From the President…Dear Members and Colleagues:

I am honored to now serve as your President! When I joined NCISS several years ago, I had no idea I would be joining such precedence in leadership – I had no plans to be involved in any leadership position. By invitation, I started on the membership committee – from my first conference in Chicago in 2010. With it being hard to say ‘no’ to the importance of NCISS, I accepted nominations to Regional Director, Secretary and then the Vice President positions.

Like you, I am a member of my state association (Professional Private Investigators Association of Colorado), as well as other state and national associations. They each serve very important purposes of importance to each person and our professions. As I mentioned at my acceptance, NCISS is the most important association I belong to – because it keeps each of us in business with access to the tools and resources we need. NCISS

does this with the support of membership – YOU! We partner with our member state associations to be more effective in federal legislation and regulations, and for state associations to be more effective locally – The Two Halves – Together We’re Better!

Recently the first 100 days of the new board passed, with many great accomplishments. Most of these have been to improve the communications and functions of NCISS with our members. You have probably noticed the finalizing the website and changing over to a more robust and friendly listserv, not subject to the spam and whims of Yahoogroups, and NCISS is now on social media. In addition, we have worked with existing Vendors & Sponsors with some exciting announcements soon, and have also added ParcelDocs as a Supporter by NCISS member Peter Duffey. Many have asked, and it is a good way of sharing news of NCISS and our professions with a larger audience. The next target for more accomplishments is the Mid-Term Meeting to be held in October – arrive the 23rd and the meeting to be held the 24th; with extra days for visiting the splendor of Las Vegas.

From the Board…In November 2016 the United States of America will be electing its 45th President. Both parties have decided which candidates they feel has what it takes to lead the Country for the next four years.

The good news is NCISS is an issue based association that cuts across party lines when it comes to protecting our industry. NCISS continues to monitor all relevant bills that may have either a negative or positive impact on our industry. Furthermore, NCISS is your one stop shop for up-to-date legislative bill movements.

NCISS leadership and its members understand the value of advocacy. That advocacy is demonstrated through by our strong support at your state association conferences, and leadership of your new President and his talented executive team.

Finally, that advocacy is demonstrated in the spring each year when we meet with our nation's leaders to ensure they are connected with their respective constituents. New relationships will need to be fostered because of the elections. Our concerns will need to be introduced to new leaders. This is not a problem because we are "THE NATIONAL VOICE OF THE PRIVATE INVESTIGATION AND SECURITY PROFESSIONS"! – James Huckabee, Board Chairman and Immediate Past President

Strength comes in numbers and together NCISS has the strongest voice. We continue to come together with our member state associations – The Two Halves. State associations monitor and advocate for you with state legislation and regulations; and NCISS monitors and advocates for you with federal legislation and regulations. By joining together to bond, unite, and galvanize our energy and resources, NCISS continues to communicate with our Senators and Representatives, as well as federal agency regulators, to support those issues important to us, and offer solutions to those laws and regulations that might have an adverse effect on our professions – together our efforts keep us in business with the tools and resources we use and need for our clients.

Probably, by the time you are reading this, I will be speaking to current and new NCISS members at our booth at the World Investigators Conference. Stop by, and bring a friend to join NCISS – we are offering a discount, and a chance to win a prize. As 2nd Vice President and Security Legislative Chair my focus has been on legislation, sponsorships, and overall promotion of NCISS. We have met recently with legislators in Iowa on issues affecting our industry, most notably the Overtime Rule and our hopes that it can still be delayed or stopped.

I'm excited to have helped secure EmbroidMe from Davenport, IA as a Bronze sponsor ($2,500) for another year. We appreciate the support of all of our sponsors, and I'm trying to help secure others. I will be attending the ASIS annual conference in September, along with the National Security Alliance meeting, where I hope to promote NCISS and hopefully gain some new members. Lastly, I'm glad to have helped launch NCISS on social media in a more meaningful way. Hopefully this can help broaden the message of our good work more than ever. – Brad Duffy, 2nd Vice President

The end of July I was reminded how important our recent "you need both halves for the best legislative protection" campaign is when NCISS had to step in and come to the aide of our state associations (INspi and IAPI) to ultimately protect our national interests and to "keep the government from legislating us out of business" (thanks to Past President Eddie McClain for that age old motto). in an effort to reduce the size of state government, the Indiana governor formed a committee recommending the elimination of the state licensing board overseeing private detectives and security guard agencies and 30 other professions. While the national trend (and NCISS position) is that every state have some form of private detective or security guard licensing, Indiana was on the verge of being the first state to "buck the system" and reverse the trend. NCISS could not sit by and idly watch.

