youth resort- ed to stone throwing after which police used tear gas shells to disperse the angry mob. Tahir’s family told KNS that he was MBA pass out from Bobal and was doing the job there as the state head in Intex mobile technology. According to family’s statement Ta- hir, 34 and a father of one child was appointed as an in charge to carry out the probe into the corruption going on in the office. One person who involved in the case tried to bribe Ta- hir and after the refusal, he in the morning of June 24 shot two bullets at Ta- hir that pierced his heart from the back side. Tahir later succumbed to his injuries and his body was taken to the state on Thursday for the perfor- mance of the last rites. Reliable sources told CNS that 1256 quintals of rice were allot- ted for this month to the five circles of Central Kashmir’s Budgam district including Cha- rar-e-Sharief Circle A, B, Cha- doora A, B and BK Pora. Sources added that instead of dispatching 1256 quintals of rice for the distribution purpose to these five circles, the employ- ees at Shiekhpora Granary dis- patched 1068 quintals only to Nagam Granary. Surprisingly, 188 quintals that went missing have not been mentioned in of- ficial records. Store-Keeper Nagam Granary admitted that that he received only 1068 quintals of rice. He told CNS that there was a delay in sending this quota to these five circles because of strikes. His claim was contested by Teh- sil Supply Officers of Charar-e- Sharief Circle A and Chadoora A. TSO Charar-e-Sharief Circle A told CNS that instead of re- ceiving total allotment of 278 quintals, he received only 213 quintals while TSO Chadoora A said that till date he has re- ceived nothing from the Nag- am Granary. “I was supposed to receive 168 quintals of rice for BPL category but have not received anything till date,” he said adding that the current month is almost over,” he said. According to the KNS correspondent, the divi- sion bench of SHRC heard the case of the unmarked graves on Thursday after an application was filed in the commission by the human rights group- seeking identification of the persons buried in un- marked graves via DNA sampling. The state gov- ernment in its argument stated that it is ready to go for the DNA sampling of the any person buried in the grave if the per- son’s family identifies the spot that it believes to be of their relative’s grave. The human rights group namely voice of victims while pleading the case termed government’s ar- guments as ‘shameless’ maintaining that if the family would have been with the knowledge about grave of its member that it would have been in the jurisdiction of the magis- trate to open up the grave and carry out the DNA sampling. After hearing the prayers of both the parties, the commission asked the rights group to approach the police as the depart- ment has established the separate section for the issue-m being headed by SP. SHRC further re- marked that it will use its authority in case the po- lice fails to do the needful. The next date for the hearing of the case has been scheduled as August 21, 2014. Pertinently, the state government earlier had informed the SHRC that it was not possible for it to conduct DNA pro- filing of the unmarked graves due to lack of ad- equate forensic labora- tories and financial re- sources required for such a massive exercise. The SHRC in September 2011 had asked the state government to conduct DNA profiling of the bod- ies in unmarked graves in north Kashmir to set at rest speculations that peo- ple buried, and claimed to be militants by security forces, were persons who went missing under sus- picious circumstances since eruption of mili- tancy in the state in 1989. In response to the letter of SHRC bearing number 2013/174/2099 dated August 19, 2013, the Direc- tor General of Police (DGP) has said: “The enquiry got conducted into the matter reveals that after communal riots at Kishtwar on August 9, 2013 the members of a community took out a protest rally at Paddar and damaged the shop of one member of another community. The protesters had thrown out all the items of the shop and burnt these items. The report further reveals that next day on August 10, 2013 mem- bers of a community took out a procession from Athol Paddar. Similarly members of another community of village Jijai came out of their houses and took out a protest march. The procession of one community also reached near Kijai Bridge and pelted stones upon the houses of another com- munity. In retaliation the mem- bers of another community also pelted stones upon the protesters. The members of VDC Kajaiee fired some shots in air. Srinagar, Jun 26 : The State Human Rights Com-mission (SHRC) Thursday stated that it will use its power if the police fails to carry DNA sampling and identification of the per-sons buried in unmarked graves in Kashmir valley.According to the KNS correspondent, the divi-sion bench of SHRC heard the case of the unmarked graves on Thursday after an application was filed in the commission by the human rights group- seeking identification of the persons buried in un-marked graves via DNA sampling. The state gov-ernment in its argument stated that it is ready to go for the DNA sampling of the any person buried in the grave if the per-son’s family identifies the spot that it believes to be of their relative’s grave.The human rights group namely voice of victims while pleading the case termed government’s ar-guments as ‘shameless’ maintaining that if the family would have been with the knowledge about grave of its member that it would have been in the jurisdiction of the magis-

