AHPRA's operations are governed by the Health Practitioner Regulation National Law, as in force in each state and territory (the National Law), which came into effect on 1 July 2010.

Checking Your Registration• You can check your own
registration status and details by searching the Register of Practitioners.
• Employers and the public can also use the online register to check whether a practitioner is registered.
• The register also indicates whether a practitioner is in the ‘grace period’.
This is an example of how you can check your registration – in this example we are searching the nursing register.
Renewal Date
Under the national scheme, there is one designated datefor the renewal of registration for nurses and midwives…
this date is 31 May.

Criminal HistoryExamples of common crimes:
• Assault • Theft (larceny)• Possession of prohibited substances• Driving under the influence of alcohol or other drugs
Health Practitioner Regulation National Law (NSW) No 86a
“A registered health practitioner…. must, within 7 days of becoming aware that a relevant event has occurred… give the National Board established for the practitioner’s or student’s health profession
written notice of the event”
Relevant event = charged with an offense punishable by 12 months imprisonment or more
Professional Indemnity Insurance (“PII”)
• In NSW, PII is generally covered by the employer – employers are liable for negligence of their employees (except in cases of serious wilful misconduct);
• The NSWNMA PII policy covers financial members of the Association who were members at the time of an incident giving rise to the claim;
• The NSWNMA PII provides additional coverage by covering representation in coronial inquests, NSW Civil and Administrative Tribunal (NCAT) proceedings and costs orders arising from such matters;
• For privately practising nurses (secondary employment);• Specifically excludes private midwifery services and homebirths.
Recency of Practice • Nurses and midwives must have undertaken sufficient practice within the preceding 5
years – of 450 hours – to demonstrate competence in their profession.
• Practice is defined as any role, whether remunerated or not, in which the individual uses skill and knowledge as a nurse or midwife.
What is PracticeFor the purposes of this registration standard, practice is not restricted to providing direct clinical care:
• working in management;• administration;• education; • research;• advisory; • regulatory or policy development roles; • any other role/s that impact on safe, effective delivery of
services in the profession and/or use their professional skills.
How Do I Describe My Context of Practice
Context of practice – conditions that define an individual’s nursing/midwifery practice.
These include: • Practice setting • Location of the practice setting • Characteristics of patients or clients • Focus of activities • Degree in which practice is autonomous• Resources that are available.
Continuing Professional Development (CPD)
The Nursing and Midwifery Board of Australia (NMBA) defines CPD as:
… the means by which members of the profession maintain, improve and broaden their knowledge, expertise and competence,
and develop the personal and professional qualities required throughout their professional lives.

Continuing Professional Development (CPD)
• Section 128 of the National Law requires CPD be completed by a registered health practitioner in accordance with the Registration Standard.
• The Registration Standard for nurses and midwives requires them to complete 20 hours of active learning (if dual registration, e.g. nurse + midwife = 40 hours CPD)
• Endorsement medication – e.g. Nurse Practitioners, Midwives, and some RNs working in rural/remote areas = 10 hours medication CPD (additional)
• Active learning must be relevant to the context of their practice of nursing and midwifery)
Continuing Professional Development (CPD)
• This registration standard applies to all ENs, RNs, and midwives – full time or part-time – including practitioners on leave from work (e,g – maternity leave)
• You should maintain your own records of all the CPD you complete.
• ASSESS PLAN COMPLETE REFLECT (and repeat).
• Year of practice is 1st June to 31st May every year

CPD for National Registration
• If you have been registered for a period of less than 12 months prior to the renewal of registration, pro rata CPD requirements apply
• You don’t need to meet this standard when you apply for registration in Australia as a nurse and/or midwife.
• One hour of CPD = One hour of “active learning”.
• Points are not relevant to the NMBA’S requirement for CPD for ongoing registration –only Hours may be counted.

CPD Activities
• The CPD activities must be relevant to the context of practice and meet the individual learning needs.
• A broad range of activities can be recognised as CPD – including mandatory in-service and education.
• CPD activities can be audited, and may also be checked if the NMBA receives a notification about you

COVID-19• Self-directed/online learning will make up an important part of your CPD. This could be
through the following:
o The Australian Nursing and Midwifery Federation has an online education service where members can access courses, at a rate of $8.90 per course
o COVID-19 infection control training
o NSWNMA podcasts
o Reading and reviewing the Nursing and Midwifery Board of Australia’s (NMBA) codes and standards
o Any type of learning you have had to undertake to prepare you for COVID-19 (in-services, reviewing workplace policies, online learning modules, journal articles)
CPD Activities
• You must keep records of your CPD activities for a period of five years from the date you completed the CPD.
• All CPD records must be available for audit or if needed by the NMBA as part of an investigation arising from a notification (complaint).
• CPD record must include: o Type of activity o Description of topics coveredo Reflection on activity and specification to practiceo Evidence provided o CPD hours
o Date o Source / provider detailso Identified learning needso Action plan
CPD records may include participation in the following activities:
• Tertiary and other accredited courses, including distance education (needs to relate to context of practice);
• Conferences, forums, seminars and symposia; • Short courses, workshops, seminars and discussion groups through a professional
group or organisation who may issue a certificate of compliance/completion;• Mandatory learning activities in the workplace in the
area of practice; • Service to the profession; • Self directed learning; and • Any other structured activities not covered above.

Documenting CPD
The NMBA expects nurses and midwives to demonstrate that they have taken a planned approach to completion of their CPD for the year.
Nurses and midwives must demonstrate that they have:
• Identified their learning needs;• Developed a brief learning plan based on the needs
identified and their practice against recognised Professional Standards;
• Participated in CPD activities which meet these learning needs and reflected on the value of these activities to their practice.
NMBA Guidelines: CPD (2016)
Research shows that CPD is more effective when it involves planning and reflection.
You will get most benefit from your CPD activities by planning your learning goals and the activities to meet these goals, completing your CPD and then recording reflections on your learning.
CPD - Key Points
• CPD hours cannot be banked;• Need to keep records for 5 years;• Nurses 20 hours and midwives 20 hours – does not have to be separate if
relevant to both;• Base on the standards – Learning needs;• CPD must be active learning;• Doing something; • Reading, need to provide proof;• No one has to sign off on CPD –
“up to you” “all about you”.
