Yosemite PoliciesWholesale Only

Yosemite Home Décor sells products only to companies who provide resale licenses. Identification is required from all customers. Possession of, or access to, any Yosemite catalog, literature or websites does not constitute the right to purchase from Yosemite Home Décor. Yosemite reserves the right to correct publishing errors. Prices listed are wholesale, do not include freight and are subject to correction or change without notice. Customers are responsible for all applicable taxes or for providing a valid sales tax exemption certificate.

Payment Terms

Yosemite Home Décor accepts cash, checks, money orders, credit card ( Visa, Master Card, Discover, AMEX) and EFT payments. Credit card payments may be subject to a service fee up to 2.5% and also require verbal or written authorization prior to charging. Dealers may qualify for a 30 day dating term with approved credit. When applying for credit, applicants are required to provide a completed and signed credit application with trade references. Yosemite Home Décor reserves the right to approve or refuse credit applications at it’s sole and absolute discretion. For customers with approved credit, payment terms are net 30 days. Term starts from the date of shipment or pick-up and not on actual delivery date. If customer fails to make payment within the dating term, Yosemite Home Décor will add finance charges on any amount in default of 1.5% per month. Yosemite Home Décor may also defer shipments until such payment is made, or may at it’s option put the account on credit hold and cancel part and/or the entire unshipped orders.

Minimum Order

Every order that is less than $100 will incur a $15.00 minimum order charge.

Freight PolicyShipping Charges

Products are shipped F.O.B. shipping point with freight costs and handling fees paid by Yosemite and charged to the customer. Yosemite orders over $1500 (including any backorders, or a combination of lighting and artwork) are shipped in the US freight free, except when shipping to Canada, Alaska, and Hawaii. The deduction will only be allowed if the invoice is paid in full within the standard invoices terms. C.O.D. shipments are not permitted.

Other terms and conditions may apply for freight collect, special handling or shipments outside the contiguous United States. Any extra charges incurred for additional services, including but not limited to customer’s carrier or special handling by the carrier (gate lift, residential charges, etc), must be paid by the customer. Title and risk of loss pass to the customer upon tender of shipment to the carrier. If product is damaged in transit, customer must file claim with the carrier. Customer must file within 10 days of receipt of a shipment to our customer services department for incorrect orders. Otherwise our responsibility stops at that time and the order is acknowledged as shipped correct.

Free Freight

Orders exceeding $1,500 receive free freight within the continental United States. Some exclusions apply, see dealer for details.

Return of Merchandise

Products are not to be returned without a written authorization from Yosemite Home Décor with an authorization number. Any items sent to Yosemite Home Décor without an authorization form will be refused. If the return is approved the following can and will apply:

1. RA number must appear on all return paperwork and cartons.2. No credit will be issued if the item returned is missing any parts, packaging or

incomplete in any way.3. Items that are authorized to be returned and are within 6 months will be charged

a restocking fee of 25% plus freight. In order to receive credit item must be returned in its original packaging and in resalable condition, and must be returned freight prepaid.

4. No charges will apply to products that are considered defective.5. Items are inspected and photographed. Credit may not be given if Yosemite Home

Décor deems the damage as misuse of the product or poor return packaging.

Delivery Schedule

Yosemite Home Décor normally processes and ships your orders within 24-48 hours. We do not control delivery schedules by the carrier but make every attempt to use the carrier that provides the best service.

Damages

It is our goal to provide quality products to our customers. All of our factories carefully inspect each item before it is packaged and shipped to our warehouse location. Every effort will be made to insure your order arrives safely. Inspect your shipment immediately upon arrival. Should exterior damage to the carton be visible, make a notation on the shipper’s delivery ticket. Report any losses or damages to us at our office at once and notify the carrier. All damaged cartons should be saved until the claim is settled. It is the customer’s responsibility to handle any claims for freight damage or missing items. We are not responsible for any freight errors after the item has left our warehouse. Shortages must be reported to Yosemite Home Décor within 24 hours of receipt of product.

Yosemite Limited Warranty

Limited warranty. All Yosemite fountains sold are warranted by Yosemite only to customers for resale or for use in business, or original equipment manufacture, against defects in workmanship or materials under normal use for one year after date of purchase from Yosemite. Any product determined by Yosemite to be defective in material or workmanship and returned to a Yosemite branch or authorized location, as Yosemite designates items will be, repaired or replaced, or at Yosemite’s option, the purchase price refunded.