trate to open up the grave and carry out the DNA sampling.After hearing the prayers of both the parties, the commission asked the rights group to approach the police as the depart-ment has established the separate section for the issue-m being headed by SP. SHRC further re-marked that it will use its authority in case the po-lice fails to do the needful.The next date for the hearing of the case has been scheduled as August 21, 2014. Pertinently, the state government earlier had informed the SHRC that it was not possible for it to conduct DNA pro-filing of the unmarked graves due to lack of ad-equate forensic labora-tories and financial re-sources required for such a massive exercise.The SHRC in September 2011 had asked the state government to conduct DNA profiling of the bod-ies in unmarked graves in north Kashmir to set at rest speculations that peo-ple buried, and claimed to be militants by security forces, were persons who went missing under sus-picious circumstances since eruption of mili-tancy in the state in 1989. Srinagar, June 26 : The police has denied role of Village Defence Committee (VDC) members into killing of Lassa Khanday, a civil-ian whose body was found at heli-pad in Padder Kishtwar last year

during the communal riots.

In response to the letter of SHRC bearing number 2013/174/2099 dated August 19, 2013, the Direc-tor General of Police (DGP) has said: “The enquiry got conducted into the matter reveals that after

communal riots at Kishtwar on August 9, 2013 the members of a community took out a protest rally at Paddar and damaged the shop of one member of another community. The protesters had thrown out all the items of the shop and burnt these items.

The report further reveals that next day on August 10, 2013 mem-bers of a community took out a procession from Athol Paddar. Similarly members of another community of village Jijai came out of their houses and took out a protest march. The procession of one community also reached near Kijai Bridge and pelted stones upon the houses of another com-munity. In retaliation the mem-bers of another community also pelted stones upon the protesters. The members of VDC Kajaiee fired some shots in air. On this the protesters dispersed and went towards village Karthaie. In the meanwhile the members of the one community blocked the road at Kajaiee. There was exchange of fire between VDC members of Ka-jaiee and one

agreement between India and Pakistan,” Mr Ganai added.While discussing various demands and problems be-ing faced by the traders associated with cross LOC trade at Salamabad, Uri and Chakan da bagh, Poonch, it was felt that there is urgent need for further aug-mentation and streamlining of the cross LOC trade. It was agreed that the additional items to be included for trade shall be forwarded by the Industries & Com-merce Department to the Ministry of Home Affairs for its inclusion in the agreed list of items in the SOP.Regarding banking facilities, the Joint Secretary informed that the matter has already been taken up with the Government of Pakistan and the Ministry will pursue the matter with them vigorously. Pro-vision of ISD facilities to the senior officers dealing with the cross LOC trade and the designated heads of traders association was also agreed to.The meeting was informed that the tendering process for purchase of Full Body Truck Scanners has been completed and a team of experts will be sent soon to identify the location and advice on the preparato-ry work before installation. During the meeting en-hancement of cash amount to be carried by the pas-sengers travelling across to PoK was also agreed to and a proposal to this effect will be submitted by the Home Department to the MHA for approval. Opening of additional trade routes, issuance of Visa permits and maintenance of balance sheet for goods traded across LOC from both sides were also discussed in the meeting.Upgradation of infrastructure at TFC Salamabad, Uri and TFC Chakan da Bagh was agreed and the custo-dians of the respective TFCs were directed to submit the updated proposals to the State Government for further necessary action and release of funds by the MHA. Upgradation of road and communication facili-ties from TFCs to zero line, visit of traders across LOC also came up for discussion and it was agreed that the Home Department will submit its recommendations to the Ministry of Home Affairs for obtaining nec-essary clearance from the Government of Pakistan. Ganai, thanked the visiting dignitaries for according positive consideration to all the issues of cross LOC trade. He expressed hope that cross LOC trade will further grow for the mutual benefit of the traders and people on both sides of LOC. (KNS)