NCISS President Dean Beers drafted a NCISS position paper for the licensing board, in favor of maintaining the status quo and continuing the licensing of our professions. NCISS members Brandy Lord, Don Johnson, George Gergis and myself attended the hearing and provided testimony. The board ultimately made a motion and unanimous vote to keep private detective and security guard licensing as is, and possibly consider additional licensing requirements, or continuing education. This is a very important victory for the people of Indiana, Private Detectives & Security Guards in Indiana, and NCISS – we are all very proud of our state associations who took this battle on firsthand. – Dean Gluth, 3rd Vice President

40 Years of Success!Drivers Privacy Protection Act (DPPA) - 1994

} In 1994, when Congress moved to close all motor vehicle records nationwide, NCISS successfully stopped the action and negotiated the language in the DPPA which allows access to the records for the following purposes: 18 U.S.C. § 2721 et. seq. “4) For use in connection with any civil, criminal, administrative, or arbitral proceeding in any Federal, State, or local court or agency or before any self-regulatory body, including the service of process, investigation in anticipation of litigation, and the execution or enforcement of judgments and orders, or pursuant to an order of a Federal, State, or local court.”

Gramm-Leach-Bliley Act (GLBA) - 1999 } Gramm-Leach-Bliley Act enacted a mandatory procedure that required all financial institutions to have a policy to protect consumer non-public information from foreseeable threats in security and data integrity. One of the provisions included pretexting protections related to the collection, disclosure, and protection of consumers’ nonpublic personal or personally identifiable information. The result was the severe restriction of bank account investigation. NCISS was able to obtain exemptions for child support enforcement.

Fair Credit Reporting Act (FCRA) - 2003 } As amended in 1996, the FCRA required employers to gain permission from a subject-employee to investigate that employee. If any adverse action was taken against that employee, the employer was then required to provide the investigative report to the employee. NCISS’s diligent work successfully effected change to correct the unintended consequences in the FCRA affecting workplace investigations.

Second Amendment – June 2008 } NCISS, along with several other state investigative and security associations, joined forces to file an “industry” amicus brief in support of the security guard Dick Heller’s claim before The Supreme Court of the United States, District of Columbia, et al. On June 26, 2008, the U. S. Supreme Court the District of Columbia’s 32-year old ban on handguns was incompatible with the Second Amendment.

Social Security Numbers } There are ongoing efforts in Congress to remove the Social Security number as a unique identifier. It is anticipated such measures will be introduced again. So far, NCISS has been successful in staving off this restrictive action.

Pretext } NCISS is protecting your right to use a pretext, a recognized investigative tool for lawful purposes. Without continual monitoring, privacy advocates and Congress will seek to ban any pretense which would then undermine undercover investigations, shopping services and various means of locating individuals.

I am happy to report that the licensing of Private Investigators and Security Guards in Indiana remains intact.

At a hearing this morning in Indianapolis the Governor's Jobs Creation Committee voted unanimously (7-0) to recommend continued licensing under the purview of the Indiana Private Investigators and Security Guard Licensing Board, a division of the Indiana Professional Licensing Agency which oversees over 35 boards and commissions. Indiana law dictates that all boards and commissions must be reviewed periodically to establish their continued efficacy and efficiency. Those reviews are the responsibility of the JCC, all governor appointees, which had 10 boards or commissions scheduled for review today.

Brandy Lord, George Gergis and Don C. Johnson. Also present today lending support was NCISS 3rd VP Dean Gluth, who is licensed in IL, IN and WI, and is a member of the Illinois licensing board.

NCISS was proud to come forward and offer our support through testimony of members - some traveling long distances from other states and at their own expense. The state association, INspi, has been a long-time State Association member and supporter of NCISS.

It is times like these that we realize how important it is to come together and bring the Two Halves - state associations and NCISS - together!

LONG TIME MEMBER HONORED

In a ceremony at the Capitol during the Annual NCISS Conference, long time member Dean Gluth was awarded the prestigious Vinson Award “in recognition of outstanding leadership, dedication and service to the National Council of Investigation and Security Services.” Gluth, president of InfoMAX headquartered in Schaumberg, Illinois was also elected as 3rd Vice President of the Council during the meeting.

With an early bent for investigation and security work, Dean Gluth earned his Bachelor’s Degree in Law Enforcement Administration with a minor in Security Management from Western Illinois University in 1983. He gravitated to retail loss prevention management for a number of years before seeking the investigative hours to qualify for his private detective license in Illinois. He is also licensed in Wisconsin and Indiana. In addition to being a Board member at NCISS, Gluth is also a Board member for ADSAI, Associated Detectives and Security Agencies of Illinois and as a Board member for IDFPR, Illinois Department of Financial & Professional Regulation. He holds memberships in INSPI, PAWLI and ILLAPPS.

Recipients of the Vinson Award have been chosen annually by the NCISS Executive Committee since 2012 and are usually members who have served as a Director or Committee Chair of the Council. Past recipients include Dean Beers of Colorado and Bill Fletcher of North Carolina. In 2013, the Vinson was awarded posthumously to Vincent Ruffolo, a revered past president, who helped lead NCISS for more than 35 years before his untimely passing.

Dean Gluth personifies the typical NCISS member who volunteers his time for the good of the profession and is the glue that holds our association together. He is justly deserving of this honor. - Eddy McClain, Chair - Awards Committee

Former Security Giant Tom Wathen Passes

The June 30, 2016 edition of the Los Angeles Times reports the death of former CALI and NCISS member Thomas W. Wathen at the age of 86. It’s a good read, whether you knew him or not. Tom, who in 1964 bought a 13 officer guard company and parlayed it into the biggest in the country, was above all a gentleman, who got along with everybody. If you closed your eyes when he spoke, you would swear you were listening to Henry Fonda. He gave such a good presentation at a CALI meeting in Fresno in 1971, that I decided our company must be missing something, and we started a guard operation. In about 1972-73 a new Bureau Chief was giving us headaches and as Chair of CALI’s Board I had a chance to work on legislation with Tom and Bob Rockwell who were some of the prime movers of the first security association, a CALSAGA predecessor. We had some amazing successes that benefited our security members for years. Over the years, every time I would congratulate Tom on some new acquisition or newsworthy milestone, he would always joke that he was just trying to get big enough to buy Krout & Schneider. In 1998 Tom made his most famous move buying Pinkerton. He sold that to Securitas for many millions and retired to pursue his hobbies of flying and restoring antique aircraft. Tom was a generous man who gave of himself to many charities. An investigator in his earlier life, Tom always made the profession look good.

Privacy Legislation Must Permit Continued Access to Vital DataNumerous bills have been introduced to protect consumer privacy. Investigators agree that Social Security numbers and other personal data should not be available to the general public on the Internet. These bills must permit investigators, however, to have access to this vital data.

Investigative Value of Social Security Numbers and Birthdates

Legislation to prohibit the sale of Social Security Number and Birthdate information would deny private investigators access to databases that are critical for helping distinguish individuals with similar names. This is particularly important with regard to women who may assume their husband’s name.How the data are used Social Security Number and Birthdate information are an integral part of “credit headers”, the non-credit portion of a credit report. This information can lead to current and former addresses of individuals being sought when combined with public record information by aggregators. This is a key to many of the functions performed by investigators. Of equal value is driver’s license information.Obtaining Criminal Histories Investigators do not have access to a central criminal history database, so it is essential to have address information when seeking information about prior convictions. With address data, investigators know which courthouse records to search. This information is important for more than pre-employment purposes. In both civil and criminal trials, attorneys need to know the backgrounds of witnesses and potential witnesses.Locating Ill Gotten Gains Address information is valuable in locating stolen assets. Daily, database information leads directly to the recovery fraudulently stolen monies and assets recovered by professional investigators.Finding Witnesses In both civil and criminal trials, justice is served best by all parties getting access to possible witnesses. The address information is used routinely to locate witnesses, including when they may be transient. Legislation restricting the use of Social Security Number and Birthdate information always provides exceptions for law enforcement. This creates an obvious issue of due process because prosecutors, with the full resources of the state, will have access while the accused will not.Obtaining Delinquent Child Support In numerous cases, such data have led to recovery of funds from persons not meeting their child support obligations.Locating Missing Persons Missing persons have been located with leads generated from credit headers, including abducted children.Assisting ID Theft Victims Law enforcement is often unable to assist victims, as demonstrated by the General Accountability Office. These victims turn to private investigators. Using databases, investigators are able to assist victims. During some cases, other victims are located through cross-referencing the Social Security numbers.