The DGP has informed the SHRC that the enquiry report also reveals that when the se-riously injured persons were being taken to Helipad Padder for their further shifting to Kishtwar/Jammu through chopper, one Lassa son of Mahmadoo Khan-day was also accompanying the injured in the ambu-lance as an attendant.“When the ambulance reached near Helipad, a provoc-ative mob of a community tried to attack the ambu-lance. The police tried to control the mob and even fired some gun shots in the air but the mob damaged the fencing of the Helipad and forced their entry into the premises. They broke the door of the ambulance and dragged out Lassa son of Mohmadoo Khanday from the ambulance. The protesters taking the advan-tage of the heavy rains took Lassa to some distance where he was beaten up severely due to which he died and his dead body was thrown near the helipad. In this connection a case FIR number 17/2013 under section 364, 307, 147, 148, 336 427, 34 RPC stands reg-istered in police station Atholi. After completing all legal formalities including post mortem the dead body was handed over to his legal heirs for last rites.”Report further adds that deceased Lassa son of Mo-hammadoo Khanday was not killed by the VDC members but was skilled by the provocative mob at Helipad Padder. Interacting with the cricket bat manufacturers, the Minister directed MD SICOP to prepare a detailed project report (DPR) for modernization of Bijbehera Sports Complex and allotment of land to the bat manufacturers. “The cricket bat industry has great po-tential for up-gradation. Once the DPR is prepared, new techniques for bat manufactur-ing will be adopted that will enable us to compete with other reputed bat manufacturing sectors in the country like Jalandhar and Meerut,” he said, adding that PPDC (Product-cum-Process Development Centre) Meerut which has helped us in the past in creation of cleft seasoning plant at Sethar, near Bijbehara, shall again be requested for moderniza-tion of the cleft manufacturing units of the Valley.Earlier, the Minister visited Govern-ment Joinery Mills, at Pampore, and reviewed its functioning. He asked the Director JKI to immediately take effective steps for upgradation of the joinery mills, which was ap-proved in the recently-held Board of Directors’ meeting at Srinagar. “The up-gradation of the Pampore Joinery mills will create additional job opportunities and also allow us to optimally utilize Government infrastructure,” he said. Later, the Minister visited Entre-preneur Development Institute (EDI) at Pampore and reviewed its trainings programmes under various employment-oriented schemes. Director EDI, M.I Parray briefed the Min-ister about the infrastructure upgradation and the courses offered to students who show inclination towards entrepreneurship and resist temptation of Government jobs.

CS reviews NRHM progressSRINAGAR, JUNE 26- The

Governing Body of State Health Society (NRHM) met here today under the Chairmanship of Chief Secretary, Mr. Mohammad Iqbal Khandey to review the progress achieved under the mission.

Chief Secretary received brief regarding health indicators and implementation status of various schemes and programmes cov-ered under the mission.

While the Functional Delivery Points have been increased from 131 in 2012-13 to 150 in 2013-14, Chief Secretary stressed for en-suring that all new-born are de-livered at the health facilities and mother and child has easy and timely access to proper Medicare.

Chief Secretary directed for fo-cusing on upgradation of facilities in the health institutions, aug-mentation of doctors and para-medical staff and strengthening of Emergency Response Service in the State.

Till date an amount of Rs. 1190

crore has been spent on vari-ous components under National Health Mission including Rs. 337 crore spent during 2013-14.

for pregnant women during ante-natal/ postnatal care and infants upto 1 year.

Meanwhile, the Chief Sec-retary asked for expanding the dimensions of the criteria for categorization of health facili-ties falling in difficult areas along with subsequent reworking of the financial incentives per month proposed for Allopathic/AYUSH doctors hired under NRHM to be deployed in these health facilities.

The decision of union govt. to earmark Rs.Twenty thou-sand crore for devel-opment of road com-

munication in J&k and North Eastern states is a welcome step and should be hailed by one and all. There were fears that the BJP govt. will not be much interested in the devel-opment of J&K as compared to UPA which has sanctioned some good projects for the state. However the decision has cleared all the doubts and apprehensions and it seems that the present govt. headed by Mr. N.Modi is inclined to make J&K a model state as far as development of basic infra-structure is concerned. There is no doubt the this hilly state with a difficult terrain is far behind in all sectors includ-ing road connectivity which is only 25% to 30%. The only National High Way connect-ing the valley with rest of the country is depleted and has become a death trap for pas-sangers.The four laneing of this highway has almost been stopped and the company do-ing the job has already asked for extention of one year to complete the job even be-tween Srinagar to Anantnag.If the same pace of work con-tinues, the project from Ud-hampur to Srinagar will take another decade to be complet-ed. The central govt. should view this situation seriously and efforts should be under-taken to complete the proj-ect on time so that the high-way reduces the travelling time besides strengthening the economy of the state . In all the road communication in the state is too poor which needs immediate attention of the central govt. so that steps are taken to make movement of the people and goods fast-er. The economic stability of any state depends on its roads which play an important role in taking the state ahead on the path of development. The new budget will ensure bet-ter roads which means better trade, better tourism, better employment and better move-ment in all spheres of life

Environment Protection under Constitutional Framework of India

he constitution of India is not an inert but a living document which evolves and grows with time. The specific provisions on environment protection in the constitution are also result of this evolving nature and growth potential of the fun-damental law of the land. The pre-amble to our constitution ensures socialist pattern of the society and dignity of the individual. Decent standard of living and pollution free environment is inherent in this. The Environment (Protection) Act, 1986 defines environment as “environment includes water, air and land and the interrelationship which exists among and between air, water and land and human be-ings, other living creatures, plants, micro-organism and property”. The chapter on fundamen-tal duties of the Indian Constitution clearly imposes duty on every citi-zen to protect environment. Article 51-A (g), says that “It shall be duty of every citizen of India to protect and improve the natural environment including forests, lakes, rivers and wild life and to have compassion for living creatures.” The Directive principles un-der the Indian constitution directed towards ideals of building welfare state. Healthy environment is also one of the elements of welfare state. Article 47 provides that the State shall regard the raising of the lev-el of nutrition and the standard of living of its people and the improve-ment of public health as among its primary duties. The improvement of public health also includes the protection and improvement of en-vironment without which public health cannot be assured. Article 48 deals with organization of ag-riculture and animal husbandry. It directs the State to take steps to organize agriculture and animal

husbandry on modern and scien-tific lines. In particular, it should take steps for preserving and im-proving the breeds and prohibiting the slaughter of cows and calves and other milch and draught cat-tle. Article 48 -A of the constitution says that “the state shall endeavor to protect and improve the environ-ment and to safeguard the forests and wild life of the country”. The Constitution of India un-der part III guarantees fundamental rights which are essential for the development of every individual and to which a person is inherently entitled by virtue of being human alone. Right to environment is also a right without which development of individual and realisation of his or her full potential shall not be possible. Articles 21, 14 and 19 of this part have been used for envi-ronmental protection. According to Article 21 of the constitution, “no person shall be deprived of his life or personal liberty except according to proce-dure established by law”. Article 21 has received liberal interpretation from time to time after the decision of the Supreme Court in Maneka Gandhi vs. Union of India, (AIR 1978 SC 597). Article 21 guarantees fundamental right to life. Right to environment, free of danger of dis-ease and infection is inherent in it. Right to healthy environment is important attribute of right to live with human dignity. The right to live in a healthy environment as part of Article 21 of the Constitu-tion was first recognized in the case of Rural Litigation and Entitlement Kendra vs. State, AIR 1988 SC 2187 (Popularly known as Dehradun Quarrying Case). It is the first case of this kind in India, involving is-sues relating to environment and