Vital Investigations Require Information AccessThe private security and investigation industries provide many valuable investigative services to businesses, the legal profession, consumers, and law enforcement agencies. Access to information is critical to perform these essential functions.Locating Witnesses Locating witnesses for both civil and criminal matters. Locating Missing Persons or Heirs Access to records is essential to find missing children, and executors to find heirs.Finding “Deadbeat Parents” Law enforcement often lacks the resources to assist parents. Professional investigators access to information is vital in the recovery of delinquent child support payments. Investigators assist in making financial recoveries, providing important resources for children and reducing public assistance rolls. Preventing Fraud & Fighting Identity Theft Insurance companies, banks and other institutions utilize investigators to uncover or prevent fraudulent activity. We assist identity theft victims by exposing and proving identify theft.Workplace Violence Employers are mandated to maintain a safe workplace. Databases are critical in investigating background of employees who have made threats against other employees. Sexual Harassment Employers are mandated by federal law to investigate claims of sexual harassment in the workplace. The EEOC recommends neutral third party investigators to determine the unbiased facts. An integral part of these investigations is determining the backgrounds of all parties.Locating Debtors Lawful judgments are of no value if the debtors and their assets cannot be found.Finding Pension Beneficiaries Social Security Numbers are used to locate persons who are eligible to receive a benefits and pension from former employers. Protecting Consumers Investigators work with both consumers and businesses to verify the backgrounds and licensing status of doctors, lawyers, school bus drivers and providers of child and elderly care. Information obtained by investigators can be used to determine if an individual has had a license suspended in another jurisdiction or a history of committing fraud or victimizing consumers.

In the month of June, Lobbyit met with the Senate Commerce Committee to discuss reauthorization of the Federal Aviation Administration (FAA) and drone regulation, discussed labor-related policy riders with House Appropriations Committee staff, and drafted and submitted a comment to the Office of Personnel Management concerning their proposed rule to ban the use of questions about past convictions in federal hiring decisions until after a conditional offer of employment was made.

In the month of July, Lobbyit met with the offices of Senator Lamar Alexander to discuss Senate Joint Resolution 34, sponsored in the House by Rep. Virginia Foxx (R-NC), and in the Senate by Lamar Alexander (R-TN), which would block implementation of the Department of Labor’s proposed “Overtime Rule”. Lobbyit also met with Senate Appropriations Chairman Thad Cochran’s office, and House Speaker Ryan’s office to discuss the prospects for the inclusion of a series of important policy riders in an “omnibus” appropriations bill at the end of calendar year 2016.

At HTH – NCISS Boar and Lobbyit met with Senate Commerce Committee Counsel

At this meeting, to discuss issues of importance to private investigators and security service providers, we were informed that that the Committee, over Chairman Thune's objection, had just adopted a series of amendments offered by Senator Markey (D-Ma) addressing information privacy and disclosure requirements for commercial drone operators.

Markey's primary amendment enhances the commercial and government drone database established by the bill by requiring that drone operators disclose if they collect personally identifiable information (PII) about an individual (including through the use of facial recognition), how the personal data will be used (including for advertising or marketing purposes), how that information will be handled, and when the sensitive information will be destroyed.