ecological balance in which Su-preme Court directed to stop the ex-cavation (illegal mining) under the Environment (Protection) Act, 1986. In M.C. Mehta vs. Union of India, AIR 1987 SC 1086 the Supreme Court treated the right to live in pollution free environment as a part of funda-mental right to life under Article 21 of the Constitution. Excessive noise creates pol-lution in the society. The consti-tution of India under Article 19 (1) (a) read with Article 21 of the constitution guarantees right to decent environment and right to live peacefully. In PA Jacob vs. The Superintendent of Police Kot-tayam, AIR 1993 Ker 1, the Kera-la High Court held that freedom of speech under article 19 (1)(a) does not include freedom to use loud speakers or sound amplifi-ers. Thus, noise pollution caused by the loud speakers can be con-trolled under article 19 (1) (a) of the constitution. Article 19 (1) (g) of the Indian constitution confers fundamental right on every citizen to practice any profession or to carry on any occupation, trade or business. This is subject to reasonable re-strictions. A citizen cannot carry on business activity, if it is health hazards to the society or general public. Thus safeguards for en-vironment protection are inher-ent in this. The Supreme Court, while deciding the matter relating to carrying on trade of liquor in Cooverjee B. Bharucha Vs Excise commissioner, Ajmer (1954, SC 220) observed that, if there is clash between environmental protec-tion and right to freedom of trade and occupation, the courts have to balance environmental interests with the fundamental rights to carry on any occupations.

Public Interest Litigation under Article 32 and 226 of the constitution of India resulted in a wave of environmental litiga-tion. The leading environmental cases decided by the Supreme Court includes case of closure of limestone quarries in the Dehra-dun region (Dehradun Quarrying case, AIR 1985 SC 652), the instal-lation of safeguard at a chlorine plant in Delhi (M.C. Mehta V. Union of India, AIR 1988 SC 1037) etc. In Vellore Citizens Welfare Forum vs. Union of India (1996) 5 SCC 647, the Court observed that “the Precautionary Principle” and “the Polluter Pays Principle” are essential features of “Sustainable Development.” At local and village level also, Panchayats have been em-powered under the constitution to take measures such as soil conser-vation, water management, forest-ry and protection of the environ-ment and promotion of ecological aspect. Environment protection is part of our cultural values and traditions. In Atharvaveda, it has been said that “Man’s paradise is on earth; this living world is the beloved place of all; It has the bless-ings of nature’s bounties; live in a lovely spirit”. Earth is our paradise and it is our duty to protect our par-adise. The constitution of India em-bodies the framework of protec-tion and preservation of nature without which life cannot be en-joyed. The knowledge of consti-tutional provisions regarding environment protection is need of the day to bring greater pub-lic participation, environmen-tal awareness, environmental education and sensitize the people to preserve ecology and environ-ment.

ight from the moment when a produce is har-vested from the farm to the time it takes to be on board for moving to its desired destination, the life of the agricultural produce gets battered at various stages. It is estimated that almost 30-40 per cent of the produce of fruits and vegetables is wasted due to lack of adequate infrastructure for post-harvest handling, transportation and storage. The inadequacy of post-harvest infra-structure facilities and wastage has persistently been underlined as a major bottleneck in boost-ing export of perishable products from India. Apart from it, the country’s agriculture export policy sometimes gets affected by short term interventions or restraints like ban on export of farm produce in the times of sudden price rise or supply constrictions. Whenever such restraints are imposed, processed and/or val-ue added products have to bear the brunt. Pro-cessed food sector and value addition in India forms but a minuscule portion of the overall agri economy and accounts for a small fraction of export of their commodities. Requirement of continuity in policy regime for encouraging in-vestment in processed food sector is therefore an imperative.In the light of all these problems, the Govern-ment, in coordination with Agricultural and Processed Food Products Export Development Authority (APEDA), has been providing nec-essary technical inputs and financial assis-tance. APEDA has taken several initiatives for promoting export of perishable commodities. APEDA has set up common infrastructure facilities like Centres for Perishable Cargo (CPC) at various international airports like Delhi, Mumbai, Kolkata, Bagdogra, Amritsar, Hyderabad, Bengaluru, Chennai, Goa, Nashik, Vapour Heat Treatment facilities for export of mangoes to Japan and Australia, Irradia-tion facilities for export of mangoes to USA, integrated pack houses, pre-cooling facilities, high humidity cold stores, Asceptic Packag-ing Unit and collection centres among others. In addition, exporters, through Scheme of In-frastructure Development, are encouraged for purchase of reefer vans, setting up integrated pack houses, pre-cooling facilities, high hu-midity cold stores etc. so as to maintain cool chain which ultimately helps in maintaining the quality of the produce exported from India.Appropriate market intelligence in terms of reliable trade data on demand, supply, season, process etc. is another critical requirement

of the exporters to diversify and explore new markets. APEDA has achieved market access for various products in hitherto inaccessible markets such as mango to USA, Japan, Austra-lia and China; grapes and bitter gourd to Chi-na, basmati rice to Japan, Mexico and China; mango products to Mexico, livestock products to Algeria, Syria, Egypt, Morocco etc. Packag-ing is critical for delivery of product in good condition. APEDA has got developed packag-ing standards and specifications for various fruits, vegetables, cut flowers etc. Exporters using packaging of these standards and speci-fications are also given financial assistance to the tune of a maximum of Rs. 5 lakhs per an-num.Food safety is a primary concern in interna-tional trade. There is an increasing need to provide greater assurance about the safety and quality of food to the end consumers. Pay-ing heed to the concerns of food safety and traceability shown by importing countries, APEDA has introduced traceability system for export of grapes to the EU countries via GrapeNet, pomegranates to EU via AnarNet and organic products via TraceNet. APE-DA has encouraged and provided financial assistance to exporters for implementation of food safety standards in various sectors such as meat, poultry and dairy manufactur-ing units, units manufacturing mango pulp, pickles, dehydrated products etc. APEDA has also introduced a stringent system for rec-ognition of export testing laboratories (23 at present), which has helped in upgrading their testing capabilities in terms of human skills and testing infrastructure. Research & Development is an important activ-ity with the objective of export enhancement programme. For the benefit of processors/exporters, APEDA gets R&D work conducted through expert institutions in accordance with trade requirement for development of value added products, improvement in pro-cessing technologies, development of new varieties etc. High airfreight cost has been a persistently inhibiting factor in enhanc-ing export potential and erodes the produc-tion cost advantage in India. High storage and inland transportation costs further aggravate the situation impeding growth in export of agricultural and processed food ex-ports. Through the scheme for Transport As-sistance, aid to exporters of horticultural, flo-

riculture, processed food and animal products is extended. To further facilitate the export of perishable agri produce, the Government through the Foreign Trade Policy 2009-14 made a provision for introduction of a Single Win-dow System.Apart from these initiatives, APEDA has also taken several other export promotion measures for fruits and vegetables from time to time. A number of agri export zones for fruits and vege-tables have been set up in different parts of the country. AEZs entail focused channelisation of efforts and assistance in a converged fashion for the overall development of supply and val-ue chain of the identified produce. APEDA also encourages exporters to participate with it in various international trade fairs which offers opportunity to the participants to get exposure and access to business channels overseas, thus augmenting export opportunities. APEDA has initiated a programme for integrated training of horticulture produce for some identified fruits like grapes, mangoes, litchis in selected regions. In the first step, APEDA has selected certain varieties of mangoes from the major producing belt i.e. Alphonso mangoes from Ratnagiri, Kesar mangoes from Aurangabad. APEDA has implemented the Integrated Training Programme in identified mango areas, response of which have been en-couraging. APEDA has also made efforts to establish a semi-commercial facility in India to meet the commercial require-ment. In this direction, APEDA received a 1.5 tonne capacity machine to treat 20 feet containers (8-10 tonnes in one-day treat-ment). This facility has been established by Maharashtra State Agricultural Mar-keting Board (MSAMB) at Vashi, Mumbai. APEDA has also initiated experiments of Controlled Atmosphere containers for the sea transportation of mangoes to various countries. APEDA has also been providing financial assistance to exporters for pack-aging, infrastructure development like packhouses, pre-cooling facilities, reefer vans etc, brand publicity through adver-tisement, purchase of laboratory testing equipment and implementation of quality systems etc. In this way, efforts for upgra-dation of post-harvest handling, distribu-tion and marketing facilities have been able to cut down on wastages and for preserving the quality of fresh produce.