Markey's amendments would also require a more complete UAS profile to be included in the database. The existing bill requires the FAA to list the operator name, contact information, expiration date of authorization for UAS operation, and UAS identification number (akin to a "license plate" identification system). Markey's amendments mandate inclusion of this information as well as details on the location, time, and purpose of operations, and a list of the UAS' technical capabilities (camera-equipped, etc.).

NCISS Regulatory Alert -- Drone Rule Released On June 21, 2016 the Federal Aviation Administration (FAA) released their final rule on the operation of unmanned aerial vehicles (UAV - or "drones"), covering a broad spectrum of commercial uses for drones weighing less than 55 pounds.

Addressed in the rules are: Drone operators, Waivers, Pilot Certification, UAS Certification, Respecting Privacy, and Other Requirements

Presently NCISS continues to monitor this activity, and will keep our members and profession advised of any progress and concerns.

Overtime Rule Recently, the Obama Administration announced its new overtime pay rule, which is to go into effect on December 31, 2016. In short, the new rule raises to $47,476 the salary threshold under which virtually all workers qualify for overtime pay (more than double the current salary threshold of $23,660). Every three years, this amount will be indexed to inflation.

This new rule is the subject of several pieces of legislation introduced to block its implementation, including:

The Protecting Workplace Advancement and Opportunity Act (S. 2707/H.R. 4773)

This legislation would:

1) Prevent the department from finalizing the overtime rule;

2) Require the DOL to fully and accurately consider the economic impact of any rule on small businesses, nonprofits, institutions of higher education, and others who will be affected;

3) Ensure future changes to the salary threshold accurately reflect the economic realities facing workers and employers by making clear automatic increases are not allowed under current law; and

4) Promote transparency and accountability by requiring any changes to the duties tests be made available for public review and comment.

LegislationIn addition to appropriations language, NCISS and Lobbyit also met with other important members of the Commerce and Judiciary Committees in both the House and Senate to see whether other suspect legislation had a chance of moving as 2015 draws to a close (i.e. data broker, GPS tracking, firearm restrictions, etc.). We were assured that none of the legislation we've been tracking is currently on the agenda, but we know that much happens late at night while Congress wraps up a calendar year, so we will be watching closely.

S 177 -- Data Security and Breach Notification Act Official Title: A bill to protect consumers by requiring reasonable security policies and procedures to protect data containing personal information, and to provide for nationwide notice in the event of a breach of security.

S 237 -- Geolocational Privacy and Surveillance Act

Official Title: A bill to amend title 18, United States Code, to specify the circumstances in which a person may acquire geolocation information and for other purposes.

HR 1770 -- Personal Information Security and Notices of Breaches Official Title: A bill to require certain entities who collect and maintain personal information of individuals to secure such information and to provide notice to such individuals in the case of a breach of security involving such information, and for other purposes. HR 1893 -- Amend NLRA and Authority of NLRB for Unfair Labor Practices Official Title: A bill to amend the National Labor Relations Act to modify the authority of the National Labor Relations Board with respect to rulemaking, issuance of complaints, and authority over unfair labor practices. HR 1939 -- Amend FAA Modernization Reform Act to Prohibit Drones as Weapons Official Title: A bill to amend the FAA Modernization and Reform Act of 2012 to establish prohibitions to prevent the use of an unmanned aircraft system as a weapon while operating in the national airspace system, and for other purposes. HR 2246 -- Amend USC Title 18 Chapter 44 for Firearms and Interstate Transactions Official Title: A bill to amend chapter 44 of title 18, United States Code, to update certain procedures applicable to commerce in firearms and remove certain Federal restrictions on interstate firearms transactions. HR 2283 -- Bill Requiring In-Person Purchase of Ammunition, Licensing and Reporting Official Title: A bill to require face to face purchases of ammunition, to require licensing of ammunition dealers, and to require reporting regarding bulk purchases of ammunition. HR 2909 -- Protecting Firefighters and Promoting Innovation Act Official Title: A bill to establish an interagency working group to study the use of unmanned aircraft systems for wildland firefighting, and for other purposes. HR 3025 -- Wildfire Airspace Protection Act Official Title: A bill to amend title 18, United States Code, to provide a criminal penalty for launching drones that interfere with fighting wildfires affecting Federal property, and for other purposes.
